Everyone knows that Afari Gyan's performance at the Supreme Court was horrendous, unless the usual airheads, who are blinded by partisan politics. However, I believe the SC judge should have been careful in his criticism of the EC boss.
It is not the duty of the Supreme Court to debate on someone's reputation or integrity. He needed to tell us why the EC boss was wrong and let the people make their own decision about Afari Gyan's integrity.

Is this a "Purjury" judgement, or "Over-voting" ruling ?
If atuguba was sincere to Ghana he would not have presided over the case, but recuse himself. This is because there was an evidence of "Conflict-of-interest" with his nephew or whatever being the executive secretary to dramani mahamana . But because he wanted to share in the booty offered by mahama, he disgracefully sat on the case using intimidation and bullying to put fear on the NPP supporters to submit to defeat at all cost without fair justice . He has disgraced himself and has lowered the esteem Ghanaians had for the Supreme Court.

According to the Holy Scriptures, Judas Is Cariot commited Suicide for betraying Jusus Christ Our Lord and Saviour for a mere ransome.
It was quite obvious right from the onset that atuguba is a politician and not a judge.
His political statements from day one and his reckless actions to throw all the hard evidence away, and daclaring it as not admissable to the court regarding the pettition was a clear manifestation that atuguba has something very serious against the NPP.
It was so apparent that he misused his judicial office and power to render the pettition irrelevant with no substance by ruling to throw the hard evidence away in oder to find grounds to dismiss the pettion at last.
KPMG rings a bell, when he "wilfully" played to the tune of tatsu tsikaka to throw some of the remaining pink sheets away.
His rulings were not based on law , but on personal feelings , self-convictions and personal political and tribal feelings.
How can a judge at the Supreme Court turn out against the law , become anti-law, and rule against the facts presented to him to rule upon, and thereafter, turn out to make his judgements based on personal political and tribal sentiments.

atuguba is not just "Totalitarian", but also a bad temprete element, insincere with double standards, and a complete "abuser" .
Unlike some of his colleagues on the Bench, he is not a neutral person, but rather a politician with open biases.

At this point, the president of the court, Justice Atuguba, said he had an observation to make.
He said, “I am concerned that there should be at all times a very strong and truly independent judiciary.
He said the “health of the country must be preserved” and “if we don’t have a strong judiciary, we will be gambling with the destiny of this country”.
He noted that if that happened, he would not be part of it and added “I don’t think my colleagues would also be part of it.”
Justice Atuguba then said that the justices had decided to hear counsel in chambers where they would make a decision on whether it was something that should be heard in open court or kept in chambers.
Before retiring to the chambers, he said, “Ghana is a very solid country but it is breaking down because principles are being broken down almost to a pedestrian level.”

Election petition case: Justice Atuguba laments, Ghana is breaking down
Hearing of the NDC's application to be joined as a respondent to the NPP's Presidential Election Petition, arguably the biggest court case in Ghana’s history, started on a controversial note.
The President of the panel of nine justices of the Supreme Court sitting on the case, Justice William Anaam Atuguba astounded lawyers and observers when he burst out into an emotional lecture of nationalism.
“This country is solid but is breaking down because principles are being chopped down to pedestrian level. The Court must be strong and truly independent. The health of [our] country depends on us," he stated, banging the table.
It is neither clear what provoked the outburst nor the target of the judge's comments but it appears his membership of the panel is being objected to by the petitioners who are opposing the NDC's application to be joined to the case.
The National Democratic Congress has applied to the Supreme Court to be joined as third respondents but the petitioners, New Patriotic Party’s Nana Akufo-Addo, Dr Mahamudu Bawumia and Jake Obetsebi Lamptey are objecting to this.
The case, called Thursday, had to be adjourned indefinitely after the petitioners, in chambers, raised an objection to the composition of the panel.
Lead Counsel for the petitioners, Philip Adisson wanted the substance of his objection to be taken in camera but opposing counsel, Mr. Tsatsu Tsikata, representing the NDC, opposed the move, stating he preferred a full public hearing on Mr Addison's objections.
Even though the petitioners did not say exactly who amongst the nine justices they have concerns with, Myjoyonline.com has learnt that petitioners are concerned about Justice William Atuguba whose cousin, Dr Raymond Atuguba has been appointed the Executive Secretary to the president John Mahama.
The president is the first respondent in the election petition.
The court adjourned the case sine die and asked the petitioners to file a formal objection with the court instead of the verbal objection they sought to raise.
The Nine justices empaneled to sit on the case are, W. A. Atuguba, (Mrs) Rose C. Owusu, Sophia A. B. Akuffo (Ms.), P. Baffoe Bonnie, Julius Ansah, S. O. Adinyira (Ms.), Jones V. M. Dotse, Anin-Yeboah, and Mrs. Vida Akoto-Bamfo.

