This is exactly what is killing Ghana and most of Africa. People go through dry schooling without and practical knowledge and ability to demonstrate common sense. A system that was established by the European needing serious upgrading so our country's graduates could compete with the best in the world. This has unfortunately not happened, I wonder when.
Unfortunate as in the case of Ghana we praise this book-long know nothing fools, honor them like demigods and hand them the destiny of the country once they graduate and the results are there for us all to see.
Tsatsu is a no brainier like we had been made to believe all along, he is your typical African graduate full of pomposity due to blind praise and less access to education by many at their time.
Its time we start honoring people that can clearly demonstrate their abilities outside of the classroom before entrusting the destiny of our country into their hands.

Seriously if I had practised law I think I could have done a much better job. Why is Tsatsu not punching holes in the analysis Bawumia and the NPP have put out. Bawumia has consistently said the pink sheets have been used once in the analysis. I was expecting Tsatsu to punch holes in that rather than follow Tony Lithur who obviously was so lost in his cross examination which made him ask the same question like a 1000 times. Charley Bawumia no size.

What Tsatsu did today can't happen in a traffic court let alone the Supreme Court of Ghana. I have tried a lot of cases in the US and I have never experienced counsel in open court tell opposing counsel to "shut up" and get away with it. Such an outburst will immediately bring the wrath of the trial Judge or a disciplinary complaint against the offending lawyer. Tsatu's conduct is disgraceful and he should be sanctioned. It appears his time in Nsawam wounded him and he is angry at the whole world. He is not helping his client with his anger in the courtroom.

OKATAKYIE SARPONG, I must admit that I hardly follow the on going 'circus' at the Supreme Court but I watched the proceedings yesterday. Actually, I was astonished to see Mr Tsatsu Tsikata, an eminent scholar/academic and legal brain losing his temper. In cross examination, losing one's temper sometimes will imply that the witness got the best of the cross-examiner. If Tsikata feels he was being 'disrupted' by Mr Addison's objections, he could have respected the courtroom by being courteous and patient in his attempt to carry on with his line of questioning.
Most probably, Tsatsu felt his ego was being punctured by those objections, hence his 'shut up'-intimidating and condescending scream at Addison. Tsatsu fell into a 'baited trap' in cross-examination. This is Cross-examination, not Verbal Wrestling Contest!

There is a difference between “Can you shut up?” and "shut up". Tsatsu only asked mr. Addison wether he can shut up? Asking mr Addison to "shut up" would have been a command and disrespectfull, which he Tsatsu did not do. The Judges could have intervained if he did that. That is why they kept mute. Mr. Addison could have answered "yes" or "no", I don´t personally see anything wrong with Tsatsu´s question. It is rather a disrespect if mr. Addison did not answer him. We are to learn from this Tsatsu. The Lawyers of the NPP should know this and stop misleading us.
Can Addison sue Tsatu for asking him "whether he can shut up?"

What you don't understand is that, Addison is objecting and winning his objections because Tsatsu is asking questions that the law does not allow him to cross the Witness about.
Let me give you a clear example of what Tsatsu is trying to do that is not allow by the law. The Witness has been led in evidence by the Petitioners lawyer Addison. Tsatsu can only cross examine him by the evidence that was put before the court and cannot ask him questions that was not presented in evidence and Tsatsu has tried many times to do that and any good lawyer will object to such sophomoric tactics by Tsatsu.

"If nothing at all he won the case on the constitutionality of the fast track high court ."
Sorry I forgot to address this issue you raised. Tsatsu could not be credited of winning any Fast Track court case because he was not the Lawyer on record on this case but was a Defendent who did not defend himself as his own lawyer but he hired other Lawyers to defend him. Actually he did not win on this case but the Fast Track High Court was found to be Constitutional.
Fast Track Courts Are Now Constitutional -SC
By GNA
The Supreme Court (SC) by a six-five-majority verdict on Wednesday reversed its earlier decision on the constitutionality of the Fast Track Court (FTC).
The six judges made up of the Chief Justice, Mr Justice Edward Kwame Wiredu, Mr Justice George Acquah, Mr Justice Williams Atugubah, Mrs Justice Sophia Akuffo, Mr Justice George Lamptey and Mr justice Kwame Afreh held the view that the FTC was not alien to the Constitution.
The five dissenting Judges, who were hitherto in the majority and maintained their earlier decision that FTC was unconstitutional were: Mrs Justice Joyce Bamford Addo, Mr Justice A. K. B. Ampiah, Mr Justice F. Y. Kpegah, Mr Justice E. D. K. Adjabeng and Mr Justice Thoedore Kwame Adzoe.
The court awarded a cost of 10 million cedis against Tsatsu Tsikata, former Chief Executive of the Ghana National Petroleum Corporation (GNPC), who brought the application, challenging the constitutionality of the FTC.
Tsikata was arraigned at the FTC for wilfully causing financial loss of 2.15 billion cedis to the State. He allegedly circumvented laid-down corporate objectives of GNPC, when he by-passed the Board and on his own, committed the GNPC to guarantee a loan.
The amount, 5.5 million French Francs was granted by Caise Francaise de Development, a French Aid Agency to Valley Farm, private cocoa-growing company, in which GNPC held initial equity shares of 17.39 per cent.
Distressed, Valley Farm defaulted in the repayment of the loan and without prior approval of the GNPC Board, Tsikata allegedly paid out of its operational funds, the principal amount plus interest, all totalling 6,919,123. 23 French Francs.
This action of his, adversely affected the financial status of GNPC, hence a loss to the State. Tsikata did not plead to the charge and the trial judge. Mr. Justice Julius Ansah entered a plea of not guilty for him and admitted him to a 500 million-cedi self-recognisance bail. In his application before the Supreme Court Tsikata stated that the FTC had no jurisdiction to try him.
At Wednesday's sitting, while the majority contended that the Chief Justice (CJ) had discretionary powers under the constitution to create divisions of the High Court, which the FTC was one, their counterparts on the minority side, maintained that the FTC needed parliamentary approval to bring it into being.
The majority argued that since Article 136 (4) of the 1992 Constitution conferred on the CJ, the exclusive powers to set divisions of the High Court, the FTC which he helped to establish remained legal. To them, the FTC was an innovation of the High Court in that it used automated systems that helped to speed up proceedings to ensure the quick delivery of justice.
The majority argued further that Article 139 (2) did not spell out methods for the CJ to create new courts, clause (3) of that same article, however prescribed that the CJ established courts to try criminal, civil, investment and other related matters, hence the establishment of the FTC.
The judges with dissenting view, stated that the CJ had no discretionary powers to create divisions of the High Court and to do so, he needed the nod from Parliament.
