4 You will not find anybody willing to go out with you.
5.Nobody will believe you anyway.

For these reasons ,many women who are raped go for the lesser evil which is keeping quiet and sweeping it under the carpet as if nothing has happened.
An example is when i bumped into old mates from Ghana and we were having a chat and i mentioned that i've just bumped into a famous Pastor from Ghana .One of the ladies then passed a comment that the Pastor once tried to rape her but she managed to escape. I was even dumbfounded when the other 3 girls also said he had done the same to them. The place just went quiet because none of them had reported this and therefore this Pastor is carrying on raping his church members. It dawned on them the severity of what they were saying.If there's is 5 of us here and he's tried it on 3 of us ,then how many members of their church ladies are suffering in silence.
I was shocked to the bones but i do understand why they did not tell anybody at that time.

I wish I could feel sorry for him but this kind of thing has been going on for too long in Ghana and has to stop.

If you did not already know about this case and you are shown the video and asked to interpret it like you will for a movie, nobody can tell what was going on in the video. The video DID NOT show "few minutes of romance” the KKD backers and CCTV put it. It did not show the girl “throwing” herself at KKD as they alleged. It shows KKD pulled her to the other side for the kiss. Secondly, as they walked to the room, KKD has his hands at her back subtly escorting her to the room. Clearly it was KKD who was showing active and visible interest in the young woman, not the other way round. The main question is when did they arrange for the sex? KKD NEVER talked about sexing her when he was engaging the girl and her friend in the lobby. Also, did the girl know that she and KKD were going to have sex when the latter asked the former to help him put some powder on his face? Then the final question is where did they make the arrangement to have the sex? Was it before they went to the bathroom, or during the powdering? That gives you an indication of coercion or lack thereof. Another hint: Did KKD use condom? That is crucial and another hint telling you whether the sex was planned, impromptu, or was coerced.
But this is the most crucial part of the incident. Did you guys noticed that the girls filed charges THE SAME DAY of the incident and KKD was arrested on the spot? She did not go home to be told what to do, and she didn’t wait for 3 months or 3yrs like some women do. Did you see the problem for KKD?
I mean will someone of KKD’s age and status have sex with a total stranger without a condom if it is not a pressured sex escapade? Will the girl also have sex with a total stranger without a condom if it was not a pressured sex? It looks to me like KKD already had erection and his dick up while he was coming from home. Otherwise this behavior on the part of someone who had a show that night is not making sense.
The only reason some people are backing KKD is because people have coerced girls or women into sex once they entered your rooms. But in this modern world, please note that the definition of raping is changing and is not more in the form of physical assault accompanied by screams and bruises and torn underwear. We all need to be learning.

A bail hearing has nothing to do with the actual facts of the case; it has everything to do with the constitutional and legal grounds on which the bail application is hinged. Although there is a term called "non-bailable offenses" in the Code, it is merely a term of art denoting the higher standard a judge must use before granting bail, and never a rout to abuse discretionary power.
As of now, KKD's continued detention is a travesty, and yet his lawyers are genuflecting instead of lawyering. The lawyers are ceding too much ground to the judge by making it appear that s/he has the full discretionary power to grant or deny bail.

My advice to the young lady, if you were really raped, by all means go ahead and press charges, but examine your own conscience, and if it was an act you willingly participated in, then my dear, you don't owe anybody an explanation. It was your own decision which you made with your eyes wide open. In this world you will definitely make decisions that you will regret. Face up to your responsibilities and the consequences of those decisions and don't push the blame on others.

I am a man and have not gone through what you have; a female friend confided in me about her experience with a chemistry professor who raped her in his office. She needed help with her chemistry lessons; the professor invited her to the lab and to the small office behind the lab. She went in there and to her surprise the guy had other intentions. She could not believe what was happening to her, but it was. The man raped her while another professor was in the lab doing some experiments. She could not scream; she blamed herself afterwards for what happened to her. I had to become a "councilor" assuring her that it was not her fault. I was a person she really trusted because we had been study mates for a number of semesters. I did encourage her to report but she was afraid that people will not believe her and may blame her for setting the man up. They may say “why is it that the professor did not hear any screams” she said. She was afraid and felt dirty for a long time.

Folks, this is happening to women every day, and the men that do it are those that you will find difficult to believe will commit such acts against women.

In Julian Assange v Swedish Prosecution Authority [2011] EWHC 2849 (Admin), an extradition case, the President of the Queens Bench Division considered the situation in which Mr Assange knew that AA would only consent to sexual intercourse if he used a condom.