On his sixth birthday, at the height of World War II, Albie Sachs received a congratulatory postcard from his father with a rather unusual wish inscribed on it: "May you grow up to be a soldier in the fight for liberation," read the card. "Looking back, it was a little bit heavy," remarks Sachs, now aged 78. But as burdensome as his father's message might have been, it instilled the young South African with a strong conviction about the value of justice, a belief Sachs has fervently advocated and fought for throughout his life.
Sachs became one of South Africa's most eminent political activists and judges, famous for being amongst the leading legal minds behind the creation of the country's groundbreaking constitution after the first democratic elections in 1994.
"Getting the constitution, when everybody predicted a bloody racial war, was a triumph in itself," says Sachs proudly. "And we did it ourselves; It wasn't forced on us -- we looked into each other's eyes, people who'd been trying to kill each other." And Sachs, one of the most prominent white South African freedom fighters, knew all too well about the cruelty of years gone by.
As a young lawyer defending victims of apartheid's repressive laws, he often faced the wrath of security police and was put in solitary confinement for nearly six months without trial.
Read this: Apartheid photographer 'sick of taking pictures of dead' In April 1988, while living in exile in Mozambique, Sachs lost his right arm and the sight in one eye to a car bomb. After a long and painful recovery, he returned to South Africa, a country he had last seen 24 years earlier.
Shortly thereafter, Nelson Mandela was released after more than 27 years in prison, and work began on the birth of a new South Africa, ending the horrors of the old regime and creating a new rule of law.
Sachs was appointed to serve as one of 11 judges in the newly established Constitutional Court, where he helped write one of the most world's most progressive constitutions in 1996.
"How can we live together in one country? What can the basic rules be, the basic values that respect the dignity of everybody?" says Sachs as he explains the thinking behind the constitution.
"Whoever you are, whoever your parents or grandparents happened to be, wherever you came from, whether you are exalted, whether you are humble, you're a person, you're a human being," he says.
"The constitution doesn't build houses, the constitution doesn't provide food, electricity, water, school text books, but it provides a framework in which people can claim these things, resolve their disputes and that's what we lacked before in South Africa. So if it hadn't been for the constitution, it would've been just total chaos, and most opportunistic grabs from power."

As someone who'd paid a big physical and psychological price for his fight for freedom, Sachs says the establishment of a just rule of law served to help a deeply wounded population put its troubled past behind it.
"It wasn't simply a healing of a fragmented, fractured, divided nation filled with enmities and fears and arrogance," he says. "It was a healing for me, personally," he adds. "The healing comes about through the achievement of the ideals for which we were fighting."

But Sachs was not only one of the architects behind South Africa's post-apartheid constitution; he also helped design the Constitutional Court in Johannesburg, an impressive building created to visually represent the ideas expressed so clearly in the country's new rule of law.
"We decided we wanted a building -- a brand new court, a brand new constitution," says Sachs. "Not one parachuted in from outer space, one that grew up from our history."
As a result, the Constitutional Court was chosen to be constructed right next to Johannesburg's Old Fort Prison, a notorious building whose walls had served to confine two of the best know civil rights figures of the previous century. "We say with a dubious pride, we South Africans have the only prison in the world where both Mandela and [Mahatma] Gandhi were locked up -- nobody else can make that claim," says Sachs.
"And we wanted to show the transformation from negativity to positivity, why we have a constitution," he adds. "Moving forward without forgetting the past and taking the terrible energy of hatred, division, pain of the past and using that force of that energy to create something positive and hopeful for the future."
A passionate art collector, Sachs has also donated several of his fine pieces to the Court. He is immensely proud of the building, where he spent five of the 15 years he was a Constitutional Court Judge, and never tires of visiting it. Now retired, Sachs lives in Clifton, Cape Town, with his family -- wife Vanessa and young son Oliver, aged six.
Sachs says he would never be able to give Oliver the same burden his father placed on him when he was six. He even admits he can't speak to Oliver about the horrors of apartheid.
"I don't want to," he sighs. "He'll find out. I can tell him that there were cruel people, put a bomb in my car, blew me up, wonderful doctor saved my life. I can tell him all that, that he can understand.
"I don't want to tell him that his mommy and his daddy, they wouldn't have been allowed to live together, to love, and to conceive him. I don't want to. It's like putting a burden on him, that we had to shoulder and deal with, and in a sense what we were fighting for was to be free of that lived reality and even the memory -- I'm happy to move on."

