let anyone who really wants to read through the judgement of Justice Dotse do another reading and you will see how unnecessarily political that he was in his judgement.Indeed when he said in his opening comments that the courts should be seen as being siatinct and independent from both the executive and legislative organs of the state, what did he really mean? Again what did he mean when he said that the Juduciary is expected to be truly independent in order to ensure strict adherence to the rule of law. Is he by this making any allusions that there were any attempts by the legislature or the Executive to influence himor any of the judges? For me these opening statements were very unfortunate and even in a way gives credence to what Tsatsu said regaring the biases of some of the judges even though I do not agree with him in the entirety of his statement. The election matter was between persons who had nothing to do with the executive. Indeed the first respondent John Mahama was addressed in his personal capacity, otherwise as per our constitution, a president cannot be sued. So for Dotse to start his submission and create the impression that he was going to be very independent and submit to the law as he ought to do without any external executive or legislative influence was a blow below the belt. Nana Addo was aspiring to use the court system to become the President and by that would assume the role as head of the executive, and o if it was a matter of any pecuniary benefits by way of influence, either party to the presdential election petition could influence. It is thus very irresponsible on the part of Justice Dotse to run down Dr. Afari Djan all in his raucous attempt to show that he is incorruptible. It has always been the bane of Ghananains to be destroying one of their own and it is unfortunate that a whole justice of the supreme court could descend to such levels. Was it Afari Djan who told a presiding officer to write twenty three zero or for persons to make some clerical errors. Indeed it is to minimize some of these errors that we have party representatives in the so-called strong room to double check and to indicate their acceptance of the results which would have been faxed before same is okayed by the chairman of the electoral commission. What has rather become obvious is that the NPP after losing the election, then wanted to use a ruse way of using some of these inocuous shortfalls to make a case. Yes the constitution makes it mandatory that the presiding officers must sign certain documents, but the same constitution is a living document and makes room for common sense reasoning but not the zombie adherence to words of the constitution. I therefore frown on all who will want to subject themselves religiously to any literalist and straight jacketted interpretation of any provisions of the comstitution. Sadly Justice Dotse could say in court that the timing of the contempt charge against Sir John was bad as any harsh dealings with him risked compromising the peace of the times. Why did he not go strictly as per the rules of court that the gentleman had scandalised the court and his contempuous behaviour should be sanctioned. This same Justice DOtse, even before one could finish with the election petition opens his mouth and says that elections in Ghana will not be the same after the election petition, fodder that he grtacefully gave to the NPP communhicators to mislead Ghanaians. I respect justice Dotse as a justice of the Supreme Court. He must be careful he does not become a POLITICAL JUDGE

Why do we have computer glitches, cyber attacks, malware and the like because where humans are involved mistakes are bound to occur but the difference is whether it is a minor one which does not necessary impact the outcome or a major one which can have a telling effect on the results. Wherever data are sampled mistakes are kept at barest minimum within a percentage 0f five.
The Germans are known for their precision and the Swiss are known for their accurate watches but even in these countries where cutting edge engineering are pioneered things sometimes go wrong.
Recently, elections were held in Australia and Norway the losers immediately went on air to concede defeat and congratulate winner. No , not in Ghana/Africa! We waste time and energy in litigation thereby holding the country hostage. We are our own enemies of progress.
Let mention here that no one can succeed in trying to tarnish the immaculate image of Dr. Afari Kwadwo Gyan. If we had ten honest Ghanaians in the corridors of power or administrative positions in the ten regions of Ghana with stainless character like his Ghana would have been a better by now.
Kwadwo’s problem is he too honest in a rotten country full of dishonest people who run to church 24/7 but corrupt to the bone.

It's about time excellence as a virtue is imbibed and actually practically lived by those in authority to serve as an example for the up and coming ones to emulate. Crass mediocrity which has attended virtually every sphere of endeavor in Ghana which is so brazenly championed and espoused with absolutely no shame is grossly retarded coming from those in a position of trust and who should know better. It's completely and absolutely incomprehensible and stupendously retarded for such mistakes to be classified as merely simple mistakes. A similar comment was passed by the newly appointed lady to the EC, who also is on record to have said that, it's such small mistakes that Ghanaians are complaining about. Who determines how small or big a problem is? Mediocrity which is basically a way of life amongst those entrusted with authority needs to be eschewed if Ghana is to progress as a country. These leaders need to be up and doing and justify why they need to be paid by Ghanaians, when the least opportunity they get, they throw all caution and excellence through the window and settle for mediocrity.

