Martin Amidu may be right from the point of the presidential pardon being interpreted as interruption with the judiciary. But on the reason why the Muntie3 and not any other prisoners, should deserve the pardon, no one can come out with any convincing point. These people have committed offences which they have in the end accepted and are punished accordingly. Why should the president pardon them? The reason that they have apologized makes no sense. Many prisoners have regrected and apologized but are still in prison for even longer terms. Some prisoners are even innocent but are in prison why don't we look out for them to grant them the presidential pardon. Because they were working for the president and the NDC, what a funny, irresponsible and childish reason!

2. There was no immediate demand for pardon as demonstrated by the lawyers of those idiotic Montie 3, as in the case of those NDC thieves in Kuffour's era.
3. There's never been such display of partisan pressure on an executive president to release convicted criminals for the mere fact that those criminals are his hirings and party members. What a timid and weakling of a president would JDM add to his chain of disasters!

I have seen a case like that where a Judge brought someone to Court for something that happened out of Court between the Judge and that person. The Judge was the Accuser, the prosecutor, the jury and the Judge!
The Judge was Judge Obiri Yeboah. I believe this Judge was eventually jailed for other offenses.
We cannot allow the Court to behave this way or we will all be in trouble. The process must be fair to all citizens of the Country.
Mr. Hamidu is talking about the Constitutional Rights of the accused, and the Presidential Right to Pardon; Mr. Hamidu is not talking about whether the accused offense must result in imprisonment or not.

So basically the argument the Citizen Vigilante is trying to advance is per legal technicalities, the crime of criminal contempt and the persistent assault on the Supreme Court by agents and assigns of John Dramani Mahama to undermine the independence, integrity and impartiality of the Court and the Justice system and coopt it to advance the political agenda of the Executive under the threat of rape, murder, violence and death is deemed not to have occurred, or even if it did occur, the process of seeking the conviction of the agents of John Dramani Mahama and the NDC party in general represented by Ato Ahwoi, Harry Zakour, Montie FM, the panelists and the incorporated bodies in his estimation is incurably flawed.
It makes for a plausible argument on the face of it, if that argument was inherently meritorious and actually eviscerated the contumacy of the contemnors.
That has not been disproven and failed to be disproven in Court. There are a million and one arguments that could also be made and advanced to support the argument that the process was as meritorious and consequential as any have been in the history of this country, drawing from other rulings in other similar jurisdictions.
My concern however, has to do with the office of the Attorney General and her inability or reluctance to initiate prosecutarial action in the face of such grave and egregious criminality and the intent of the Executive arm of govt to intimidate, cower and stultify the judiciary in the exercising of their rights in a democracy as unshrined in the Constitution.
That is a subject that makes for robust debate and of utmost relevance and significance, and not an Executive arm of govt seeking to exert dictatoral magisterial dogmatic doctrinaire oracular through the threat of rape, death, violence and murder in the case of Abu Ramadan et al vs the EC.
A Presidential pardon arising from such a situation therefore lends itself to a circuitous approach of establishing same, ie the original intent of the Executive to muzzle the judiciary and by extension the state, in a despotic and autocratic manner thereby clearly undermining the ethos of our democracy and the rule of law underpinning it.
That absolute right in the manner of the exerising the prerogative power of mercy by the President cannot be supported by the Constitution in such a whimsical and capricious manner and manifestly, no locus.

I have a lot of respect and admiration for Martin Amidu, but with all due respect I disagree with his position in the matter of three citizens issuing threats to kill constitutional officers of the Republic of Ghana. I cannot argue the legalities or constitutionality of the issue but I can argue the simple common sense aspect of this case. In the case of glaring dereliction of duty and malfeasance or mise as ancestors of the Attorney General, does it make sense for the Supreme Court to act? In the various positions that Martin Amid has taken on.public policy, I would support his right to life. I would oppose anyone who threatens to end the life of Mt. Amidu. As Ghana's "democracy" evolves, will we allow hooliganism and illegal and criminal behavior to become part of what we do. Where dies it end?

1. Kuffour pardoned those NDC thieves who were even his opponents after they had served well into their jail term. Not his own party members who had breached the law.
2. There was no immediate demand for pardon as demonstrated by the lawyers of those idiotic Montie 3, as in the case of those NDC thieves in Kuffour's era.
3. There's never been such a display of partisan pressure on an executive president to release convicted criminals for the mere fact that those criminals are his hirings and party members. What a timid and weakling of a president would JDM add to his chain of disasters if he should yield to this nonsensical pressure!

The rule of law is the foundation of a civic society.
I don't hold brief for these Monte 3.
I think they are vile and crumbs from the bottom of the barrel of nation- wreckers, aided and abetted some people who are Ghanaians in name only.
Yet, the rule of law-the process of the consititutional law- should have been followed.
The law is sometimes messy. Its application is fraught with dire anxiety in the ruling that may come down.
But that ruling is always embraced by both the winners and the losers because of their abiding faith in the fairness in the doctrine of "the rule of law."
Throw out that doctrine for the sake of expediency and anarchy and mob rule would rule the waves.
Mr.Amidu has a brillant legal mind, an African's replica of Floyd Abrams- a constitutional lawyer in the US- and should be applauded and not villified.
He has educated us- for those with an uncluttered mind- and, thus up to the Republic to defend it.
