I wrote about it yesterday,he is just wasting his time and money if he spends money to do what will end up being thrown away in court as happened to most of his works in the past.
Investigative journalism is not done in secrecy,the investigators don't plant evidence on people they are investigating,they introduce themselves telling them the network they work for and what they are investigating as Azure did in the case of Dr Gabass which got the doctor convicted for sodomizing a teenage boy,although some of us don't like the way he nailed that doctor he really did what investigative journalists do unlike this so called Anas who always hide his identity while exposing others and will not defend his actions or findings in open court as done everywhere.
I wonder what type of Attorney General Department we have that will quickly give him immunity without investigating what he has been doing.
Don't forget that it is a crime also in some jurisdictions to tape people without their knowledge,he has no right to do what he is doing,he is not undercover agent protected by the law,he is a journalist and must exhibit professionalism in his work as journalists do.
Just mark it down,all this nonsense will come to nothing,none of this people will go to jail,the guy cannot prove or defend his work in court of law,he can only win the case in court of public opinion unless we put the law aside to use martial law to jail them.
Some of us don't support corrupt people but we cannot fight corruption this way to succeed,in Ghana almost everybody is corrupt so unless we change our way of doing things no amount of tape recordings will solve the problem.

If the system should let the 34 judges of the hook, we will never be able to fight corruption again either in the judiciary or in any other sector, which we badly need. The framers of the constitution did not intend to protect rogue judges in the system or any other criminal for that matter.

Do you remember that even Papa Jerry said something of that sort when the death of Ya NAA and forty of his collesgues were murdered? We heard of Asare Djan not long ago. To me, such tapings are illegal and those offended can be sued. Yes, I remember the case of Capt(Rtd) Mfojo too.
I congratulate Anass because we all know these developments have been going on for centuries, even during the AFRC and NDC under Papa Jerry who no oe dared do that. In all forms of corruption, Mahama is mentioned but now it is the judiciary. The Doctors and some Headmasters will focus very soon.
I think Anas has been give a Blank Checque to operate. There are instances where his investigations failed and would have lynched but luckily for him, the state saved him. so I think Anas has a kind of protection.
Corney, corruption is so serious in Ghana that if you do not have money your case will never see the light. Your docket may be even missen but found as soon as you do something. There is bribery everywhere, but it becomes annoying when people are making chop-chop of Ghana's money and set people like Wayome go scot free.

They belong to the high class of citizens, so they might walk free after all, but this is an opportunity for Mahama to demonstrate that he is serious about the fight against corruption. Even if this evidence is thrown out a lot has been achieved by letting the world known what goes on in chambers.

How can an office be private, especially, if it is a public office? Any office that is used to provide a service of a public nature is not private. For example, if a lawyer or any professional opens an office his his/her home and operates from there, receives members of the public in that office and provides advice, that office no longer becomes a private office but a public one.
What is important is not only the modus operandi of Anas but whether the matter for investigation is of public interest. The answer is definitely and hugely yes on this occasion. That over-rides the private interest. In some cases, it is right and appropriate to breach private interest for the public good and I believe this case is one.
Finally, the Whistle Blowers Act also justifies what Anas did, irrespective of the methodology.