The other day in a Bible study, one of the participants asked if Judas Iscariot was saved or lost. In a room that contained two missionaries, two pastors, myself, and a couple of dozen other visitors, no one could come up with an answer. The question was asked in relation to the fact that Judas Iscariot had committed suicide by hanging himself, and the Bible study was on eternal security.
Forgetting about the questions of suicide and eternal security, we all should have known the answer on Judas Iscariot. Jesus Himself provided the answer in John 17:12, "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."
The son of perdition who was lost is of course Judas Iscariot.
Judas and Suicide
In relation to his suicide, one must note that Judas Iscariot was pronounced lost before his actual suicide had taken place. Judas appeared with the guards to betray Jesus in John 18, obviously before he had committed suicide.
There is nothing in Scripture to suggest that suicide itself is an unforgivable sin. Matthew 12:31 even suggests that suicide must be forgivable, "Wherefore I say unto you, All manner of sin and blasphemy shall be forgiven unto men: but the blasphemy against the Holy Ghost shall not be forgiven unto men."
The phrase, "all manner of sin" must include suicide. So, the lost state of Judas does not really have to do with his suicide; it has to do with the fact that Judas never repented and believed in Jesus Christ.
We know that Judas did not repent because he did not bring forth works that reflected repentance. Paul characterized his own preaching as telling people they should "repent and turn to God, and do works meet for repentance" (Acts 26:20d).
Judas's works did not reflect a repentant life. John 12:6 reports that Judas, who held the money bag, was a thief who stole from the money he had been entrusted with.
One may wonder whether a truly repentant person would ever commit suicide. I do not understand how this could be, either; however, Matthew 12:31 tells us that "all manner of sin and blasphemy shall be forgiven unto men" (excepting the blasphemy of the Holy Spirit). The sins of people who are not repentant will never be forgiven; therefore, if suicide has ever been forgiven, it must have been the suicide of a person who had indeed repented and believed in Jesus Christ.
Certainly suicide is a terribly unadvisable thing. The Scripture would seem to support the possibility that suicide is forgivable, but I think we should endeavor to follow the advice given at 2 Peter 1:10, "Wherefore the rather, brethren, give diligence to make your calling and election sure: for if ye do these things, ye shall never fall."
There can be nothing in this life that is so bad that we should risk our happiness in eternity to end our unhappiness here. Rather, in the midst of our troubles, we should keep in mind what Jesus said at John 12:20, "He that loveth his life shall lose it; and he that hateth his life in this world shall keep it unto life eternal." There are going to be many "reversals" when we reach heaven. Jesus also said, "Blessed are they that mourn: for they shall be comforted" (Matthew 5:4). It seems almost that the more troubled life we lead here, the more comforted we will be there.
We should hold to these promises, remembering also this word of Jesus, "And ye shall be hated of all men for my name's sake: but he that endureth to the end shall be saved" (Matthew 10:22). We have to endure through the hatred of other people for the sake of our faith.
Judas and Eternal Security
What happened with Judas has absolutely no bearing on the doctrine of eternal security; if anything, Judas' life supports the doctrine. It is evident from Judas' unrepentant actions, such as stealing from the money bag, that Judas had never repented and believed in Jesus Christ. In fact, Judas was never characterized as being a saved person.
In John 6:70, Jesus asks the rhetorical question to His twelve apostles, "Have not I chosen you twelve, and one of you is a devil?"
The basic nature of Judas Iscariot never changed. He was not saved and then lost. The man was never saved at all. He never repented, and so, was never born again, and he remained the same old sinful creature he had always been.
Paul wrote, "Therefore if any man be in Christ, he is a new creature: old things are passed away; behold, all things are become new" (2 Corinthians 5:17). Judas Iscariot was not in Christ because his old things had never passed away. Rather, he clung to his old sinful nature to the point that he was even willing to betray Jesus for the sake of 30 pieces of silver (cf. Matthew 26:15).
Therefore, the life of Judas Iscariot does nothing whatsoever to erode the Biblical doctrine of eternal security for the saved believer. What Jesus said remains true: "And I give unto them eternal life; and they shall never perish, neither shall any man pluck them out of my hand. My Father, which gave them me, is greater than all; and no man is able to pluck them out of my Father's hand" (John 10:28-29). Not even the man himself is able to pluck himself out of the Father's hand, if he is indeed in the Father's hand.
Did Judas Ever Repent?
At the point that Jesus was speaking of Judas in John 17:12, Judas had certainly not repented. However, after Jesus had been betrayed, we read in Matthew 27:3-5, "Then Judas, which had betrayed him, when he saw that he was condemned, repented himself, and brought again the thirty pieces of silver to the chief priests and elders, Saying, I have sinned in that I have betrayed the innocent blood. And they said, What is that to us? see thou to that. And he cast down the pieces of silver in the temple, and departed, and went and hanged himself."
The words "repented himself" here (from the King James Version) are not the best possible translation of the underlying Greek. The underlying Greek word means "regret" or "remorse" but it does not necessarily imply a change like the word for "repentance" does. The World English Bible translates Matthew 27:3 as, "Then Judas, who betrayed him, when he saw that Jesus was condemned, felt remorse, and brought back the thirty pieces of silver to the chief priests and elders" (WEB).
The key piece of information in interpreting this remorse of Judas is 2 Corinthians 7:10, "For godly sorrow worketh repentance to salvation not to be repented of: but the sorrow of the world worketh death." Given this piece of information, there can be little question that Judas' remorse did not result in repentance but in death, and it was merely worldly sorrow, not godly sorrow that he experienced.
In Conclusion
Sometimes we get so caught up in doctrinal principles that we fail to look at what the Bible actually says about things. The question of Judas' salvation has little to do with principles concerning suicide or eternal security. The answer is in black and white from our Bible, and the answer has come from the very lips of our Lord Jesus Christ: "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."

Foremost, I would like to know the person or group of persons who made this "One-Man" enacted dictatorial law and the rational as well as the motive behind that Law:
- I would also like to know if the Parliament of Ghana is so statisfied with the existing law , and are therefore, not prepared to "overturn", or repeal it , or make amendments with the mandate of the people.
Secondly , I do not want to believe that the Fouth Republic is programmed or predestined by a PNDC law to enable incumbents to steal elections and get away freely without fear of any consequences thereof, and go ahead to maintain their positions as legitimate public officials.
- If this is the case ,I would come to a judgement, that there is no need to go to the polls to hold elections to waste public money and time.

I know the judges, they will speak the truth, but there is one or two, one particular judge who opens his mouth at anytime and the next thing you hear is a warning. I want him to know that he can’t intimidate us. I have never heard him warn Mahama.”

Justice Atuguba then said that the justices had decided to hear counsel in chambers where they would make a decision on whether it was something that should be heard in open court or kept in chambers.
Before retiring to the chambers, he said, “Ghana is a very solid country but it is breaking down because principles are being broken down almost to a pedestrian level.”

