Why do you go around releasing feeble statements and comments like this without concrete actions. You guys look weak and easily intimidated by this NDC crooks. Test the legal system on this issue and if they also agree with the government that it's ok to disregard and disrespect the court in this way, then their ruling will will set a precedent for the future. If the courts allow this disrespectful action to slide by, then we must as well kiss good bye to our democracy. This case has a huge implications for the survival of our democracy but it looks like our timid judicial system is so scared of the government that it has become totally impotent. I guess the judiciary helped imposed this fraudulent government on us so they are paying homage to it.

I know some Ghanaians who were detained for criminal activities here in the USA but later released before their trial to be deported by the US Immigration, because they were in violation of immigration laws. Now who says it can not be done?

US immigration will NEVER usurp the authority of the judicial system and deport a person while a court case is still pending. This thing only happens in a jungle country like Ghana where your government and security people have absolutely no respect for the judiciary. This is a hugely bad precedent being set if the judiciary doesn't drop the hammer heavily on these crooks. This smacks of total disrespect on the part of the government towards the judiciary.

Immigration can deport anyone unlawful entrant or homeland security can deal with anyone according to their legislative power but they can't usurp the power of the court in any real democracy.

Once you resort to the court, it is only the court that can make the final decision.....

You guys don't understand the issue here. It's not about the prerogative of the immigration service to deport illegal immigrants. There's no question about that. However, when there's a case before the court, they cannot deport until they withdraw the case. This can always be done in an instant when the subject is deemed a security threat. In most cases the withdrawal is done so fast that the lawyers of the subject won't even know it until the deportation is done. To the ordinary person on the street, it will seem that no legal recourse was followed. US is a country of laws and immigration will not blatantly flout a court order under the pretext of national security threat without going through the courts. It's not obvious to you but there is a standby judges all the time to accede to judicial issues at the blink of an eye. There's nothing to show that this happened in the case of the SA3, and that's the issue we are talking about.

It wasn't the Immigration Services that sent to court initially. So the GIS had a very free hand to handle them their way and surely they did by deporting them..

Why did both work in cahoot to nullify the court order by deporting the SA3 on the blind side of the judge? This is tantamount to ganging up to outwit the judge. Now the stupid BNI wants to open up investigation into the whole saga but they have foolishly shipped the material witnesses off to South Africa. Every investigation will hit a dead end, as those involved will invariably plead innocent and defer every question to the three deported South Africans. This is how stupid your government and its agents are.

This is an issue which borders on the security of the nation and he is talking about the Rule of Law. Mr.Otoo is expecting the National Security agencies to wait for Rule Of Law to determine what is relevant for the Security of the Nation.
Then why should the Executive arm not take emergency decisions when the security of the nation is deem threatened?
This decision was taken in the supreme interest of national security and there is no time to waste for NPP's rule of law in such matters. The case is close.

One may have a case in court and the police will use his own smart law of which is within their authoriity and repatriate you without allowing the court to finish with you with the case in court.

They have their tentacles spread all over our security agencies, judiciary, financial institutions, drug barons playing money launderers, the 'one meal a day' fed street tugs and probably the military. Any time the national security with the help and backing of the government flaws with blatant impunity, and undercuts our courts, it becomes clear to all that there is no justice, and if no justice, then no rules or laws. It's do what you want if you can get away with it. The gate is wide open for them to come and catch, beat, maine, jail and most likely kill or bury you alive like Papa Doc's Ton ton makuts used to do. It's going to be pure terror and hell from now on. Just mark it on the wall. If Mahama does not go, we might as well run and seek refuge in fulani lands. These guys are here to win anyway they can. (1) A foreign national is liable to deportation if—
(a) a court recommendation for his deportation is effective under subsection (2) of this section;
(b) he has been found by a court to be destitute or without means of support or to be of unsound mind or mentally handicapped;
(c) he is a prohibited immigrant;
(d) he is in Ghana without a valid permit, or any of the conditions on which his permit was granted has been broken; or
(e) his presence in Ghana is in the opinion of the Minister not conducive to the public good.
(2) A recommendation for deportation is effective if it is made by a court upon conviction for an offence punishable by a term of imprisonment exceeding three months with or without a fine and
(a) on an appeal against the conviction, the appellate court has upheld the recommendation; or
(b) no appeal has been brought within the time allowed for appeal but the recommendation was made by—
(i) the High Court, or
(ii) an inferior court and has been approved by the Chief Justice.
(3) Where a court makes a finding under paragraph (b) of subsection (1), the court shall report the finding in writing to the Minister.