This accomplice of a lawyers, Asare or whatever his name is, confirms what I say to people all the time, that, democracy is the reason why Africa and Ghana for that matter is still under developed.
They will steal, kill, rape, in fact do all sought of evil things and so long as they are able to cover their tracks they are always free to walk on our streets because most victims can never proof their abuse without any documentary evidence. These judges and lawyers know this and they exploit it big time.
They know that majority of the people in Ghana are illiterates or 'educated illiterates' and most do not understand their rights under a democracy so they exploit them.
Just listen to this lawyer, even when his seniors are caught on camera, thanks to technology, he is finding ways to say that the information was collected illegally so it cannot be used against the accused. This stupidity and nonsense can only be tolerated under a democratic dispensation where the big fish eat the small fish with no mercy!!!
In Ghana, the rich and powerful will always tell you to provide evidence or proof their guilt with documentry evidence whenever you have a case with them. They know most people are naive so when they start their moves they always have an exit plan.
This time Anas has exposed them and no amount of judicial/legal nonsense will free them of the shame. Their colleagues in their cult profession may exonerate them because they all belong to the same fratenity, but the shame will forever hang on that profession called law and the judicial service of Ghana!!. Somebody should tell him that you can do such stupid things in Europe but not here in Ghana.
I don't blame him. I blame the whole legal and judiciary establishment that has imported an incompatible legal system which is wholy unsuitable and unproductive for our needs and requirements.
Somebody should tell the fool that as far as we are concerned, the end justifies the means. The people have been caught manipulating the existing justice system for their selfish and greedy capitalist ends and they have been caught. Period!
Unfortunately we will have to use their own dubious brothers and sisters in the same cranky courts to judge whether they are innocent or guilty of the crimes they are alleged to have committed.
Left to me alone, I would have suggested that due to the seriousness of their alleged crimes, they should throw those dishonest judges to a military tribunal to effectively deal with them. As for our soldiers we all know that they are crazy and they see things only in plain black and white - no grey areas for consideration.

The constitution of Ghana should be sacrosanct and should not be misinterpreted by anyone suggest that it tolerates this kind of monstrous betrayal of trust. The bad nuts should be exposed and expelled to restore the trustworthiness of the Judiciary so that everyone will be sure that when s/he is appearing before them s/he will have justices.
Some citizens were castigated by various bodies when they dare said there was corruption within the judiciary. Do you remember what was said to the late Larry Bimi, Dr. Raymond Attubiga and co when they braved it and mentioned this cancer to the public? If you are a foreign investor, and you think of investing in Ghana, one of the things you think about is just how much bribery you are willing to pay. If you are such a foreign investor, you have alternatives. You can go to invest your money in Singapore or Brazil or Israel. You get to decide which jurisdiction will give you the least headaches. This Lawyer Asare can rationalize graft and corruption and bribery all he wants. Ghana, with such citizens as this Lawyer Asare, is destined to be a backward undeveloped country for the next thousand years! If i am a corrupt citizen, and I offer an honest judge a bribe, it is his job to indict me for making such an offer. The judge ALWAYS have the prerogative to refuse the bribe. This is what I expect a reasonable lawyer to do by explaining issues to us
A major conundrum arising from the expose of the judges/magistrates' bribe-taking:
What will become of the cases that they heard and for which they took the bribes to subvert justice? Will the victims be given another trial or automatically freed on account of the impropriety occasioning their trial?
I am not a lawyer, but I can stick my neck out to say that the revelation has a lot for us to worry about because of the legal implications.

You steal from Wal-Mart and get caught on the Camera and your defense is that, the camera should not have been installed where it was installed?
Suppose a father is suspected of molesting his daughter and an uncle of the daughter plants a camera in the house, and the father is caught in the act of molestation on that camera, the father can walk because he did not know that his brother has planted the camera in his house?

What Ana has done is heroic, infact it is what happens daily in the matured democracies or journalist ought to be doing this continuously as CCN, Fox News NBC stations do continuously to rid their societies of criminals and bring out the truth. Anas is not supposed to inform the whole public in advance of his findings in future all he needs to do is air his findings for all of us to see and judge. What is the whistle blower law supposed to achieve? Whistle blowers should be giving immuinity from prosecution and their identities should not be revealed, that is the only way we can win this war on corruption.The government should stand firm on this and be counted, there should be no cover up we must hold the bull by the horn, others who have experiencies of bribery and corruption should be given immunity to come forward and tell their stories so that the judiaciary can be cleaned once and for all. It is the revolution of the civilians we have all be waiting for all these years. Some of us know it will come to this, because the rot cannot be allowed to continue forever. There's a total breakdown of our systems of government,justice and law enforcement. In the advanced democracies,these systems, even with all their natural tendencies and imperfections work satisfactorily for the people they serve. Anas private investigations are a necessary but inconvenient evil because they fill a void. If we abhor Anas modus operandi and characterize it as invasive and intrusive then we as a -people must provide a solution to fill the void his absence will create. Sometimes you wonder what's wrong us. Our elected officials and their appointees are overly corrupt, inefficient and ineffective but we keep re-electing these officials to second terms in office to complete their destabilization process. What's wrong with us all? Between Anas and any inept administration I'll always choose Anas because his operations constitute the lesser of two evils.