Election petition case: Justice Atuguba laments, Ghana is breaking down
Hearing of the NDC's application to be joined as a respondent to the NPP's Presidential Election Petition, arguably the biggest court case in Ghana’s history, started on a controversial note.
The President of the panel of nine justices of the Supreme Court sitting on the case, Justice William Anaam Atuguba astounded lawyers and observers when he burst out into an emotional lecture of nationalism.
“This country is solid but is breaking down because principles are being chopped down to pedestrian level. The Court must be strong and truly independent. The health of [our] country depends on us," he stated, banging the table.
It is neither clear what provoked the outburst nor the target of the judge's comments but it appears his membership of the panel is being objected to by the petitioners who are opposing the NDC's application to be joined to the case.
The National Democratic Congress has applied to the Supreme Court to be joined as third respondents but the petitioners, New Patriotic Party’s Nana Akufo-Addo, Dr Mahamudu Bawumia and Jake Obetsebi Lamptey are objecting to this.
The case, called Thursday, had to be adjourned indefinitely after the petitioners, in chambers, raised an objection to the composition of the panel.
Lead Counsel for the petitioners, Philip Adisson wanted the substance of his objection to be taken in camera but opposing counsel, Mr. Tsatsu Tsikata, representing the NDC, opposed the move, stating he preferred a full public hearing on Mr Addison's objections.
Even though the petitioners did not say exactly who amongst the nine justices they have concerns with, Myjoyonline.com has learnt that petitioners are concerned about Justice William Atuguba whose cousin, Dr Raymond Atuguba has been appointed the Executive Secretary to the president John Mahama.
The president is the first respondent in the election petition.
The court adjourned the case sine die and asked the petitioners to file a formal objection with the court instead of the verbal objection they sought to raise.
The Nine justices empaneled to sit on the case are, W. A. Atuguba, (Mrs) Rose C. Owusu, Sophia A. B. Akuffo (Ms.), P. Baffoe Bonnie, Julius Ansah, S. O. Adinyira (Ms.), Jones V. M. Dotse, Anin-Yeboah, and Mrs. Vida Akoto-Bamfo.

On his sixth birthday, at the height of World War II, Albie Sachs received a congratulatory postcard from his father with a rather unusual wish inscribed on it: "May you grow up to be a soldier in the fight for liberation," read the card. "Looking back, it was a little bit heavy," remarks Sachs, now aged 78. But as burdensome as his father's message might have been, it instilled the young South African with a strong conviction about the value of justice, a belief Sachs has fervently advocated and fought for throughout his life.
Sachs became one of South Africa's most eminent political activists and judges, famous for being amongst the leading legal minds behind the creation of the country's groundbreaking constitution after the first democratic elections in 1994.
"Getting the constitution, when everybody predicted a bloody racial war, was a triumph in itself," says Sachs proudly. "And we did it ourselves; It wasn't forced on us -- we looked into each other's eyes, people who'd been trying to kill each other." And Sachs, one of the most prominent white South African freedom fighters, knew all too well about the cruelty of years gone by.
As a young lawyer defending victims of apartheid's repressive laws, he often faced the wrath of security police and was put in solitary confinement for nearly six months without trial.
Read this: Apartheid photographer 'sick of taking pictures of dead' In April 1988, while living in exile in Mozambique, Sachs lost his right arm and the sight in one eye to a car bomb. After a long and painful recovery, he returned to South Africa, a country he had last seen 24 years earlier.
Shortly thereafter, Nelson Mandela was released after more than 27 years in prison, and work began on the birth of a new South Africa, ending the horrors of the old regime and creating a new rule of law.
Sachs was appointed to serve as one of 11 judges in the newly established Constitutional Court, where he helped write one of the most world's most progressive constitutions in 1996.
"How can we live together in one country? What can the basic rules be, the basic values that respect the dignity of everybody?" says Sachs as he explains the thinking behind the constitution.
"Whoever you are, whoever your parents or grandparents happened to be, wherever you came from, whether you are exalted, whether you are humble, you're a person, you're a human being," he says.
"The constitution doesn't build houses, the constitution doesn't provide food, electricity, water, school text books, but it provides a framework in which people can claim these things, resolve their disputes and that's what we lacked before in South Africa. So if it hadn't been for the constitution, it would've been just total chaos, and most opportunistic grabs from power."

As someone who'd paid a big physical and psychological price for his fight for freedom, Sachs says the establishment of a just rule of law served to help a deeply wounded population put its troubled past behind it.
"It wasn't simply a healing of a fragmented, fractured, divided nation filled with enmities and fears and arrogance," he says. "It was a healing for me, personally," he adds. "The healing comes about through the achievement of the ideals for which we were fighting."

But Sachs was not only one of the architects behind South Africa's post-apartheid constitution; he also helped design the Constitutional Court in Johannesburg, an impressive building created to visually represent the ideas expressed so clearly in the country's new rule of law.
"We decided we wanted a building -- a brand new court, a brand new constitution," says Sachs. "Not one parachuted in from outer space, one that grew up from our history."
As a result, the Constitutional Court was chosen to be constructed right next to Johannesburg's Old Fort Prison, a notorious building whose walls had served to confine two of the best know civil rights figures of the previous century. "We say with a dubious pride, we South Africans have the only prison in the world where both Mandela and [Mahatma] Gandhi were locked up -- nobody else can make that claim," says Sachs.
"And we wanted to show the transformation from negativity to positivity, why we have a constitution," he adds. "Moving forward without forgetting the past and taking the terrible energy of hatred, division, pain of the past and using that force of that energy to create something positive and hopeful for the future."
A passionate art collector, Sachs has also donated several of his fine pieces to the Court. He is immensely proud of the building, where he spent five of the 15 years he was a Constitutional Court Judge, and never tires of visiting it. Now retired, Sachs lives in Clifton, Cape Town, with his family -- wife Vanessa and young son Oliver, aged six.
Sachs says he would never be able to give Oliver the same burden his father placed on him when he was six. He even admits he can't speak to Oliver about the horrors of apartheid.
"I don't want to," he sighs. "He'll find out. I can tell him that there were cruel people, put a bomb in my car, blew me up, wonderful doctor saved my life. I can tell him all that, that he can understand.
"I don't want to tell him that his mommy and his daddy, they wouldn't have been allowed to live together, to love, and to conceive him. I don't want to. It's like putting a burden on him, that we had to shoulder and deal with, and in a sense what we were fighting for was to be free of that lived reality and even the memory -- I'm happy to move on."