At the time the EC was represented by counsel who was present and the Court was not hearing oral evidence from any witness. Infact no date had even been set for the hearing of the substantive issues of the petition There was absoutely no need for Dr Afari Djan to attend those meetings in person; and yet Dotse could not restrain himself from ridiculing Dr Afari Djan in open court
The notion that Dr Djan should be personally blamed for the failure of presiding officers to sign their names is both ludicrous and pure nonsense. Dotse has probably not worked in the real world where the tendency is for the managers to delegate assignment to subordinates Dr Afari Djan as head of the EC could not have performed all the functions of the EC.

We all saw the open counting of the ballots that took place. With onlookers joining in the slow count. The fact is the party loyalists were vigilant and were not going to allow any shady deals. There was an instance where the NPP supporters fiercely opposed the ballot box being stored overnight at a Police Station so that voting and counting could resume the following day in one of the Accra polling stations.
In the excitement to declare the results at the polling stations and relay them to the collation centres, in a country with frequent power failure and sometimes no light at all, it is not inconceivable that the Presiding Officer would forget to sign the forms misunderstanding that the signatures of the party agents sufficed to authenticate the results.
The fact remains that the absence of the Presiding Officers signatures did not affect the results or implicate them in tampering with the results. The order of mandamus is what is required to rectify the omission by a public official. They could and should have been asked to sign them any time after the elections. The Supreme Court could have even asked them to come to court to sign them.
The fact that the petitioners left out some pink sheets alone should have been sufficient to throw out this petition but the entire country bent backwards to tolerate the naked ambitions of "someone's presidency".

NPP sent a flimsy case to court wanting to be pronounced winners of the 2012 election. Because their case was so weak to merit any help from any of the Judges who might be sympathetic to their cause, they could not get the number of those judges who would sacrifice their reputation in deciding in their favour.
Notwithstanding, those judges who made the right decisions but do not want to incur the wrath of their friends now want to compensate the party by trying to blame the Chairman of the commission. It would be recalled that the NPP has done every thing to denigrate and malign the good achievements the EC chairman has garnered both locally and internationally. And who could be more relied upon than some of the judges who had sat on the case but could not put their own reputation on line.
It would be recalled that this very judge had been fingered as once holding a high office in that party in the Volta region. The man therefore had to pull off this compensatory act by running down Dr. Afari-Gyan´s reputation the way he has done in his judgement!
The NPP should have rather chosen THE CRAB as their mascot rather than the elephant since the crab aptly suits the way they behave toward their perceived opponents.

Any Electoral Commission, who is innocent woulf not have fought tooth and nail to conceal records. An EC that provides no plausible explanation why two sets of identical pink sheet booklets were ordered is dysfunctional, to say the least.
The political parties should not rush to join any reforms until the EC itself is reconstituted. They have not learnt from their mistakes and such is African Institutions. Anywhere else, but for Africa, Dr. Kwadwo Afari-Gyan would have honourably resigned, to pave way for reforms.
I fear for 2016!