4) No one fixed cameras in any lawyer's house or offices. In investigation science, there are numerous ways of gathering evidence. As a former media investigator myself, we do not use static cameras etc. Each investigation determines the methodology to be used
5) Whether the judges were coerced or not is irrelevant. It is their corrupt minds that led them into visibly taking bribes. If you are not corrupt, nothing will lure you to accept a bribe. Not even the Devil can lure you because he knows you are incorruptible.
6) From the exposition so far, neither Anas nor any member of the team physically gave or coerced any judge. It was their subordinates who know their corrupt bosses who were complicit in the corruption. I agree that the defence lawyer will agree that "had it not been for their action...". The question however is not about Secondary Liability. The fact is a Judge is alleged to have accepted, taken, traded justice and pocketed 'bad money' for his personal greed contrary to his oath of office. Whether he was coerced, beaten, slapped and his balls squeezed or not is irrelevant.
7) Those lawyers jumping to the defence of their colleagues may themselves be corrupt or guilty or afraid of their own shadows. They are crying foul, in case the net was cast beyond the present, that they might not be subjected to the untold hardship being suffered by their colleagues. This is a Cock and Turtle Syndrome.
8) It is nonsense to argue that the investigation is illegal if not commissioned. You can not tell the media what to and what not to cover. President Mills, a Lawyer, once Commissioned Anas to investigate and expose corruption in State Institutions in Ghana.
9) Corruption is a global issue and an offence in many countries including Ghana. Anas is not an individual investigator, he works for a legal organisation that has among its objects exposing ills of this nature to the public.
10) Anas petitioned the Judical Council on what was happening. The AG, CJ and relevant authorities would have therefore known about it or had hint about this matter. In his Cocain and smuggling investigation, the top heirachy of the Police Serve knew about it and cooperated with the investigation. When the culprits were brought to book was it not the same investigation that was used to convict the culprits? Were the culprits not Ghanaians and for that matter human beings? As a nation we do not have two sets of Laws, I guess.
The CJ, President, IGP and anti-corruption agencies are all worried about corruption in institutions of State and have no clue as to how it can be tackled. Lawyer Asamoah et. al., are now questioning the legal basis for exposing corruption possibly because they are a thieves themselves or just wanting media exposure as a lawyer to promote their trade - which is it? For me those who stand sharply against the current exposure are anti-state and very bad citizens hiding behind the cloak of democracy. In fact, looking at it carefully, such people are not democratic because democracy is about upholding the rule of law. I find it difficult to understand why Asamoah in particular should say 'the public should not rejoice' yet for stamping this level of corruption in the head. Even if it was not proven at the end of it, the fact that it has sent positive vibes to public office holders is a great feat and cause to celebrate in the wildest imagination of humankind. I know that when dry bones are mentioned some people, but sorry, it is still dry bones.
My advice to you dear "defence" lawyers is, if you don't have the moral standard to do public service, try the private sector.