The other day in a Bible study, one of the participants asked if Judas Iscariot was saved or lost. In a room that contained two missionaries, two pastors, myself, and a couple of dozen other visitors, no one could come up with an answer. The question was asked in relation to the fact that Judas Iscariot had committed suicide by hanging himself, and the Bible study was on eternal security.
Forgetting about the questions of suicide and eternal security, we all should have known the answer on Judas Iscariot. Jesus Himself provided the answer in John 17:12, "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."
The son of perdition who was lost is of course Judas Iscariot.
Judas and Suicide
In relation to his suicide, one must note that Judas Iscariot was pronounced lost before his actual suicide had taken place. Judas appeared with the guards to betray Jesus in John 18, obviously before he had committed suicide.
There is nothing in Scripture to suggest that suicide itself is an unforgivable sin. Matthew 12:31 even suggests that suicide must be forgivable, "Wherefore I say unto you, All manner of sin and blasphemy shall be forgiven unto men: but the blasphemy against the Holy Ghost shall not be forgiven unto men."
The phrase, "all manner of sin" must include suicide. So, the lost state of Judas does not really have to do with his suicide; it has to do with the fact that Judas never repented and believed in Jesus Christ.
We know that Judas did not repent because he did not bring forth works that reflected repentance. Paul characterized his own preaching as telling people they should "repent and turn to God, and do works meet for repentance" (Acts 26:20d).
Judas's works did not reflect a repentant life. John 12:6 reports that Judas, who held the money bag, was a thief who stole from the money he had been entrusted with.
One may wonder whether a truly repentant person would ever commit suicide. I do not understand how this could be, either; however, Matthew 12:31 tells us that "all manner of sin and blasphemy shall be forgiven unto men" (excepting the blasphemy of the Holy Spirit). The sins of people who are not repentant will never be forgiven; therefore, if suicide has ever been forgiven, it must have been the suicide of a person who had indeed repented and believed in Jesus Christ.
Certainly suicide is a terribly unadvisable thing. The Scripture would seem to support the possibility that suicide is forgivable, but I think we should endeavor to follow the advice given at 2 Peter 1:10, "Wherefore the rather, brethren, give diligence to make your calling and election sure: for if ye do these things, ye shall never fall."
There can be nothing in this life that is so bad that we should risk our happiness in eternity to end our unhappiness here. Rather, in the midst of our troubles, we should keep in mind what Jesus said at John 12:20, "He that loveth his life shall lose it; and he that hateth his life in this world shall keep it unto life eternal." There are going to be many "reversals" when we reach heaven. Jesus also said, "Blessed are they that mourn: for they shall be comforted" (Matthew 5:4). It seems almost that the more troubled life we lead here, the more comforted we will be there.
We should hold to these promises, remembering also this word of Jesus, "And ye shall be hated of all men for my name's sake: but he that endureth to the end shall be saved" (Matthew 10:22). We have to endure through the hatred of other people for the sake of our faith.
Judas and Eternal Security
What happened with Judas has absolutely no bearing on the doctrine of eternal security; if anything, Judas' life supports the doctrine. It is evident from Judas' unrepentant actions, such as stealing from the money bag, that Judas had never repented and believed in Jesus Christ. In fact, Judas was never characterized as being a saved person.
In John 6:70, Jesus asks the rhetorical question to His twelve apostles, "Have not I chosen you twelve, and one of you is a devil?"
The basic nature of Judas Iscariot never changed. He was not saved and then lost. The man was never saved at all. He never repented, and so, was never born again, and he remained the same old sinful creature he had always been.
Paul wrote, "Therefore if any man be in Christ, he is a new creature: old things are passed away; behold, all things are become new" (2 Corinthians 5:17). Judas Iscariot was not in Christ because his old things had never passed away. Rather, he clung to his old sinful nature to the point that he was even willing to betray Jesus for the sake of 30 pieces of silver (cf. Matthew 26:15).
Therefore, the life of Judas Iscariot does nothing whatsoever to erode the Biblical doctrine of eternal security for the saved believer. What Jesus said remains true: "And I give unto them eternal life; and they shall never perish, neither shall any man pluck them out of my hand. My Father, which gave them me, is greater than all; and no man is able to pluck them out of my Father's hand" (John 10:28-29). Not even the man himself is able to pluck himself out of the Father's hand, if he is indeed in the Father's hand.
Did Judas Ever Repent?
At the point that Jesus was speaking of Judas in John 17:12, Judas had certainly not repented. However, after Jesus had been betrayed, we read in Matthew 27:3-5, "Then Judas, which had betrayed him, when he saw that he was condemned, repented himself, and brought again the thirty pieces of silver to the chief priests and elders, Saying, I have sinned in that I have betrayed the innocent blood. And they said, What is that to us? see thou to that. And he cast down the pieces of silver in the temple, and departed, and went and hanged himself."
The words "repented himself" here (from the King James Version) are not the best possible translation of the underlying Greek. The underlying Greek word means "regret" or "remorse" but it does not necessarily imply a change like the word for "repentance" does. The World English Bible translates Matthew 27:3 as, "Then Judas, who betrayed him, when he saw that Jesus was condemned, felt remorse, and brought back the thirty pieces of silver to the chief priests and elders" (WEB).
The key piece of information in interpreting this remorse of Judas is 2 Corinthians 7:10, "For godly sorrow worketh repentance to salvation not to be repented of: but the sorrow of the world worketh death." Given this piece of information, there can be little question that Judas' remorse did not result in repentance but in death, and it was merely worldly sorrow, not godly sorrow that he experienced.
In Conclusion
Sometimes we get so caught up in doctrinal principles that we fail to look at what the Bible actually says about things. The question of Judas' salvation has little to do with principles concerning suicide or eternal security. The answer is in black and white from our Bible, and the answer has come from the very lips of our Lord Jesus Christ: "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."

