The president and Vice should never again travel outside the country at the same time except it is an emergency. That is, in fact, what the constitution allowed for, but not a deliberate absence from duty!

In that ruling, the SC said that 'away from Ghana' is equivalent to 'unable to perform'. It is well past arguing same now.
The speaker, under current understanding, failed to obey the SC, which solely has the authority to interprete the constitution.

Since that aspect of the constitution(what constitutes incapacity) is yet to be clarified the structural hierarchy meant that the cj must obey the speakers opinion until a properly constituted panel of the sc decides otherwise.

Did it have to take a political scientist to educate Ghanaians on the law? There are always many dissensions among lawyers/judges on cases of law. I am glad medicine is not like law otherwise millions will die each day. Of course, there are disagreements among doctors on cases, but eventually, another person's view, normally, that of the renown professor of that particular case of medicine comes to be accepted. I am really glad that medicine is governed by scientific analysis that seems to significantly tone down the rhetorics of dissension and argument as it is in law.

The constitution doesn't give the conditions under which the speaker should take over in explicit terms. Not even the supreme court can categorical state what it should be by referring to the relevant section of the constitution. They may have to use commonlaw or the equivalent if precedents exist

The constitution says when the President and his Vice are unable to PERFORM their duties respectively, the Speaker of Parliament shall subscribe to the oath of acting President.
The constitution does not say when the speaker swears the oath once, it takes him through his tenure of office as Speaker.
It seems to me Amoako-Baah has not been heard off. As a result, he wants to be heard, hence this lengthy argument.

could act on behalf of the Sitting President as the case may be as follows
1.Art 60(8) TRAVEL - whenever,the President is absent from Ghana or is for
...........
2.Art 60(11) In case of ILLNESSES,
WHEN BOTH HAVE TRAVELED,IN CASE OF ACCIDENT or DEATH -
where the President and the Vice President are both unable to perform the functions of the President........
3.60(12) THE SPEAKER shall,before Commencing to perform the functions of the President TAKE and Subscribe the Oath set out in relation to the office of the President.
Now,I will begin my argument from the buttom up to arrive at my conclusions.
1.A sitting President is addressed as President or Mr President.
2.When the President leaves office ,he is addressed as a Former President.Right !
1(b) A Speaker of Parliament is addressed in the House as The Speaker or maybe Mr Speaker(I stand corrected)
or Hon Speaker.
2(b) when a Speaker of Parliament leaves office he is addressed with his name or as Hon Speaker depending on where he's being referred or mentioned.
A Speaker of Parliament who acted on behalf of the President is not addressed as Speaker and Acting President when the President or his Vice is in the Country,never ! He is the Hon Speaker.
Because (1) he is not a Elected president even if he acted several times while the President and his Vice were out of country.(2) he is/was Elevated to the honor and position as required by Constitutional Provisions Protocol.What that means is that,on arrival in the Country of the President or his Vice President,the Speaker's elevation to perform the functions of the President is - automatically Void instantly.
Therefore if the Speaker is again needed to perform the functions of the President,he cannot rely on the fact that he took the Oath/sworn in recent past.
If it's assumed that, is not necessary to take the Oath again,Fine !.But the fact is Constitutional protocol was relaxed.
All the argument by Dr Amoako Baah is neither here nor there,He confuses himself and turn round to blame the Constitution.The Constitution is clear on the subject.For example Amoako Baah's argument that the President can ask or pinpoint or assigned anyone to the functions of the office of President,is misplaced indeed .Yes,the President can do that like how he detailed Ayariga to oversee the Ministry of Sports.But remember ! The Prez is also the Supreme Commander of the Ghana Armed Forces.In case of an emergency while outside the Country,it's only those mandated by the Constitution in his absence that can order the Armed Forces to commit the Country.I am sorry time is not on my way/side to do a complete postmortem on his rantings.
Having said that,this perz Oath Saga should be a wake-up call to the President in particular and the Presidency in general.Why, because it demonstrates lacks of seriousness of Mahama to the office of the President to Stay home to do the peoples business, and the pitiful lack of Common Sense approach on travels planning by the Presidency. A Prez of a nation could go on say,2,3 ,4,5 etc nation tour
at a time.But a Prez of any serious nation do not travel Back and Forth to foreign Countries as if he had nothing to do home.Or,as if he has Stomach upset visiting the restroom/bathroom.It demonstrates the lack of commitment by the Prez to his people,And the general lack of planning by the office of Prez as already said.And is on the same level as last Dec when he left his people to Spent the Xmas holiday in Dubai, a foreign Country instead at Bole.
Anyway.