What about the famous land courts? Right down to the bailiffs, the list goes on... However, the perception of the General Public that: "Judges take bribe" to favour or jeopardize a party's case is a living nightmare for all litigant. However, you dare not even whisper such a taboo in fear of being sued, and unable to prove it. I have a client who told me about a bribe they've bribed a Judge. He added, if the Judge does not keep to the bargain, he will expose him because he had secretly recorded the transaction.
The big billboard on the High Street of Accra in front of the High Court; shouting "Justice is not for sale (Sounds like a joke). "You have to play your part to ensure it". How is a party expected "to play his part to ensure it" when the presiding Judge and other Judicial staff is corruptible? The only PART a party can play is to bribe them if not, no so called Justice. Irrespective of the widely pasted notice in every corner, door, window of the court saying it's an offense to give gift or to receive it. Let's get real: Is Justice not for sale? LOL!!!! It's become a good material for standup comedy. Wow!

2- Crime and fraudulent/dishonest acts is not protect by Privilege.--- Therefore no immunity for the Judges and Judicial Staff.
3- How else could this offense be reported and support with evidence beyond reasonable
doubt, Lawyer Asamoah Asare?
4- Section 51 & 52 of the evidence decree act 1975 (NRCD 323) makes this admissible
evidence because it is relevant to the determination of the truth.
5- Kuruma vrs The Queen 1955. - The Common Law case study .
6- Jones v. University of Warwick [2003] 1 WLR 954--- Common Law case study.
THE EVIDENCE DECREE ACT 1975 NRCD 323.
1- RELEVANCY
Section 51—Relevant Evidence Admissible.
(1) For the purpose of this Decree, "relevant evidence" means evidence, including evidence relevant to the credibility of a witness or hearsay declarant, which makes the existence of any fact that is of consequence to the determination of the action more or less probable than it would be without the evidence.
(2) All relevant evidence is admissible except as otherwise provided by any enactment.
(3) No evidence is admissible except relevant evidence.
Section 52—Discretion to Exclude Relevant Evidence.
The court in its discretion may exclude relevant evidence if the probative value of the evidence is substantially outweighed by—
(a) considerations of undue delay, waste of time, or needless presentation of cumulative evidence; or
(b) the risk that admission of the evidence will create substantial danger of unfair prejudice or substantial danger of confusing the issues; or
(c) the risk, in a civil action, where a stay is not possible or appropriate, that admission of the evidence will unfairly surprise a party who has not had reasonable ground to anticipate that such evidence would be offered.
2- PRIVILEGE does not protect discretion in which advice is given as to the setting up or carrying out of criminal or fraudulent conducts. (Applicable in Expose).
3- unlawfully obtained evidence is prama facie admissible in civil proceedings.
However, such evidence may be excluded by the Judge exercising discretion. However,
in practice that discretion is generally exercised in favour of admitting evidence.
In addition, evidence may be excluded by the court exercising it's inherent discretion to
prevent the court process being abused or brought into disrepute.
In any event, there will be a balancing act to be performed which necessary involves a
consideration of the conventional rights involve.
4- The law requires the source of the information to be disclosed in a timely manner. No Pop-up surprises on trial. (Anas complied with).
5- The Common Law Principle.
In criminal law, the general rule is that all relevant evidence is admissible. As Lord Goddard
said in Kuruma v The Queen [1955] AC 197, 203, “the court is not concerned with how the
evidence was obtained”. Lord Goddard made reference a remark of Crompton J in R v
Leathem (1861) 8 Cox CC 498 , 501, which is now often quoted. Overruling an objection to
production of a letter which had been discovered in consequence of an inadmissible statement made by the accused, Crompton J said:
“It matters not how you get it; if you steal it even, it would be admissible.”
The starting point in civil proceedings is therefore that if the evidence is relevant it will
ordinarily be admissible. There is no rule of law that evidence must be excluded simply
because it has been obtained illegally or improperly.
Indeed, it may be the case that, as in criminal cases, in civil cases the courts did not even have a common law discretion to exclude evidence which would otherwise be admissible (i.e. evidence which is relevant) on the grounds that it was improperly obtained:
so far as civil cases are concerned, it seems to me that the judge has no discretion. The
evidence is relevant and admissible. The judge cannot refuse it on the ground that it may
have been unlawfully obtained in the beginning.
