Is that what the law in Ghana stipulates? That an individual can decide to discontinue a criminal case? So if somebody kills my child, I can decide due to my Christian belief to forgive and tell the state not to prosecute the person who killed my child because the one is rich and willing to offer me monetary compensation?

If that is the law in Ghana, then it is an antiquated law that should not exist in any civilized society. Was the case filed as KENU vs BAFFOUR GYAN? Criminal cases are filed as the state vs the culprit because the law sees the culprit as haven committed the crime against the state and that is why criminal cases are filed as GHANA vs the culprit, in this case, GHANA vs BAFFOUR GYAN.

Mr Kenu has every right to refuse to testify but you have witnesses and the medical report to continue this case and prosecute Baffour Gyan and his Macho men security detail. Ghana is a banana republic indeed.

I think we are all misreading Kenu. I am very sure his lawyer might have informed him that this is a criminal case, State vs. Gyan. Then knowing how corrupt Ghanaian judges are, he decided to take his cut and leave state to pursue its side. Basically, he instinctively knew money is going to exchange hands somewhere along the line, he will rather want the money coming to him than into the hands of a judge. It is him who received the blows to the ears, he will be doubly mad if some crook wearing some horse hairs double down on him on his blind side. Money talks in Ghana you know.

- the State prosecutor may consider a minor assault and batttery against a person a civil offence for which the accuser can proceed through the Civil Court for money payment (compensation)

- as reported on Gyan's matter, the State prosecutor might have decided not to procceed on criminal proceedings

Reasons he assigned for dropping the case are not tenable and I am very surprised that a regional editor of no mean newspaper like Daily Graphic should give such bogus reasons to discontinue the case.The stupid question that he posed which culminated in the whole saga will be condemned in court.It is a shame of immense proportion!