On the specific facts the President said:

"It would plainly be open to a jury to hold that if AA had made clear that she would only consent to sexual intercourse if Mr Assange used a condom, then there would be no consent if, without her consent, he did not use a condom, or removed or tore the condom ..... His conduct in having sexual intercourse without a condom in circumstances where she had made clear she would only have sexual intercourse if he used a condom would therefore amount to an offence under the Sexual Offences Act 2003...."

In R (on the application of F) v The DPP [2013] EWHC 945 (Admin), the High Court examined an application for judicial review of the refusal of the DPP to initiate a prosecution for rape and/or sexual assault of the complainant by her former partner. "Choice" and the "freedom" to make any particular choice must, the Court said, be approached in "a broad commonsense way".

Against what the Court described as the "essential background" of the complainant's partner's "sexual dominance" and the complainant's "unenthusiastic acquiescence to his demands", the Court considered a specific incident when the claimant consented to sexual intercourse only on the clear understanding that her partner would not ejaculate inside her vagina. She believed that he intended and agreed to withdraw before ejaculation, and he knew and understood that this was the only basis on which she was prepared to have sexual intercourse with him. When he deliberately ejaculated inside the complainant, the result, the Court stated was:

"She was deprived of choice relating to the crucial feature on which her original consent to sexual intercourse was based. Accordingly her consent was negated. Contrary to her wishes, and knowing that she would not have consented, and did not consent to penetration or the continuation of penetration if she had any inkling of his intention, he deliberately ejaculated within her vagina. In law, this combination of circumstances falls within the statutory definition of rape".

Taken item by item, no law will view any of these as constituting constraint. For example no law anywhere will agree with you that a woman lacks the freedom to consent because of age difference between the parties; or social status of defendant; or popularity and family reputation; or traditional beliefs in simply agreeing to whatever you are told to do by the elderly; or presence of people who may have added to pressure to simple comply.
"Constraint" as viewed by the law is some kind of physical force, or loosely construed, overpowering authoritative force as in a superior officer versus his subordinate. None of these occurred under the circumstances in point. All those facts in the public domain are pieces of evidence of one kind or another. The question remaining is whether they are admissible or inadmissible...
I am a criminal defense attorney here in Texas with some contempt for government lawyers; they are too secured in their posts to do any extensive research.

The phrase refers to the behavior of deer caught in the beams of car headlights at night; frequently, the deer would simply freeze for several seconds rather than run safely out of the car’s path.

To be like a deer caught in the headlights is to be so frightened or surprised that you cannot move or think. It is a mental state caused by anxiety, fear, panic, surprise and/or confusion.
A person experiencing the "deer in headlights" syndrome often shows behavioral signs similar to those of a deer subjected to a car's headlights, such as widely opened eyes and a transcient lack of motor reactions. When someone finds him/herself in a tight corner facing immediate danger, he/she feels too dazed, stunned & stupid to think & decide what to do next in that situation.

The girl wasn’t expecting sex, not in the bathroom, and especially not when there were other people in the hotel room. The suddenness with which KKD pounced and ambushed the girl was enough to create the DEER CAUGHT IN THE HEADLIGHTS effect. Dr. Attorney at Law, now that is some CONSTRAINT! If we assume that she didn’t vocalize a NO, put up a fight, scream for help etc, the constraint resulting from the DEER CAUGHT IN THE HEADLIGHTS is a plausible and reasonable explanation. Needless to say, there are other equally plausible and reasonable explanations or CONSTRAINTS.

Interference with witnesses and fear of D failing to appear.

It is also not late for the judge to make non reporting/ anonymity order in favour of the complainant . This has not been considered by anybody and I deeply sympathise with the complainant

This order should have been made at the first hearing at the magistrates court.

The damage caused to the complainant is enormous and irreparable . It has the potential to affect the willingness of the complainant to provide continued support for this proceedings.

The case can be discussed by all dans but the identity of the lady including her name should not have been put in the domain.

It is my considered view that it is nevertheless, not too late for such an order to be made to protect the complainant ion anticipation of the development / progress of the case.

The complainant should seek legal advice and pursue the state for compensation. This is complete negligence and puts the fear of God in others who may have claims against BIG MEN and women in ghana

This current case in my view, has to be put on the basis that there was no consent.
KKD called the shot at all times. Look at how her hand was pulled by KKD before there was what appears to be a forceful entanglement between the two.

Yes the footage might have shown this poor girl kissing the defendant, but for her behaving in a flirtatious manner in the vedio doesnt give rise to consent to sex.