Kuruma v The Queen principle concerned us with vindicating the truth with the aid of relevant evidence, rather than excluding evidence on the grounds that it has been improperly come by. The Kuruma v The Queen principle cannot be said to have privilege even where crime or fraudulent (dishonest act ) has been committed to obtain the information.
Jones v. University of Warwick [2003] 1 WLR 954.
The leading case is Jones v. University of Warwick [2003] 1 WLR 954. In that case, the
claimant argued that she had a continuing disability in her right hand as a result of an
accident at work. The defendant employed an inquiry agent, who posed as a market
researcher and used a hidden camera to film the claimant in her home. The videos showed
that the claimant had entirely satisfactory function in her hand. It was accepted that the inquiry agent had been guilty of trespass – a civil tort. The claimant argued that the court should exercise its discretion under CPR 32.1(2) to exclude the video, and that medical experts who had seen the video should also be prevented from giving evidence. In making that argument, the claimant relied on the Human Rights Act 1998, and in particular Articles 6 (the right to a fair trial) and Article 8 (the right to respect for one?s private and family life, home and correspondence).
Lord Woolf CJ, the architect of the CPR explained in detail how the CPR should be applied
in such a case:
“A judge's responsibility today in the course of properly managing litigation requires
him, when exercising his discretion in accordance with the overriding objective
contained in CPR Pt 1 , to consider the effect of his decision upon litigation generally.
An example of the wider approach is that judges are required to ensure that a case
only uses its appropriate share of the resources of the court ... Proactive management
of civil proceedings, which is at the heart of the CPR , is not only concerned with an
individual piece of litigation which is before the court, it is also concerned with
litigation as a whole. So the fact that in this case the defendant's insurers ... have
been responsible for the trespass involved in entering the claimant's house and
infringing her privacy contrary to article 8(1) is a relevant circumstance for the court
to weigh in the balance when coming to a decision as to how it should properly
exercise its discretion in making orders as to the management of the proceedings.” (at
961)
“The court must try to give effect to what are here the two conflicting public interests.
The weight to be attached to each will vary according to the circumstances. The
significance of the evidence will differ as will the gravity of the breach of article 8,
according to the facts of the particular case. The decision will depend on all the
circumstances. Here, the court cannot ignore the reality of the situation. This is not a
case where the conduct of the defendant's insurers is so outrageous that the defence
should be struck out. The case, therefore, has to be tried. It would be artificial and
undesirable for the actual evidence, which is relevant and admissible, not to be
placed before the judge who has the task of trying the case. We accept Mr Owen's
submission that to exclude the use of the evidence would create a wholly undesirable
situation. Fresh medical experts would have to be instructed on both sides. Evidence
which is relevant would have to be concealed from them, perhaps resulting in a
misdiagnosis; and it would not be possible to cross-examine the claimant
appropriately.”
The Court therefore admitted the evidence, although it did order that the defendant should
pay the costs of dealing with the issue at first instance and on appeal.
In practice, surveillance footage continues to be used regularly and as long as it is disclosed
in a timely manner, is generally permitted. In the cases since the decision in Jones, evidence
has generally only been excluded where it has been disclosed late in the day (so-called
„ambush? cases).

Cabinet has given approval for the enactment of a Whistle Blowers Act to encourage people with information on corruption to report to the appropriate agencies for the law to take its cause.
The Attorney-General and Minister for Justice, Papa Owusu Ankomah, disclosed this at Sekondi in the Western Region. He was addressing the Sekondi Youth Congress of the New Patriotic Party (NPP).
A Whistle Blower is someone who tells people in authority or public about dishonest or illegal practices in business and government. The passage of the Whistle Blower’s Act by Parliament will be the fulfillment of yet another promise by the government.
The government on assumption of office promised a zero tolerance for corruption and assured that it would set up an accountability office at the office of the President which has already been realized. In addition it assured that it will table before Parliament a Whistle Blowers Act to encourage people to volunteer information on corruption practices
