These poiticians are giving us too much trouble. Hannah Tetteh and collins Dauda are hard working ministers but I think they are getting all wrong. Let us go to Togo and see how poor they are just because of the Free port. We are collecting taxes from the existing ports yet we are poor. Where at all is the idea of free port in Ghana coming from. Let no potential former minister make noise when time comes for him or her to respond to charges of causing financial loss to the state. Hannah Tetteh should know that Lonrho has started mobilizing funds for the project. if they do not stop them now and they finish with the mobilisation before the abrogation, what will happen is for Lornho to go to court for illegal abrogation of contract and which will eventually lead to another judgement debt.

The legality or illegality of the proposed contract should be determined by the courts of the land.Why give monopoly to the Lonrho Ports to develop and operate such a facility to the detriment of Ghanaians.To me , GPHA for the funds and expand its current facilities to accommodate what Lonrho Ports plan to do.With the oil finds in Ghana the sharks of the industry are developing strategies with their local comparadors to milk the country.We have to be vigilante. Would the relevant authorities, the media, the clergy, the Think Tanks, Parliament, the legal fraternity, Civil society organizations, opinion leaders,the masses seek further information on this issue which has been raised by GPHA about the unconstitutionality of this proposed Lonrho project, and why John Mahama wants to go ahead with this clear and apparent illegality and why he should not be impeached for going against the strict tenets of the constitution, which he swore to uphold when he was sworn in as the first citizen of the land?
Why is parliament silent on an obvious illegality? Why is John Mahama hell bent on carrying on with a project which is effectively not in accordance with the strict provisions of the law and in the interest of the country? What is in it for John Mahama, Hannah Tetteh and Collins Dauda? Are these individuals operating within the laws of the land from the issues so raised in the report? Why is it that nobody is acting to prevent this illegality from happening in the country? Why is GPHA not getting the support it needs to prevent this illegality? What are the actions to be instituted in the face of this gross infringement of the constitution of Ghana with respect to what should happen to the President, Hannah Tetteh, Collins Dauda etc, etc in seeking to push this illegality at all cost?
Ghana is headed in the wrong direction under this NDC gov't and the level of impunity as well as the flagrant and huge disregard for the laws of the land should begin to have consequences on the executive and Ghana needs to wake up and ensure that this is achieved.

A phrase which caught my eyes in the report was ''the company is said to have started mobilization towards the project''. In other words, the company have started preparing to go on site and start working.
You know what that means and its implications! If the government abrogates the deal, The company is now going to sue the government for the cost of the mobilization. (That is what happened in the Stadium rehabilitation saga. (WOYOME)
In that case the company (forgotten its name), Woyome's partners, sued the Government of Ghana for millions of dollars ''for moving equipment to the site'' They did not have to prove anything. The courts did not ask them to give proof of the nature and number of equipment- tractors, bulldozers, etc which they moved.
They, in essence, had a blank cheque which they filled gleefully, and the embattled government, just accepted the claim and paid.
Sad though that the courts can probe more into such cases, but.....
So, folks, WATCH THIS SPACE. The foundation for a potential gargantuan claim and judgement debt is unfolding before our eyes.

I understand where you are coming from. In the developed countries sometimes a foreign company may be preferred to a national company, if they offer the best value for an undertaking. However, any selection is preceded by a 'competitive tendering process.
The process is done in accordance with laid down procedures, which offers all competitors a fair chance to make their case. It is normally an open, fair process. The government, for example(here in the UK) will publish the reasons why it favoured one company over the others. That is not the case here.

