There are no corporate lawyers in Ghana, they may call themselves corporate lawyers but that does not make them corporate lawyers. We are such idiots, when was the last time you read of a western government paying these judgement debts? They enter into contracts with large private firms worth billions of USD or GBP but they use top quality corporate lawyers in agreeing the contract terms and protect themselves. We use Tony Lithur or lawyers in the Attorney General's office. What a joke?

Whenever I read such reports my heart bleeds for Ghana. From the details reported herein, it appears a decision was taken to acquire the Barge without any forward planning on how it would be transported to Ghana, where it would be sited in Ghana and how it would be operatedd. For the above failures, the Barge sat idle in an Italian port for two good years and attracted $10 million fees. Then finally when it arrived in Ghana the site was not prepared so it continued to be idle. All that time Ghana was experiencing power shortages.

The other problem is that Ghanaian politicians (the Executive and Legislature) together with the technocrats (senior civil servants) for some selfish reasons either cannot, unable or unwilling to negotiate agreements with foreign organisations and secure a good deal for Ghana. Instead, they put their personal interest first, collect bribes and sign agreements valued millions of dollars that are not worth the paper on which the agreements are written on. So these foreign investors/companies take Ghana for a ride and sue Ghana for millions of dollars in judgement debts.

How could this investor come to Ghana empty handed to operate Ghana's property for $40 million and after failing to deliver turn round to sue Ghana for $2 billion? That was a joke but he has taken Ghana for a ride. He brought nothing to invest but he has ended up $12 million richer for doing nothing.

It is clear from this report that the man could not deliver his part of the contract so he made unreasonable demand to audit the capacity of Ghana's power transmission which he knew was not part of the agreement and was fully aware that it would not be granted. That way he blamed Ghanaian authorities for his failure to deliver and turned round 180 degrees to sue Ghana. What a sad day?

These poorly written agreements with foreign investors are still being signed by the Executive and approved by the Legislature such as the recent oil agreements, the Ridge Hospital contract and the alleged agreement with Lonhro to build a free port in Ghana. That agreement if true would be a threat to the sovereignty of Ghana.

Ghanaian politicians must sit up and stop wasting Ghana's scarce resources and making themselves and foreign investors rich and the rest of the people poor and lacking basic amenities such as water, energy, healthcare, education, housing and food.

Did anyone in Ghana carry out any due diligence on the American investor? For example did Ghana check the past performance record of this American investor in operating Barges before the contract was signed? How much did he bring to Ghana to invest?

It is because we cannot plan and we do not have the tough corporate lawyers to do this kind of work. A US corporate lawyer would have charged about $50,000 and an international Project Manager who knows what it is all about would charge a similar fee. Even if we had spent $150,000 to get this project off the ground it would have been worth it. But why should we employ foreigners, after all we are a sovereign nation, we have corporate lawyers in Ghana, we have Project Managers with MBAs blah, blah, blah. There are no corporate lawyers in Ghana, they may call themselves corporate lawyers but they are not. Attending Gimpa or one of the bogus universities and obtaining an MBA does not necessarily mean you can undertake project management on this scale. When are we going to learn that just because we are an independent nation mean we have to use Ghanaians to do everything.

Kofi is right in his assessment of the whole issue because most of us see it exactly the same way. He is right in "wringing hands" as you fondly stated because we have become a country that regrettably and pitifully fails to do accurate assessment and due diligence before nose-diving into contracts that bring debts instead of solving the problems for which they are initiated.

How many billions do we have to pay/loose for "little" engagements I believe serious cost-effective assessments could have had moving smoothly without glitch?

A patriotic, honest and highly principled citizen doesn't have to be a lawyer or MBA holder to push a needed deal through so long as he is objective and knows what he does without thinking of his stomach, as is the case in Ghana. This is Kofi's lamentation.

In short, don't make simple ideas look too complicated already when the flaws in the business acumen of our leaders, their stupidity and lethargy are getting overbearing for the country.