THAT IT WAS THE SAME DR.AFARI_GYAN WHO WAS THE CHAIRMAN OF THE ELECTORAL COMMISSION DURING 2000 AND 2004 PRESIDENTIAL AND PARLIAMENTARY ELECTIONS AND DECLARED THE NPP PRESIDENTIAL CANDIDATE THEN H.E.FORMER PRESIDENT OF GHANA JOHN AGYEKUM KUFUOR WINNER OF BOTH ELECTIONS WHEN THE GOOD PEOPLE OF GHANA CLEARLY VOTED FOR HIM.
THAT AS I HAVE POSTULATED TO THE ENTIRE WORLD THAT "JUSTICE SEEKS THE TRUTH AND NOTHING BUT THE TRUTH".
THAT THE LEGAL ISSUES BEFORE GHANA SUPREME COURT THAT THE COURT ADJUDICATED AND RULED ON THE MATTER AND BY MAJORITY DECISION DISMISSED THE PETITION THAT WE MUST ALL CALL "A SPADE A SPADE".
THAT IT IS ALSO A TRITE KNOWLEDGE THAT THE LEGAL RESEARCH AND INDUSTRY THAT COUNSELS/LAWYERS PUT INTO A CASE HELPED THE JUDGES WORK TO BE VERY EASY.
IN FACT, THE SAME CANNOT OR COULD NOT BE SAID WITH THE 2012 PRESIDENTIAL ELECTIONS PETITION CHALLENGED SINCE COUNSELS FOR RESPONDENTS INSTEAD OF TO RAISE "A PRELIMINAY CHALLENGE ON THE PETITION ITSELF AND OTHER LEGAL ISSUES RAISED AS FRIVOLOUS, CAPRICIOUS, VEXACIOUS AND MALICIOUS" BUT RATHER ENGAGED THE PETITIONERS ON "PINK SHEETS CLERICAL ERRORS INSTEAD OF ON POINTS OF LAW AND LEGAL BASIS".
THAT THE WHOLE MATTER WAS "A QUESTION OF LAW AND NOT PINK SHEETS".
HOWEVER, THE SUPREME COURT OF GHANA HAS NOT BEEN FULLY APPRISED WITH THE LEGAL POSITIONS SINCE COUNSELS FAILED TO MAKE THE RELEVANT LEGAL ARGUMENTS BUT JUST DWELL ON FACTS AND RATIONALITY OR RATIONAL ANALYSIS OF THE FACTS.
IT IS MY FIRM BELIEVED THAT IF THE COUNSELS FOR RESPONDENTS WERE TO RAISE THE PRELIMINARY OBJECTIONS TO THE PETITION AND MADE THE RELEVANT LEGAL ARGUMENTS SUPPORTED WITH THE RELEVANT PROVISIONS OF THE CONSTITUTION AND OTHER RELEVANT LAWS THE COURT WOULD HAVE DISMISSED THE LAWSUITS ON THE ONSET.
THAT I AM RESPECTFULLY CALLING ON ALL THE MEDIA HOUSES THAT COVERED THE PROCEEDINGS TO PRODUCE THE TAPE RECORDINGS OF THE PROCEEDINGS OF THE AMICUS CURIAE REVIEW MOTION AND THE LEGAL ARGUMENTS THAT I ADDUCED AT THE COURT AND EACH COUNSELS RESPONSE AND THE COURT RESPONSE AND THE THE COURT RULING TO HELP THE READING PUBLIC TO ASCERTAIN THE DIFFICULTIES POSED BY SOME OF THE COUNSELS RESPONSES TO THE JUDGES.
THAT DR.AFARI-GYAN IN THE FIRST PLACE DO/DID NOT HAVE FULL RESPONSIBILITY OVER TEMPORAL 2 OR 3 DAYS ELECTION OFFICIALS SINCE THEY WERE NOT PERMANENT STAFF AND THAT THE INSTRUCTIONS GIVEN TO ME WERE ACROSS THE BOARD.
THAT THE TRUTH OF THE MATTER WAS THAT THE MALPRACTICES AND OTHERS THAT THE PETITIONERS COMPLAINED ABOUT AND COMMENCED THE LAWSUITS DID NOT OCCUR IN REALITY AT THE POLLING STATIONS THEMSELVES THAT THE LEGITIMATE VOTER COULD BE BLAMED OR ACCUSED OF BUT JUST "MERE CLERICAL OR ADMINISTRATIVE ERRORS" THAT DID NOT ACTUALLY AFFECT THE FINAL OUTCOME OF THE FINAL RESULTS DECLARED THAT IT THEREFORE DEFILED COMMON SENSE THAT THOSE GENUINE AND HONEST SINCERE VOTES CAST TO BE PURPORTED TO BE ANNULED THAT THE ISSUE THEN IS "WHERE THEREFORE WILL BE JUSTICE ITSELF?".
TO PURPORT TO FIND A FINDING FOR "A MERE HYPOTHETICAL SPECULATIVE CASE WOULD HAVE REALLY CAST A SLUR ON OUR JUDICIAL SYSTEM AND WOULD EVEN AMOUNT TO "JUDICIAL SABOTAGE".
BUT THANKS TO THE MAJORITY DECISION THAT DISMISSED THE PETITION.
THAT DR.AFARI-GYAN HAS DONE NOTHING WRONG TO CAST A SLUR ON HIS REPUTATION AND INTEGRITY ESPECIALLY AS DR.BAWUMIA TOLD THE SUPREME COURT IN HIS EVIDENCE IN CHIEF AND UNDER CROSS-EXAMINATIONS THAT WHEN THEY WERE PREPARING THE PINK SHEETS TO COMMENCE THE LAWSUITS THEY ALSO MADE "MISTAKES" AND HE EVEN FURTHER STATED THAT "THEY MADE MISTAKES AS ANYBODY OR ANY PERSON CAN ALSO MAKE MISTAKES" AND THAT THE LEGAL POSITION AND LEGAL EFFECTS OF DR.BAWUMIA TESTIMONY WAS NEVER ADDRESSED IN LAW.
IT IS AT THESE RELATED BACKDROPS THAT TAKING COGNIZANCE OF THE FOLLOWING LEGAL THEORIES OR LEGAL PRINCIPLES IF THEY HAVE BEEN ADDRESSED WOULD HAVE HELPED THE COURT TO MAKE EASY DETERMINATION OF THE CASE:

