I read this story last Wednesday and was confused why the Judicial Appointment and Disciplinary Committee got involved in am employment matter of the Judicial Service. My confusion stems from the fact that I assumed the committee is responsible for the appointment and disciplinary matters of the Judiciary (those in the legal profession such as magistrates, judges from the lowest to the highest court and lawyers- Solicitors, Attorneys, or Barristers but excluding other non-legal employees of the Judicial Service. In other words, the Judicial Appointment and Disciplinary Committee is a regulatory body of the professionals within the Judiciary in Ghana. Employment matters of the Judicial Service should be handled by a separate Disciplinary Committee of the Judicial Service. That should not involve any judge, let alone a Justice of the Supreme Court. In other words, that should be done by the management of the Judicial Service headed by its administrative head (not the Chief Justice).
If this is the system in Ghana, then, that is wrong. The body that deals with the appointment and disciplinary matters of the professionals should not be the same that should deal with employment and disciplinary matters involving staff of the Judicial Service. This is because the Judicial Service is different from the Judiciary. The Judicial Service is an agency and part of the Civil Service and therefore the employees are subject to the rules of the Civil Service and not the Regulatory body.
Even if the dismissed employee was a qualified lawyer and a member of the Ghana Bar Association, any disciplinary matters pertaining to her work as an employee of the Judicial Service should not be a subject matter for a Regulatory body but but her employer under the terms and conditions of her employemnt. If she did something contrary to her professional conduct, then that could be considered separately by the Regulatory body afterwards. The two are not the same.
How come the dismissed worker had to absent herself from work in order to pursue further studies at University of Ghana? Did the worker apply for study leave and if so was it refused to compel her to use time for work to study? Is it not in the employer's interest to encourage and support professional and personal development of its employees through further studies? If so what did the Judicial Service do to support her private studies?
In my view and my experience as a former Employment Tribunal Case Worker and Panel Member (Judge), there is more to this case than meets the eye.
If it is true that the initial story was by the husband of the dismissed worker, who is an employee of GNA and posted the article if it it was from GNA, then he is also in trouble and could lose his job.

PLease appoint people who are fully qualified whether or not that qualified belong to your party or not. THis is the ony way forward.
