Those are not the facts. The charge sheet which is in the public domain is the accuser swearing that there was physical pressure, threatening behaviour and so on. This is not the borderline rape issue that there was no one around. Mind you, her cousin was in the very room. Her boyfriend was also there. There should be abrasions. She should have at least felt physically hurt. She should have attended hospital fir some sort of physical treatment. She should have reported the alleged rape to the police immediately.
Mind you it is a common law jurisdiction so you have to prove beyond doubt that what you claim is true by showing concrete evidence. Also in common law jurisdictions, circumstantial evidence can play a major part. Please read the Ghana law reports on rape.
That is why in the UK only about 7% of rape allegations results in conviction. This is what the feminist are lobbying so that in rape cases only, the common law principles are not applied just to artificially bump up rape convictions. This is different in a jurisdiction like California where rape cases are convicted only on consent which has got a technical and very wide meaning which cannot be explained easily here. Technically, in these jurisdictions any sexual intercourse is potentially and technically rape. This is because consent technically means either the female says stop and the male does not stop as you mentioned, the female regreting of having sex and later claims rape, or her needs were not met whereby she claims rape and so on. That is why many men tiptoe around women in such jurisdictions especially those with fame and wealth.
Now if KKD faces a feminist judge, then she may throw away the common law principles and rule based on her emotions but he will win on appeal. I do not think he will like to go through that.

My client was accused of rape and arraigned before a district court here in the USA. The prosecution offered to reduce the charge to a Class C misdemeanor for my client to accept some sort of blame and pay a small fine. That was a signal enough that they had nothing on him; although my client was willing to sign on to the plea deal.
I wrote to the prosecutor that my client was just not "not guilty" but was innocent, and therefore even if all that he was being asked to do was to bat an eye in order to go free, he would rather go blind. I stated my alacrity to go to trial to prove my client's innocence.
Soon thereafter, the case was dismissed, and the judge was full of praise for me......My point is that with a serious charge like rape, your innocence should be beyond any shadow of doubt, and you must come out totally clean in order to be clean indeed.
KKD's apology leaves a cumulus cloud hanging over his innocence.

By his public expression of remorse and recognition of adverse impact the incident is having on both parties,I doff off my hat for KKD. Ewura herself has withdrawn the case and I can see KKD by this public statement may have apologised to Ewura before going public. When a convict is being sentenced, one of the key things a judge looks at before giving a jail term is REMORSE as has been demonstrated by KKD. No matter your know-it-all posturing here, this is a remorse and I am sure both parties will thread cautiously going forward and many humble people following this story will be guided by it and thread cautiously, I am sure you are not one of them. 2. Every apology substantially weakens the case of the defense, and might automatically lead to an admission of some culpability.

3. Up to now, KKD had an iron-clad defense; today, I am not so sure.

4. Very few Ghanaians can think right; so don't be too disappointed in your full display of stupidity here.

Nobody is saying he should not be remorseful but to say you have sinned is uncalled for,u he rushed to send that apology.
Although the lady has withdrawn the case what will happen if the prosecutors decide to use his own apology letter which states he has sinned to continue with the case?

When a woman says no, you should be prepared to put some ice on that flagellum. It does not make any difference whether she is your wife, your girlfriend or a street girl, no means no. If you use brute force to have your way you will be considered a criminal and charged with rape.
The fact that the girl did not scream did not indicate that she enjoyed it. She just wanted to save her life. Hot head KKD was temporarily insane at the time. He could have done the unthinkable.

If the sexual act was consensual, the age of the girl in this case is irrelevant. People bring in the moral argument. You can keep your moral code to yourself. You can not impose your moral code on anyone.
I do not see anything wrong with KKD's apology statement. If he says he is sorry, it has nothing to do with admission of guilt. It has everything to do with the impact on both families. If he had not had sex with her we would not be having this discussion now, hence he is sorry for the pain that everyone is going through, and that includes the girl's friends and KKD's fans. Most of you guys chastising KKD are having sex with 18 and 19 year old girls and buying them cell phones, tablets etc.
The bottom line is, if you are not an eye witness to any situation, you can not pass judgement.

Bingi, if the lawyers for the defendant believe that they can win on that ground they will never advise their client to apologize.
Anyway, how many are people are usually invited to watch people making love. Eyewitness to sex? We are having this discussion because most us do believe that a woman has no right to say no to sex if she enters a man's bedroom. In a civilized world your wife can even sue you for rape if you use brute force to have your way.