He lied under oath about the timing of the printing of the "Pink sheets," where and when. He lied about the printing of duplicate, triplicate and quadruplicate pink sheets. He lied about their use as well. First he said they were used for special voting and when he was confronted with the evidence, he started telling fibs.
Then there was the "transpositional and clerical errors nonesense." You went to the villages and recruited complete illiterates who could not count up to 100 and paid them peanuts, to spew out rubbish on results sheets.
He printed election sheets without knowing how many was printed. Or was that another one of the "create loot and share scams, whereby the hapless Ghanaian taxpayer paid for 1 million copies and received 200,000?" The state really ought to seize Afari-Djan's pension. He is a disgrace to academia!

When we were children we use to fight on the street and the youth leaders will come for us and give us some lashes at the public gathering place to deter others from committing the same offense. When two adults do the same then they were hauled before the elders and if it were to be between the elders they are quickly hauled before the palace and sometimes would not allow the children to even hear what punishments were given to the culprits. Unfortunately when you have these elders who have no respect for the chief then their misbehavior on the street becomes the source of scornful ridicule by the neighboring towns to the detriment of our home town.
This is where I find it very difficult to understand what one of the Supreme Court Judges (Dotse JSC) want to achieve by trying to destroy the image of Dr Afari Gyan when he said "So far as I am concerned, Dr. Afari-Gyan has cut a very poor figure of himself, and the much acclaimed competent election administrator both nationally and internationally has evaporated into thin air once his portfolio has come under the close scrutiny of the Courts,". The constitution of Ghana from which Justice Dotse got his power and sat in that chair trying to ridicule people is the same constitution which gave Dr Afari Gyan the power to do what he has been doing for many years now. Since when the Chief Justice take responsibility for the miscarriage of justices that have been going on in the lower courts of the country? We all have heard the CJ severally calling on the bar and the bench to ensure that justice is delivered properly. Why didn't the he advise the CJ to take responsibility for the actions and inaction of the bad judges on the bench because her reputation as the CJ will make her destroy her personal image?
We need to encourage the institutions in our country, especially those established under the constitution work to foster our democracy and when the very people who must ensure that start to ridicule those institutions it become very worrisome to we the ordinary people. As Justice Dotse was giving a road map for reforms in his ruling, I wonder why he did not recommend for the removal of Dr. Afari Gyan sin in his (Dotse JSC) words "he (Afari Gyan) has cut a very poor figure of himself". As he recommended for re-run of the elections in those affected areas, why didn't he use his power (whichever such power he has) to replace Dr. Afari Gyan for somebody else (who is more competent than Afari Gyan per Dotse JSC's view) conduct the re-run?
We all know when you are at the top you need to supervise your subordinates, but that does not mean you will not get some people under you doing the wrong thing and I think Justice Dotse is very experience in our administrative processes of the country to know better and live such unwarranted criticisms to uninformed youth to make. Dr. Afari Gyan has done very great job for this country since 1994 and he needs to be give credit and may be asked to ensure his subordinates supervise the works of junior officers properly to ensure mistakes are not repeated next time. We have no right under any circumstances to try and denigrate the man is such manner. We all have a role to play in order to see our country's democracy works for our benefit and that of our children and grand-children. Let us pause and ask ourselves whether we have played our role with all honesty before trying to destroy others' reputation.

To go beyond that and insult the personal integrity of Dr Afari Gyan is to say the least unprofessional. This alone should disqualify SJC Dotse as a Supreme Court Judge. The question we should all ask SJC Dotse is if he Dotse is insulted the way he insulted Dr Afari Gyan, will he like it? Won't that be considered as contempt of court? Do unto others as you would like others to do unto you.
I suggest to the EC and Dr. Afari Gyan to sue SJC Dotse for defamation of character because SJC Dotse has gone beyond his authority as a Supreme Court Justice..

If the Judge can touch of the credibility of an official based on mistakes of a subordinate then the judges must also be prepared to accept all the criticisms about them even if it bothers on their family life.
