His powers under the constitution in this regard are perfunctory and not substantive like appointing his own ministers. His appointment of the lady is, therefore ultra vires because the president is a leading political player and does not have substantive powers under the constitution to appoint the political referee. In fact, the appointment is against the letter and spirit of the constitution. Our constitution does not seek to give undue advantage to one political player over the other players, and the real meaning of the word "advice" must be understood in its constitutional context.

from a Ph.D holder in political science.Afari Gyan stands tall and is widely respected internationally.The NPP won two terms under Afari Gyan coming from opposition.The NPP right from time in memorial have penchant for inciting violence and mayhem anytime election results don't favor them.Most of the political upheavals and assassination plots in past times in this country that could have easily resulted in civil war was orchestrated by the NPP.I remember the secret meetings and plan attacks organized on Legon campus in commonwealth hall that led to student agitation (mobrowaa struggle)against the latter days of the Rawlings Government.I remember the near mob action and lynching of then deputy interior minister Tony Aidoo by irate students who have to pull a pistol to safe his life upon visiting commonwealth to engage students in a peaceful dialogue.In my view Charlotte Osei is relatively neutral with the requisite experience to supervise a fair and transparent election.But the rush prejudice and heckling against her is unfounded other than a commonest inferior tactics by the NPP to intimidate her into doing something undemocratic in their favor.I am not holding brief for the Mahama Government that have to face insurmountable obstacles in the wake of deliberate machinations by the NPP to make the country ungovernable and in turn consciously incite the populace against an unpopular government.The court petition hearing challenging the legitimacy of the President was needless,counterproductive,unpatriotic and unnationalistic.It was certainly a major drawback for the country's economic and developmental progress not to mention the numerous NPP incited demonstrations and labour agitations that followed.The government is still grabling with issues of industrial actions with the GMA setting a deadline for en-mass resignation on June 30th on pretext of Service Condition that is being worked on by the MOH.The leadership of the GMA are sympathizers or surrogates of the opposition NPP.Sabotage of government in public institutions by anti-government forces mainly sympathizers of the NPP are galore some in the known, some unknown.The Mahama Government should be blamed for repeating the same mistakes of not heeding to the advise of the Founder in purging the system of anti-government forces with the sole aim of undermining his government.The NPP is rather over confident in having an easy run to victory come 2016 in the wake of the numerous challenges confronting the Mahama Government which they contributed in large measure to.I may not be an expert like Dr.Amoako Baah who is a political Scientist.But my candid opinion on the bases of the facts on the ground is that politics in Africa and for that matter Ghana is not won on the bases of performance.The voting pattern in Africa is not issue or developmental based.Marketability of candidate,communication skill of candidate,political strategies(both crude and refined),political financing,ethnic/tribal/clan lineage and religious ties play a major role in the outcome of election results in Africa and for that matter Ghana.For the simple reason that the large chunk of our population is the ignorant,rural poor these factors will dominate the outcome of election results in African/Ghanaian politics for a long time other than development gains chalked.Even more so for the simple reason that development hardly go to neglected rural areas of Ghana with politicians capitalizing on their illiteracy,ignorance and poverty to ruthlessly exploit them without accountability.This is the very reason why some non-performing MPs have been in parliament for decades barely visiting their constituency not to even talk of development.People following the exploits of the Mahama Government know he can potentially win the 2016 election even by a wider margin because he is one president with a lot of focus on rural development.There have been a lot of rural projects under his government including rural electrification,water,sanitation,health and road projects.This combine with the above mention factors still make him the favorite as an incumbent.There is wins a democratic election judging by what happened in 2012 that eventually led to the court petition hearing challenging his incumbency.Every patriotic citizen particularly the state security apparatus should be vigilant in ensuring Ghana remains peaceful and stable irrespective of the outcome of the 2016 election.The likes of Dr.Amoako Baah are beating war drums by their very attitude and should be call to order.
