Article 94 of the 1992 Constitution sets out the qualification and eligibility criteria for membership of Parliament. Key among the criteria is the nationality and age qualification which requires an MP to be a Ghanaian citizen of not less than twenty-one year and a registered voter. Persons with dual citizenship cannot be MPs.
The next important qualification is that of residential status by Article 94 (1) (b) the MP must be “a resident in the constituency for which he stands as a candidate for election to Parliament or must have resided there for a total period of not less than five years out of the ten years immediately preceding the election for which he stands, or he hails from the constituency”. IT IS A CONSTITUTIONAL REQUIREMENT TO BE A REGISTERED VOTER TO STAND FOR AN MP. THIS REQUIREMENT IS NOT STRICTLY ENFORCED BY THE POLITICAL PARTIES, BECAUSE THEY MAY HAVE QUALIFIED POPULAR CANDIDATES WHO HAD LIVE OUTSIDE AND NOT REGISTERED BUT ARE MEMBERS OF THEIR BRANCHES ABROAD, WHO MAY CONTEST AND WAIT TO REGISTER WHEN THE EC OPENS REGISTRATION PRIOR TO THE ELECTIONS. REMEMBER SPIO GABRAH THE FIRST TIME HE CAME DOWN FOR APPOINTMENT AS A MINISTER, HE HAD NOT BEING ABLE TO REGISTERED SO HIS APPOINTMENT WAS STOPPED, TILL HE HAD HAD THE OPPORTUNITY TO REGISTER.

Is it that difficult? Does the tax payer really have to waste money on a clear cut case? Was she a registered voter when she run for the position? Does the constitution state that the person has to be a registered voter? Why are they forcing her on us? Why doesn't Mr. know it all Rawlings do the honrouable thing and get his beloved daughter to withraw to fight in 2020?It doesn't only look bad but gives the impression "do as I say not as I do". It is a shame when they have the audacity to point fingers at others but shield theirs when they go against the law. sad.

Dr Rawlings have indicated to her Party that she would like to represent Klottey Korley Constituency in the 7th Nov 2016 Parliamentary election (WHEN THE TIME COMES BUT WHICH IS A YEAR AWAY). This to me the lay man is a statement of INTENT. Some years ago, I was in UK and my former tenant threatened to deal with me. He made the threat in presence of a Local Authority official. I promptly reported the case to the Police. It was explained to me that no offence has yet been committed because he has not done anything to me yet. But that would be too late - well that is how the law stands and I left the Station and thank God nothing really happened from his vain threat. To my understanding, therefore, because 7th November 2016 was still far away, she has merely expressed intent and it does not matter what her Political Party says or does, Article 94(1)(a) is actionable by only the E.C. She made her intentions known to her preferred Party (NDC). The Party needed to know if she was a Party member. i.e. holder of a Party Card. She satisfied this criteria and she was pitched against other interested individuals in the primaries where she trumped them convincingly. I therefore put it to you that because 7th November 2016 is still months away and there is a window for late registration to comply with Article 94(1)(a), her win over the others at the primaries was legitimate as far as the Party was concerned. Article 94(1)(a) cannot be evoked at Party level unless there is a specific NDC party article which has been flouted. The E.C. is the final authority. She has not as yet filed her papers with the E.C at the time of the contest in her Party. Also just supposing there would be a specific amount to pay as Deposit before she could register with the E.C but she has not got the exact sum as at November 2015 or when their primaries took place but she had hoped to have the money before the registration with the E.C opens. she would not have contravened any law. If when it came to registering with the E.C. she has not been able to raise the money, she has wasted the time of her party and her nomination will be annulled and a quick contest will be organised by her party. Her real issue is therefore exclusively with her Party and interpreting Article 94(1)(a) broadly is ineffective in my lay man's view. Many things can happen which can disqualify an individual from registering after wining the primaries that wining the primaries does not provide rubber stamp for recklessness. As Dr Zenator has now complied with the E.C. regulations as enshrined in Article 94(1)(a), she is now the bonafide Candidate for her Party at Korley Klottey.
