The FDA wants Congress to clarify its authority over compounders and is supporting a bill that would establish a new category of large compounding pharmacies that would have to register with the FDA and report any adverse reactions tied to their drugs. They would not have to meet all of the strict regulations that drug manufacturers do, but the law would prevent them from any longer making the most complex biologic drugs that are more easily contaminated. They also would have to kick in fees for the privilege of having FDA supervision.

I know BOG has been closes down Micro finance businesses that don't meet the operational standards, they don't refer the matter to the ministry of finance before doing so. Idiotic Tony, your ministry should be working closely with the FDA to protect the lives of Ghanaians not using the legal form of the law to obliterate the substance of what the FDA is doing, which is ensuring the ordinary Ghanaian is not taking sub standard drugs.
Clearly this Tony guy is implying the president is involved in this Mafioso business of deciding who can operate as a pharmacy in this country. I fail to see how the president will need to know. Lets not forget, this is a president who wasn't aware of the hundreds of millions paid under gyeeda so why bother him with this?FDA has a critical role to play in this country and they need all the support they can get from agencies like the police and the ministry of health. Both opponents are quoting from the legislature making it reasonable to question why our MPs should enact contradictory laws in the same Act? Also, for a minister who is political appointee to consult the president before action could be taken on sale of fake drugs which innocent Ghanaians are consuming is illogical and, therefore our MPs, should explain why such legislation? No matter how our opinions may differ on this issue, since both of them are quoting the legislature to support their case, we would need interpretation from the law courts or where necessary the MPs would need to amend the law.

The same companies supplying Tobinco supplies Ernest Chemist. This nonsense must stop. It is only because we have a useless presidency that has lost control of the system that someone creating so much havoc like Opuni can be allowed to continue messing around like this. Ghana's parliament should know that it is there to make laws and not to judge, mediate and arbitrate on the laws they made. Thus a law maker can not play the rule of a legislator and judge at the same time.
It looks like parliament is in the dark concerning this swindle case by TOBINCO. The case is that the World Health Organization (WHO) hand a contract with an Indian drug manufacturing company to make that particular drug for it. Thus the WHO which is an organ under the United Nations is the owner of the license to the drug.
TOBINCO after hearing that WHO ordered the drug went to India and deceived the manufacturer that it was receiving and paying for the drug on behalf of Ghana government. The WHO paid for the drug which is to be supplied to Ghanaians free of charge. Now TOBINCO have the same drug without registering with the Food And Drugs Board the only board authorized by Ghana's Constitution to register and approve the consumption of drugs and food.
For the information of those at the Ministry of Health, two departments under the Ministry of Employment and Social Welfare, namely the Labour Department and Factory Inspection do not need permission or authorization from the sector minister to close down a factory or company that infringe on the law. Is that Kwame Tutu telling us that the inspectorate division of the ministry of health can not close down any premises that pose threat to the health of the public?
Why were members of parliament bribed by TOBINCO to intercede on its behalf? I first got this TOBINCO swindling of the government of Ghana, people of Ghana and WHO from my friends in India and our parliamentarians must take caution not to damage their own image and that of the country before the United Nations.

116. The Minister may, by executive instrument, prohibit the importation,
manufacture, exportation, advertisement or sale of a drug, herbal
medicine, cosmetic or medical device or household chemical substance
as specified in the instrument.

Cancellation or suspension of registration
119. (1) The Authority shall suspend or cancel a licence issued under
this Part if an information submitted in respect of the registration changes
or it is found to have been inaccurate.
(2) An applicant may at anytime after suspension or cancellation
of a registration re-submit new information on the drug, herbal medicinal
product, cosmetic, medical device or household chemical substance.
From the foregoing, unless there are other aspects of the Act that contradicts the above, it is clear the FDA is abusing the powers invested in it and tresspassing on the work of the Ministry of Health. So far also I have not heard Dr Opuni deny the message from Tobinco of his threat that he shows no mercy and that he will bring them down, unfortunately saying he was able to get the husband of Semanhyia to commit suicide and the lady to go mad, dying at a shrine. As an observer I recall his banter with Napo and the statements he made at the time. He must know that he is not God and that though God is patient, God can be very ferocious when he acts. He must therefore be very careful in his actions. The breath that allows him to wake up and move up and down does not belong to him.

The FDA licenses drugs and substances which are otherwise not banned in the Executive instrument. So that if a substance which can be licensed is illegally brought into the country or manufactured in the country without the necessary authorisation of the FDA it has the legal authority to impound said products, stop the manufacturing of the said substance, and bring in the public prosecutor to institute action against the culprits. These are criminal cases, not civil action.
A crime will be deemed to have been committed.
The case of pharmacies has the additional dimension of the Pharmacy Council which is the actual regulator of pharmacies.
The police or the FDA can enter any premises and shut it down if they believe a crime has been committed or is being committed. But such closure will cover the period of their investigations. Only the pharmacy Council can revoke the licence of that pharmacy.

There is no time for turf when it comes to drug law enforcement. The ministry does not enforce laws. Rather resource th FDA to do its job effectively.

Let us work n resource the FDA to carry out its mandate before n after the drugs enter the market. Customs officials at the ports in collusion with politicians are cause of these problems. Kudos to the FDA.

Because,the FDA has all the tolls to do that,for the safety of the citizenry.
THAT SHOULD BE PARAMOUNT TO THE MINISTRY OF HEALTH AND THE WHOLE GOVERNMENT,as well.
On the contrarily,if the answer is YES,then THE MINISTRY OF HEALTH IS DAMN RIGHT.

Me beef is, why should such a very simple issue of closing a pharmacy be reported to the President of the day?

If we have the interest of the citizenry at heart, does such a closure be linked to the Prez?

I believe very soon before one is issued with a divorce, the Dep't of Justice would have to consult with the Prez. Absolute rubbish.

Tobinco refused to continue paying bribes after Opuni claimed he wanted a share of the company because he helped him to build it. Opuni asked Asante-Boateng to be on Tobbin's payroll to 'help' the company. Asante-Boateng is at the FDA. When Tobbinr refused to transfer the shares to Opuni he started to blackmail him. When that failed he decided to destroy the company. He Opuni was the one who opened all the doors for Tobbin. We have every single phone call after he made the demands and threats. He even brought someone to hold the shares for him. Corrupt thief! Only Mahama will put someone this evil and shallow in charge of a sensitive organisation like the FDA.

It's even disturbing that the CEO of FDA has been penciled for the COCOBOD as their next CEO, if snippets of information trickling in, is anything to go by.
The issue with the NDC gov't is that incompetence and ineptitude is rewarded, so also is corruption, thereby creating a vicious cycle of socio-economic development stagnation, and basically that is the reason, nothing is working in the country.