Foremost, I would like to know the person or group of persons who made this "One-Man" enacted dictatorial law and the rational as well as the motive behind that Law:
- I would also like to know if the Parliament of Ghana is so statisfied with the existing law , and are therefore, not prepared to "overturn", or repeal it , or make amendments with the mandate of the people.
Secondly , I do not want to believe that the Fouth Republic is programmed or predestined by a PNDC law to enable incumbents to steal elections and get away freely without fear of any consequences thereof, and go ahead to maintain their positions as legitimate public officials.

It was quite obvious right from the onset that atuguba is a politician and not a judge.
His political statements from day one and his reckless actions to throw all the hard evidence away, and daclaring it as not admissable to the court regarding the pettition was a clear manifestation that atuguba has something very serious against the NPP.
It was so apparent that he misused his judicial office and power to render the pettition irrelevant with no substance by ruling to throw the hard evidence away in oder to find grounds to dismiss the pettion at last.
KPMG rings a bell, when he "wilfully" played to the tune of tatsu tsikaka to throw some of the remaining pink sheets away.
His rulings were not based on law , but on personal feelings , self-convictions and personal political and tribal feelings.
How can a judge at the Supreme Court turn out against the law , become anti-law, and rule against the facts presented to him to rule upon, and thereafter, turn out to make his judgements based on personal political and tribal sentiments.

Atuguba’s Observation
At this point, the president of the court, Justice Atuguba, said he had an observation to make.
He said, “I am concerned that there should be at all times a very strong and truly independent judiciary.
He said the “health of the country must be preserved” and “if we don’t have a strong judiciary, we will be gambling with the destiny of this country”.
He noted that if that happened, he would not be part of it and added “I don’t think my colleagues would also be part of it.”
Justice Atuguba then said that the justices had decided to hear counsel in chambers where they would make a decision on whether it was something that should be heard in open court or kept in chambers.
Before retiring to the chambers, he said, “Ghana is a very solid country but it is breaking down because principles are being broken down almost to a pedestrian level.”

Election petition case: Justice Atuguba laments, Ghana is breaking down
Hearing of the NDC's application to be joined as a respondent to the NPP's Presidential Election Petition, arguably the biggest court case in Ghana’s history, started on a controversial note.
The President of the panel of nine justices of the Supreme Court sitting on the case, Justice William Anaam Atuguba astounded lawyers and observers when he burst out into an emotional lecture of nationalism.
“This country is solid but is breaking down because principles are being chopped down to pedestrian level. The Court must be strong and truly independent. The health of [our] country depends on us," he stated, banging the table.
It is neither clear what provoked the outburst nor the target of the judge's comments but it appears his membership of the panel is being objected to by the petitioners who are opposing the NDC's application to be joined to the case.
The National Democratic Congress has applied to the Supreme Court to be joined as third respondents but the petitioners, New Patriotic Party’s Nana Akufo-Addo, Dr Mahamudu Bawumia and Jake Obetsebi Lamptey are objecting to this.
The case, called Thursday, had to be adjourned indefinitely after the petitioners, in chambers, raised an objection to the composition of the panel.
Lead Counsel for the petitioners, Philip Adisson wanted the substance of his objection to be taken in camera but opposing counsel, Mr. Tsatsu Tsikata, representing the NDC, opposed the move, stating he preferred a full public hearing on Mr Addison's objections.
Even though the petitioners did not say exactly who amongst the nine justices they have concerns with, Myjoyonline.com has learnt that petitioners are concerned about Justice William Atuguba whose cousin, Dr Raymond Atuguba has been appointed the Executive Secretary to the president John Mahama.
The president is the first respondent in the election petition.
The court adjourned the case sine die and asked the petitioners to file a formal objection with the court instead of the verbal objection they sought to raise.
The Nine justices empaneled to sit on the case are, W. A. Atuguba, (Mrs) Rose C. Owusu, Sophia A. B. Akuffo (Ms.), P. Baffoe Bonnie, Julius Ansah, S. O. Adinyira (Ms.), Jones V. M. Dotse, Anin-Yeboah, and Mrs. Vida Akoto-Bamfo.

On his sixth birthday, at the height of World War II, Albie Sachs received a congratulatory postcard from his father with a rather unusual wish inscribed on it: "May you grow up to be a soldier in the fight for liberation," read the card. "Looking back, it was a little bit heavy," remarks Sachs, now aged 78. But as burdensome as his father's message might have been, it instilled the young South African with a strong conviction about the value of justice, a belief Sachs has fervently advocated and fought for throughout his life.
Sachs became one of South Africa's most eminent political activists and judges, famous for being amongst the leading legal minds behind the creation of the country's groundbreaking constitution after the first democratic elections in 1994.
"Getting the constitution, when everybody predicted a bloody racial war, was a triumph in itself," says Sachs proudly. "And we did it ourselves; It wasn't forced on us -- we looked into each other's eyes, people who'd been trying to kill each other." And Sachs, one of the most prominent white South African freedom fighters, knew all too well about the cruelty of years gone by.
As a young lawyer defending victims of apartheid's repressive laws, he often faced the wrath of security police and was put in solitary confinement for nearly six months without trial.
Read this: Apartheid photographer 'sick of taking pictures of dead' In April 1988, while living in exile in Mozambique, Sachs lost his right arm and the sight in one eye to a car bomb. After a long and painful recovery, he returned to South Africa, a country he had last seen 24 years earlier.
Shortly thereafter, Nelson Mandela was released after more than 27 years in prison, and work began on the birth of a new South Africa, ending the horrors of the old regime and creating a new rule of law.
Sachs was appointed to serve as one of 11 judges in the newly established Constitutional Court, where he helped write one of the most world's most progressive constitutions in 1996.
"How can we live together in one country? What can the basic rules be, the basic values that respect the dignity of everybody?" says Sachs as he explains the thinking behind the constitution.
"Whoever you are, whoever your parents or grandparents happened to be, wherever you came from, whether you are exalted, whether you are humble, you're a person, you're a human being," he says.
"The constitution doesn't build houses, the constitution doesn't provide food, electricity, water, school text books, but it provides a framework in which people can claim these things, resolve their disputes and that's what we lacked before in South Africa. So if it hadn't been for the constitution, it would've been just total chaos, and most opportunistic grabs from power."

