How do you expect to get a 2007 C-Class replaced free of Charge by " a brand new latest model of Mercedes Benz 200 E Class." in 2014?
What we don't know are the circumstances under which two Mercedes Benz cars broke down.
He should take his money, and go buy himself a Hyundai, maybe that vehicle is more stable for our roads.

Don. You misunderstand the facts of the case. The man bought a C class, which broke down.
Then the man came to an agreement with the seller of the car that he could get a brand new E class if he pays an additional 15,00 Euros, to replace his faulty C class. (remember, were it not for the additional 15,000 Euros, he may have been entitled to a brand new C class.
But then his brand new E class also broke down. The seller is simply being asked to replace it.
This is a simple case.
The bickering it seems were over two issues:
1) whether the seller should just replace the faulty part of the broken down new car: it seems this is the engine.
2) whether the seller should compensate the buyer for the time that the buyer had to go without use of his new benz, which he had paid for.
The buyer won issue one. He gets a new car. And lost issue 2. He gets no compensation for time spent without his purchased car.
Does this now make sense to you?
It gives me a thrill to see that there is some semblance of reason in our system. But of course, this matter is not yet over. The seller simply chose to provide his own remedy rather than the remedy ordered by the court.
The court should order that a new benz be seized from him to satisfy the verdict.

But the vehicle with a registration number: GN 2266-Y could hardly be "Brand New" in the year 2008. I think 2008 had "....-Z", and in 2009 vehicles had the ending "-09".