I believe the same applies to Ghana, although I stand to be corrected.
I am not familiar with so-called "marital rape" cases, but in most cases, these are derivative of divorce cases where the couple are getting ready to part company; and they mostly deal with a partner's demands for kinky sex.

I think KKD must be able to prove that he "BELIEVED" that he had consent(permission) from his victim for activity of a sexual nature to take place.

Off course, the backbone of our justice system is that, it is not for the defence to prove their innocence, but for the prosecution to, beyond reasonable doubt, prove their guilt which means the presumption of innocence challenges the prosecution to prove it or lose it and in most cases, the prosecution may suggest that KKD might have
caused the victim to fear at the time of the relevant act or immediately before it began, using violence against her or causing her to fear that immediate violence wld be used against her? Or that same violence would be used against her cousins who were waiting in the hotel room.
They can also say that she was unconscious at the time of the relevant act? Meaning KKD administered substance capable of stupefied or overpower her at the time of the act( voyeurism)
Again, I don't know whether she has some sort of physical disabilities that she could not communicate to KKD she consented.

My point is that, the CCTV footage has got nothing in it to support Kkd,s case. Off course, the defend lawyer cld use all possible witnesses including even the victim,s own best friend's account of the night to discredit the her during the trial. But the mere fact that they were caught on CCTV kissing, doesn't give consent for sexual Act. This can not be a mitigating factor and we should get this in our heads!!!

I am just a part time law student and a Police Officer in London and my knowledge in Law could not be as higher as yours...Mr Attoney, But I have been exposed to the practical aspect of the law and sometimes it frustrates me to hear some learned lawyers posing to the cameras and making quick public statements on some sensitive matters.

I know that it is a very hard time for KKD and his family, but we shouldn't forget that this girl and her family are also going through the same predicament.
I have dealt with many rape cases both male and female victims, and until u come to face to face with a horrified traumatised victim, you won't understand their plight.
I wish KKD all the good luck! But until it's proven she is faking it, my prayers are with this poor girl and her family. Good night Mr. attorney

Offcourse, the defend lawyer will use everything they can get their hands on to discredict the victim. This is normal in such cases where it is incumbent upon the state to prove guilt.
I know its hard time for KkD and his family but it is also difficult time for the victim and her family too..

When it comes to penetration, and you suddenly realize that I bypassed where you were expecting to have fun and find your anus exploding, you can decide to head straight to the police, where a medical form will be required to ascertain your story.

So if the medical report comes out that there was anal penetration, it is automatically considered rape, because you did not want it there. KKD goes about screaming it was consensual, but if the girl realizes that her anus was splitting she will definitely ask KKD to stop, which he didn't. This is how gay rapists behave. Please study their victims' complaints. They all seem to have the same story!! This is what happened in KKD's case.

Even if she did, which she didn't as per the video, it still didn't mean that KKD couldn't rape her in the room. And women respond to rape in different ways - not all of them are going to run around carrying their underwear in their hands crying!!!

The burden of proof lies with the defence -- it is they who have to prove that sex was consensual and therefore no rape was committed. Secondly, it is a blatant lie that the video footage shows the girl and KKD kissing and romancing before and after the sex incident. In fact, per the video, the only physical contact between the girl and KKD when KKD stood between the two girls and took a snapshot with them, and when he yanked the girl aside and chatted with her. There is absolutely no hugging, kissing or so-called romancing anywhere in the video. This matter really rests on what happened in the bathroom. KKD didn't have to "pin the girl down", she didn't have to fight him or struggle in resistance, and she didn't have to scream or cry out for help. And when she came out of the bathroom, she didn't have to inform her cousin and the other person in the hotel room that she had been raped. If the lawyer thinks that these are the criteria for rape to have happened, then he has already lost the case and KKD will definitely go to jail. There is no human rights issue involved in the continued detention of KKD. According to the laws of Ghana, you are not entitled to bail when you are charged with rape. Legally remanding someone in detention is never a human rights violation. KKD needs better lawyers, even then, he should start showing remorse and hope for leniency when sentencing comes. This would be a more sensible approach than being ignorantly adversarial and defending the case in the media.

To defend himself, the accused must provide evidence to rebut the accusation. Look at it another way... KKD is saying that sex was consensual; is the burden of proof then not on him to proof that sex was indeed consensual? How else do you think he would disprove the prosecution? Why do you think the defence is circulating the video footage of the non-existent so-called romantic kissing? The defence even adduced the video in the High (Human Rights) Court in seeking bail. The defence keeps saying “the FACTS don’t show/support this and that”. What facts? Isn’t that supposed to be evidence to disprove the allegation?
