What is insane and judicial madness is the conviction of a journalist who reported Akrasi-Sarpong's comment. How can that be contempt of court? What happened to free media in Ghana? Where is the Ghana Journalist Association?

If Akrasi had evidence that these Nigerians were criminals, the judge should have seriously considered what he said. I really don't understand the basis upon which the judge granted the bail, but the story of the case required a critical look that favors Akrasi's point of view. There are some Nigerians who are very dangerous wherever they go, and can create seriously toxic environment. What is happening in South Africa now, with the hate for immigrants can partly be blamed on some Nigerians. There are other Nigerians who are hard working, who are looking for a peaceful place to earn a genuine life for the family, just like any immigrant. But the bad apples among them do make life unbearable for everyone else. Ghanaians should use common sense in cases like this. Otherwise we will find ourselves to blame. A lot of the genuine Nigerians have giving up hope for their country because of the few apples who are dangerously toxic. I lived with them, and know what they can do and undo. Gradually they are seeping into Ghana, and if Ghanaians fail to open their eyes it won't take long for Ghana to sink into serious societal problems.

1. It is not clear if the prosecution opposed bail to the accused, the drug dealer. But 1. given that the accused is a known drug dealer, the prosecution should have relied on his notoriety in drug dealings and 2. he is a wanted man for drug related crimes, and 3. his propensity or likelihood to jump bail, as the basis for opposing same (bail). But we don't know that.
If indeed, the prosecution raised an objection of granting bail to the accused, and submitted those aggravating factors as the basis, then the judge should have considered those factors. But again, we don't know.
But if that was the case, that the prsecution objected bail to the accused because he was deemed a flight risk but the judge ignored those factors and granted bail, thereby creating the possibility of the accused not availing himself for prosecution, then the judge erred by not considering those aggravating factors in granting bail to the accused.
For that reason. Mr Sarpong's comments are fair. At worse it is a critical observation on the bail decision which did not consider aggravating factors. His comments do not rise to contempt in a any democratic society; and I believe Ghana is one.
What also beats me is why the accused lawyer was the one who brought contempt charges against Mr. Sarpong ? Unless I misread the story, it s sounds very bizarre to me. The accused couldn't have, and shouldn't have brought criminal charges against Mr. Sarpong, who commented on his criminal activities and its consequent impact on the welfare of the general public.
As for the accussed's lawyer's argument that the comment would impact the decision of the judge is as bizzare as he bring criminal charges, not civil, against Mr. Sarpong. The whole thing conflated criminal and civil procedures.
Be it so, is the defence lawyer, by his assertion that Mr. Sarpong's comment would affect dispensation of justice, not an indictment of the judiacial system and lack of confidence in the seating judge's indepedent reasoning (unless it is a jury trial and probably the accused past criminal activities are not admissible) and suggestion of impairment of due process, not akin to Mr. Sarpong's comment which was imputed to him as being contemptous? Maybe, the defence lawyer should be cited for contempt too, this time by someone who has the legal standing to do so.
IIn any case, I honestly disagree that Mr Sarpong's comment was meant to 'derogate the authority' of the court, as per the presiding judge. Judgments and court decisions are landmines for legal and lay commentaries in democratic societies. They are not immune to critical analysis and comments. I'm truly dumbfounded by the whole drama, but I'm sure the court has absolutely nothing to fear from Mr. Sarpong's comment and shouldn't have entertained the charges of contempt brought by some one who lacks standing or is not in a position to do so. I REST.

Besides the legalities, sometimes, I believe, if judges can temper justice with mercy they should be able temper justice with common sense. A case in point is that of the adjudication of Ghana's presidential election litigation before the swearing-in. The supreme court, though was following the constitution, its delayed action, could have contributed to a possible chaotic situation in the country that might have led to civil disturbance if not war. Kenyan supreme court was in similar, if not same, situation in an election year that led to chaos and, if you may, a civil war with some deaths and injured citizens. They got it right the next time when the court forced the complainants and the defendants to work around the clock within a week or a little more to ague their cases. The judges gave verdict/ruling but deferred giving details of the ruling, that allowed the swearing-in or the inauguration to proceed at the constitutional time frame. Common sense then prevailed. I wish the judge in this case would have applied some common sense. I'm a novice when it comes to judicial matters, but I can assure the judge that if these criminals jump bail his career will be in danger. In fact I am horrified by his judgement that raises a big eye brows.

In which country in the world would a drug peddler be allowed to sue the head of the government agency on narcotics? Was Mr Sarpong not right to criticize the court's decision to grant him bail? Whatis the course of delay? Why hasn't the court ruled on the case? Look at how the British Authorities treated the Nayele case. It did not take more than a forthnight to decide.I think the judge must be investigated and sanctioned. This is corruption at the highest level. I think the state must intervene and send the Nigerian back to custody. he should be jailed for a very long period if found guilty. A sentence of not less than 40yrs in jail will be appropriate. It is about time the Ghanaian courts show to the whole world that they are not corrupt.

Oman Ghana, us all citizens of this beautiful country will have to rise up to defend our good elements as a society others are colluding with foreignets to abuse. Oman Ghana arise and be heard. Speak out in defense of common sense approah to dtopping drugs infilteration into Ghana. Yaw Akrasi Sarpong, like any Ghanaian every where you have an individual liberty, granted by God, not man, to freely comment on a post ruling court case. Its opinion, the judge might not like it , but that is your right as a citizen of Ghana. Question the judge's temperament, his judgement and appeal against his contemptious sentencing of your good self. We can not allow any single judge in Ghana to hide behind the cloak of socalled contempt to silence ondividuals into submission. You have a right to launch a massive judiciary inquiry into the jidge's behavior. Take your case to the next court to appeal against your sentencing as a former and immediate past anti drug boss. Also link up the USA DEA agencies to make sure the judge is placed under watch for suspicious ruling. Why did it have to take well over three years to grant bail to the alleged criminals and drug pushers from the Nigerians in this case? Yaw, you have a good case and i urge you to talk to Joe Case, Martin Amidu for legal opinions.

We will have to defy corrupt judges even if it means going to jail. SPCCAG & Africa is in full support of you. Akrasi, i urge you as a matter of priciple to throw your hat into the ndc presidential primaries if opened next time. Continue your push against illelicit drugs everywhere and anywhere in Ghana. Life after government is better put to use by forming an advocasy instution, agency for the purpose stated above. Our judges should bow their heads down in shame for instead of using the opportunity to reclaim a lost image they prefer to drag it further into the mud. Even a day old baby knows money influenced the Judge's decision to grant the fugitive from justice some respite. The judiciary must be purged of these unscrupulous judges otherwise lawlessness will become more attractive to criminal minded elements of society. There's crime everywhere in the world but in what we refer to as the developed world criminals are subjected to the rule of law and often punished as the law demands whenever their crimes are thoroughly investigated and are found guilty.
