It was usually an eerie moment for the convict’s relatives, court reporters, lawyers, the convict and people in the public gallery: Before passing the death sentence, the court judge would in accordance with judicial tradition pick up and put on a black cap, before pronouncing those dreaded words: “…I sentence you to hang by the neck until you die. May God have mercy on your soul.”
What?! The Lord have mercy on a ruthless killer’s soul? On second thought, Jomo, who can tell with God, especially where there is genuine repentance? That is beside the real point though, which is that these days, court judges in Ghana keep playing a judicial hoax on the public in the matter of the death sentence.
It is a prank that does not appear to amuse the chaps from Amnesty International who called on Speaker of Parliament Professor Mike Ocquaye on Tuesday to press home the point: Whenever there is a change of political administration in Ghana, the Amnesty people always show up right on time to ask the new administration to expunge the death penalty from Ghana’s statutes.
You wonder why they bother to do that, since no convict sentenced to death in Ghana has actually walked the high road to the gallows for the past 24 years! No executions of convicts sentenced to death have been carried out in Ghana since 1993. It has left the hangman at the Nsawam Medium Security Prisons unemployed, and he must be wondering if he will ever get his job back.
Why then is Amnesty upset, and why do judges continue to sentence convicts to death? You wonder who the big joke is on, since capital punishment as a deterrent to violent crime, is dead serious business. On second thought, judges may only be handing down the maximum penalty for some categories of crime on conviction.
The death penalty has remained dormant in Ghana’s statutes probably to give the public a false sense of security while keeping the international anti-death penalty people happy. So why are they not happy and have to go and worry the Speaker of Parliament with the ritualistic request that capital punishment be expunged from our criminal justice laws?
The Amnesty people argue that in other countries, people have been convicted and sentenced to death for crimes they did not commit. They describe capital punishment as “cruel and inhumane” and not a deterrent against crime.
It makes sense to allow for a margin of error in any exercise and no statistics were provided to show whether cases of miscarriage of justice were so significant as to justify the abolition of the death penalty. I don’t know about capital punishment NOT being a deterrent to crime but the bit about the death penalty being cruel and inhumane invites a question: What about their victims? In Ghana, the majority of death row convicts are convicted robbers and killers.
Some crimes are so heinous that they weigh very heavily on the conscience of society. Makers of the law felt that such people must necessarily be kept permanently away from society for society’s own safety. That is how the death penalty came about.
It is unclear whether the folks from Amnesty broached the subject of the so-called gay and lesbian rights in their meeting with professor Ocquaye or whether the House Speaker only jumped at an opportunity to launch a virtual tirade against gays and lesbians as he did. It was a rather undiplomatic, unexpected and blistering attack on the so-called rights of gay people.
As you might expect, some homosexuals jumped on Professor Ocquaye’s neck and shoulders and pummeled the old man relentlessly on some Internet websites, for daring to suggest that gays in Ghana should be deprived of their rights to their sexual preferences.
Here is my opinion on this vexed issue about gays and lesbians, Jomo: They are children of God like the rest of us and have a right to personal choices but wait a second: Natural Law is a concept which holds that there is inherent in nature, a set of laws created by God to which all humans must conform. These laws are considered from the point of view of common sense, to be so self-evident that they are easily observed by everyone.
A study of the male and female reproductive systems in particular, should make it obvious to every sane person that their natural function is to come together for the purpose of procreation. A physical act in which an organ meant for excreting body waste is used as a sexual organ and which sexual act does not lead to procreation, is wrong. There is nothing like the right to do wrong, is there?
Unless anyone can provide evidence to the contrary, we must assume that the human rights referred to in the United Nations Charter of Human Rights pertain to natural rights. What is unnatural cannot be right or claimed as a human right, can it?
Professor Ocquaye might have gone to meet his Parliament House guests armed with a fat Bible with a bright red cover and quoted at the top of his voice from Leviticus 18: 22: “No man shall have sexual relations with another man; God hates that.”

Among the death row convicts, there must certainly be murderers. Put them to work! They've already demonstrated their skills on innocent people, and now is the time for them to show off those skills to their murdering compatriots.

Let us recruit just two from Afghanistan and sanitary will prevail. A village chief once complained of invasion of stray CATs in his jurisdiction. Two Ewe men were dispatched there and there was sanity within 3 days!!!.Bring Afghans to solve that problem

We have to understand that the decision to execute offenders condemned to death is solely the President's. Since the 60's, no President or Head of State has ordered the execution of a prisoner condemned to death BY HANGING.

However during the revolutionary era, some prisoners, particularly armed robbers and "alleged coup makers" condemned to death by firing squad, were accordingly executed. By taking the operational allowance which is just a subsituation for execution allowance, prison personnel are committed to hang prisoners when the order comes from the executive. They better prepare, for there is no free lunch.