As someone who'd paid a big physical and psychological price for his fight for freedom, Sachs says the establishment of a just rule of law served to help a deeply wounded population put its troubled past behind it.
"It wasn't simply a healing of a fragmented, fractured, divided nation filled with enmities and fears and arrogance," he says. "It was a healing for me, personally," he adds. "The healing comes about through the achievement of the ideals for which we were fighting."

But Sachs was not only one of the architects behind South Africa's post-apartheid constitution; he also helped design the Constitutional Court in Johannesburg, an impressive building created to visually represent the ideas expressed so clearly in the country's new rule of law.
"We decided we wanted a building -- a brand new court, a brand new constitution," says Sachs. "Not one parachuted in from outer space, one that grew up from our history."
As a result, the Constitutional Court was chosen to be constructed right next to Johannesburg's Old Fort Prison, a notorious building whose walls had served to confine two of the best know civil rights figures of the previous century. "We say with a dubious pride, we South Africans have the only prison in the world where both Mandela and [Mahatma] Gandhi were locked up -- nobody else can make that claim," says Sachs.
"And we wanted to show the transformation from negativity to positivity, why we have a constitution," he adds. "Moving forward without forgetting the past and taking the terrible energy of hatred, division, pain of the past and using that force of that energy to create something positive and hopeful for the future."
A passionate art collector, Sachs has also donated several of his fine pieces to the Court. He is immensely proud of the building, where he spent five of the 15 years he was a Constitutional Court Judge, and never tires of visiting it. Now retired, Sachs lives in Clifton, Cape Town, with his family -- wife Vanessa and young son Oliver, aged six.
Sachs says he would never be able to give Oliver the same burden his father placed on him when he was six. He even admits he can't speak to Oliver about the horrors of apartheid.
"I don't want to," he sighs. "He'll find out. I can tell him that there were cruel people, put a bomb in my car, blew me up, wonderful doctor saved my life. I can tell him all that, that he can understand.
"I don't want to tell him that his mommy and his daddy, they wouldn't have been allowed to live together, to love, and to conceive him. I don't want to. It's like putting a burden on him, that we had to shoulder and deal with, and in a sense what we were fighting for was to be free of that lived reality and even the memory -- I'm happy to move on."

The other day in a Bible study, one of the participants asked if Judas Iscariot was saved or lost. In a room that contained two missionaries, two pastors, myself, and a couple of dozen other visitors, no one could come up with an answer. The question was asked in relation to the fact that Judas Iscariot had committed suicide by hanging himself, and the Bible study was on eternal security.
Forgetting about the questions of suicide and eternal security, we all should have known the answer on Judas Iscariot. Jesus Himself provided the answer in John 17:12, "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."
The son of perdition who was lost is of course Judas Iscariot.
Judas and Suicide
In relation to his suicide, one must note that Judas Iscariot was pronounced lost before his actual suicide had taken place. Judas appeared with the guards to betray Jesus in John 18, obviously before he had committed suicide.
There is nothing in Scripture to suggest that suicide itself is an unforgivable sin. Matthew 12:31 even suggests that suicide must be forgivable, "Wherefore I say unto you, All manner of sin and blasphemy shall be forgiven unto men: but the blasphemy against the Holy Ghost shall not be forgiven unto men."
The phrase, "all manner of sin" must include suicide. So, the lost state of Judas does not really have to do with his suicide; it has to do with the fact that Judas never repented and believed in Jesus Christ.
We know that Judas did not repent because he did not bring forth works that reflected repentance. Paul characterized his own preaching as telling people they should "repent and turn to God, and do works meet for repentance" (Acts 26:20d).
Judas's works did not reflect a repentant life. John 12:6 reports that Judas, who held the money bag, was a thief who stole from the money he had been entrusted with.
One may wonder whether a truly repentant person would ever commit suicide. I do not understand how this could be, either; however, Matthew 12:31 tells us that "all manner of sin and blasphemy shall be forgiven unto men" (excepting the blasphemy of the Holy Spirit). The sins of people who are not repentant will never be forgiven; therefore, if suicide has ever been forgiven, it must have been the suicide of a person who had indeed repented and believed in Jesus Christ.
Certainly suicide is a terribly unadvisable thing. The Scripture would seem to support the possibility that suicide is forgivable, but I think we should endeavor to follow the advice given at 2 Peter 1:10, "Wherefore the rather, brethren, give diligence to make your calling and election sure: for if ye do these things, ye shall never fall."
There can be nothing in this life that is so bad that we should risk our happiness in eternity to end our unhappiness here. Rather, in the midst of our troubles, we should keep in mind what Jesus said at John 12:20, "He that loveth his life shall lose it; and he that hateth his life in this world shall keep it unto life eternal." There are going to be many "reversals" when we reach heaven. Jesus also said, "Blessed are they that mourn: for they shall be comforted" (Matthew 5:4). It seems almost that the more troubled life we lead here, the more comforted we will be there.
We should hold to these promises, remembering also this word of Jesus, "And ye shall be hated of all men for my name's sake: but he that endureth to the end shall be saved" (Matthew 10:22). We have to endure through the hatred of other people for the sake of our faith.
Judas and Eternal Security
What happened with Judas has absolutely no bearing on the doctrine of eternal security; if anything, Judas' life supports the doctrine. It is evident from Judas' unrepentant actions, such as stealing from the money bag, that Judas had never repented and believed in Jesus Christ. In fact, Judas was never characterized as being a saved person.
In John 6:70, Jesus asks the rhetorical question to His twelve apostles, "Have not I chosen you twelve, and one of you is a devil?"
The basic nature of Judas Iscariot never changed. He was not saved and then lost. The man was never saved at all. He never repented, and so, was never born again, and he remained the same old sinful creature he had always been.
Paul wrote, "Therefore if any man be in Christ, he is a new creature: old things are passed away; behold, all things are become new" (2 Corinthians 5:17). Judas Iscariot was not in Christ because his old things had never passed away. Rather, he clung to his old sinful nature to the point that he was even willing to betray Jesus for the sake of 30 pieces of silver (cf. Matthew 26:15).
Therefore, the life of Judas Iscariot does nothing whatsoever to erode the Biblical doctrine of eternal security for the saved believer. What Jesus said remains true: "And I give unto them eternal life; and they shall never perish, neither shall any man pluck them out of my hand. My Father, which gave them me, is greater than all; and no man is able to pluck them out of my Father's hand" (John 10:28-29). Not even the man himself is able to pluck himself out of the Father's hand, if he is indeed in the Father's hand.
Did Judas Ever Repent?
At the point that Jesus was speaking of Judas in John 17:12, Judas had certainly not repented. However, after Jesus had been betrayed, we read in Matthew 27:3-5, "Then Judas, which had betrayed him, when he saw that he was condemned, repented himself, and brought again the thirty pieces of silver to the chief priests and elders, Saying, I have sinned in that I have betrayed the innocent blood. And they said, What is that to us? see thou to that. And he cast down the pieces of silver in the temple, and departed, and went and hanged himself."
The words "repented himself" here (from the King James Version) are not the best possible translation of the underlying Greek. The underlying Greek word means "regret" or "remorse" but it does not necessarily imply a change like the word for "repentance" does. The World English Bible translates Matthew 27:3 as, "Then Judas, who betrayed him, when he saw that Jesus was condemned, felt remorse, and brought back the thirty pieces of silver to the chief priests and elders" (WEB).
The key piece of information in interpreting this remorse of Judas is 2 Corinthians 7:10, "For godly sorrow worketh repentance to salvation not to be repented of: but the sorrow of the world worketh death." Given this piece of information, there can be little question that Judas' remorse did not result in repentance but in death, and it was merely worldly sorrow, not godly sorrow that he experienced.
In Conclusion
Sometimes we get so caught up in doctrinal principles that we fail to look at what the Bible actually says about things. The question of Judas' salvation has little to do with principles concerning suicide or eternal security. The answer is in black and white from our Bible, and the answer has come from the very lips of our Lord Jesus Christ: "While I was with them in the world, I kept them in thy name: those that thou gavest me I have kept, and none of them is lost, but the son of perdition; that the scripture might be fulfilled."

