Even a moron would easily know that this idiot masquerading as a professor is blatantly wrong. Once a president you are always a president of Ghana. Thus Mahama was President of Ghana on duty to Burkina. This did not incapacitate him in his functions. I wonder if NPP foot soldier knows the circumstances that incapacitate a President. In fact he was performing one of his key functions off the shores of Ghana.
Of course there is the need for someone to stand in for him for some of the routine functions at home. But does that mean as he was performing his duties out of Ghana he was not president? If this is the kind of professors we have then I support the Boko Haram's philosophy that education is not good for Africa. People with knowledge in Ghana only use it to steal and spin for their political parties. So shame to "Prof" S. Kwaku Asare!!! We know that a tutor in a secretarial school can choose to call himself a professor.

Having said that, I wholeheartedly agree with your opinion here. The clause in the constitution only applies when the president is incapacitated and unable to function. Not when he travels performing his constitutional duty outside the country. To me, once the speaker is sworn in as president, this action automatically voids the presidency of Mahama for that duration of time while he is outside the country because we cannot have two presidents at the same time calling the shots. It therefore becomes illegal for the traveling president to perform any duty as president from the outside. This is common sense, and does not need a consttutional lawyer to interpret.

I further believe, as you point out, that the President is performing presidential duties when he is on official business outside the country. Unfortunately, the Asare opinion disagrees with both of us (you and me), and with common sense. The Supreme Court has stupidly created an Constitutional conundrum. Certainly the wording of Article 60(11) - "unable to perform" - was intended to refer to physical or mental inability, not to geographical location, which makes the Supreme's 2003/4 ruling absurd; nevertheless, until judicially overturned or Constitutionally amended, their interpretation is the law and tragically, must be followed.

Sgt Anani Fiadzoe, your reasoning is sound, that the President is still President regardless of his physical location, BUT we must be cognizant of the quoted Asare ruling, that for the purposes of Article 60(11), when both the Prez and his Vice are out of the country, "they are to be regarded as unable to perform the functions" of their offices. There's no way around that ruling, unless you want to start disregarding whatever ruling you find inconvenient - but that's not the path Ghana wishes to take. Therefore, in accord with the rule of law, the oath should have been administered (twice) and should not have been shunned by the recalcitrant - and now impeachable - Speaker.

For a recap, Readers need to know that Prof Asare did take the Government of Ghana to the Supreme Court during President Kufuor's regime, challenging the legality of having to "SWEAR IN AN ACTING PRESIDENT, JUST BECAUSE THE PRESIDENT AND VICE WERE OUT ON DUTY".
The Supreme Court of Ghana ruled out Prof Asare, declaring that the Constitution of Ghana demanded the Speaker to be sworn in when the Pres and Vice were out of town.
With the Supreme Court of Ghana declaring Prof Asare "wrong", what then makes Kwaku Azar wrong now in asking for FULL IMPLEMENTATION of the Supreme Court Judgment?

Some of you educated souls in Ghana are so out of touch with the suffering of the down and out souls in Ghana the only things that matter is for you selfish elite to see yourselves in papers or hear yourselves speak. While there may be constitutional issues at stake, Ghana can be vulnerable to outside enemies when Ghana is divided along political and tribal lines and when people are asleep at their respective posts. If who is in charge of the presidency trumps patriotism and vigilance then a president and his men cannot save the nation. Let's grow up for a change and look to things that matter in the lives of a majority of Ghanaians and not what become basis for intellectual chatter.

The current practice where newly inducted doctors called house officers with no experience whatsoever are left to experiment with (attend to) serious medical cases while residents, specialists and consultants are away must be put to a stop immediately. There must be at least one specialist present 24 hours in three shift rotations to supervise them. Our health system as it is presently is not the best. The situation in the countryside and rural communities is even worse.
Do not doubt the wisdom in these words.

there is no breach in this issue - CJ has done nothing wrong- because the constituition did not explain what type of absences need a swearing in- but to common understanding - at exercutive powers traveled outside the country on national issues are not absents- this constituitional absent is refering to whereby the president is dead or uncurable sick in which he cannot direct presidential affaires that is where we need to swear somebody mandated by law in to do the presidential works.
it is only a conservative political beast who would not understand this.

to swear in the speaker as the president s/he must resign from every holding position-, which he cannot resume after the return of the president so here the speaker had an interest to protect, in the sense that there is no constitutional benefit/ provisions for him as former prez if cannot resume his position again as speaker,and remember the same constituition forbiden ex-prez to take exercutive positions in the country again. o knowing all these the CJ did a wise job not to swear him in again.
let us also ask ourself about this - that asuming the speaker was swore in as president today and within the period of the president returnng from his travel THE SPEAKER DIES arew going to refer to him as the former president or former speaker of parliament?