Was the decision to sign and give the mandate to Lonrho to build a private free zone port discussed at cabinet level, in view of all the facts as raised by GPHA concerning the constitutionality of the said project? Was this contract which was signed by gov't an usurpation of the mandate and constitutional obligation and responsibility of GPHA? Was cabinet apprised of these facts and still went ahead to sign this contract on a purported public-private partnership? Does the said entity Lonrho have the capacity to engage in this project or just as merchant bank was partitioned and offloaded to the NDC family and friends looting brigade with the understanding that, the expertise could be bought, this project is also being dished out on the premise that, the expertise for the project can be bought? What happens in the face of such a flagrant abuse and disregard for the laws of the land concerning cabinet's decision to approve and append it's signature to this contract? In the light of the reasons cited concerning the denial of financing by ADB and AFD and I quote
"On funding for the project, GPHA says Financial Institutions such as the African Development Bank, Agence Francaise Development and others have all declined Lonrho`s application for loan facilities for the project. The three principal reasons that accounted for the denial of the loan applications were that the current Legislation in Ghana does not allow private/ free zone ports; Lonrho’s financial track record is not in good standing; and that there is not a clearly defined role for Lonrho in the arrangement they have proposed because they cannot operate as a port authority in Ghana", end of quote.
Are we to assume that, cabinet and the AG's office is unaware of the relevant provisions of the law as spelt out in our statute books, and ADB/AFD- the financial entities which Lonrho sought funding for the project, are even more in tune with the laws of Ghana than cabinet and the AG's office?
Also having raised the issue of the illegality of the project, is cabinet still going to go ahead with the illegality and what are the consequences for cabinet in perpetuating such illegality on the citizens of the country by their flagrant disregard and abuse of the laws of the land?
Ghana is obviously suffering from a huge lack of effective, transparent and good governance under this NDC gov't and this needs to be rectified, because this level of impunity and recklessness should have no place in the administration of the country.

Mr. Mahama, as a President, you don't have to stoop so low to the level of your corrupt and good for nothing Cabinet Ministers including your Attorney-General who has so far demonstrated to Ghanaians through his official acts that he is as equally corrupt as your Minsters and that he is not even worth the salt and the title as Attorney-General.
Mr. Mahama, putting aside the past incriminating missteps of most of your appointees, the time has come that the Lonrho story should in all fairness give you cause to be concerned about your legacy and the integrity of those public officials who are petitioning to you on behalf of Lonrho Company.
Even a lay man like myself, after reading the above article, I'm convinced that the Minister of Transportation, the Attorney-General as well as those who negotiated and were signatories to the Agreement deserve to be fired from office and not to be moved around to any other official position.

Under Ghana laws, the GPHA is the only authorized body in Ghana charged to operate and manage ports. The government should direct Lonrho to partner GPHA for the development of this facility. The GPHA has similar arrangements with port operators like MPS and others that are working well. The GPHA should resist this move by Lonrho. It is an encroachment on their rights as port operators. The Ghana Navy and Airforce have are currently operating the Takoradi Naval Yard and the Takoradi Airport as commercial entities while the GPHA and Ghana Airports stand and look. Are the Ghana Navy and Airforce commercial port and airport operators? This is against the law of the land. The government must set the example and indeed demonstrate to the international and local investor community that Ghana is a jurisdiction that respects the rule of law. Who sets the rates for these services being performed by Ghana Airforce and the Ghana Navy? These arrangements have the potential to undermine the GPHA's and Ghana Airports Company's tariff structure and viability as a going concern. GPHA and Ghana Airports Company should enter into some arrangements with the Navy and Airforce to lease their facilities to GPHA for GPHA to on -lease to the oil & gas customers. If we continue on this path, everyone would just walk to the seat of government and cut a deal that could potentially undermine these vital state institutions.

With this project announcement, the government is sending the wrong signals to the investor community that there is no predictability and reliance on the laws in this jurisdiction. GPHA is currently seeking investments on the international markets for capital improvements at the Takoradi & Tema Ports. Any indications that the lucrative revenue stream accruing from the oil & gas port facilities/ services is out of GPHA’s reach spells doom for the plan to expand the ports. The contributions of GPHA to the Ghanaian economy and the development of this country is too great and sensitive a price to give away to Lonrho for a chump change. If Lonrho is interested in Ghana, they should invest in the Agriculture sector. We have hectares upon hectares of land that could be irrigated with our abundant water resources for food and cash crops. The government should preserve our vital national assets and interests like the ports. Please do not read any politics into this. Enough of NDC /NPP already!!!