Foremost, I would like to know the person or group of persons who made this "One-Man" enacted dictatorial law and the rational as well as the motive behind that Law:
- I would also like to know if the Parliament of Ghana is so statisfied with the existing law , and are therefore, not prepared to "overturn", or repeal it , or make amendments with the mandate of the people.

…That “To the relatives of judges sitting on the election petition, … If you have a relative who is on the panel go and tell him that you don’t want a funeral on your hands, beg him to speak the truth. …. I know the judges, they will speak the truth, but there is one or two, one particular judge who opens his mouth at anytime and the next thing you hear is a warning. I want him to know that he can’t intimidate us. I have never heard him warn Mahama.”

Your "Dr" Afari-gyan FAILED by his incompetence on all the above managerial principles. People like you especially the majority of Ghanaians think the same think being described as "president", "Director", "minister", "chairman", "ceo", etc is itself competence. Afari-dyan is the typical African and Ghanaian "leader", who thinks his/her title alone and length of occupation in a position alone shows competenceand "professionalism".
Afari gyan is not competent nor professional by any stretch of the imagination since all the elections he had conducted so far were fraught with avoidable errors, mistakes, fraudulence and corruption, but because they were not subjected to scrutiny like the 2012 elections, they were undetected.

Men of double standards. Afari Djan understood delegation very well. That is why he asked for proof of wrong doing by the NPP before going to announce results. He cannot be every where to authenticate the good behaviour or otherwise of his lieutenants. got that?

Maybe we were over-ambitious: no verification-no vote - when majority of our own educated folk are virtually "illiterate". I understand they were told to charge the verifcation machines after every six hour of usage. But what did they do? They waited until the batteries run out completely and the machines went off. Several otehr instances of sometimes almost deliberate human error, or is it our way of doing things in this part of the world? taking things for granted, not paying attention to detail...? Dr. Afari Djan will be retiring soon and should not be made to feel worthless, after several years of sacrifice for this nation. I dont think a party should waste precious time and resources going to court hoping that the court will nullify someone else votes to enable them win? Why dont they work on winiing DECISIVELY???

I can't agree more with others that Justice Dotse got it wrong here and went personal, an attempt to take sides with the NPP call that the EC Chair is incompetent. Whoever was a keen follower of the election 2012 will come to agree that Dr. Afari Djan did the best under the circumstances and to call him incompetent is really below the belt. These are the reasons why:
The NPP went to the Supreme court to present him from undertaking his very constitutional obligation of creating new constituencies when new districts were created. This delayed greatly the compilation of the electoral registers and threw the election 2012 processes into some form of chaos. It was only when the Supreme Court gave the green light, barely days to the elections did the Electoral Commission then got the green light to move forward.
In previous elections, the EC used Teachers from our public and private institutions for these elections. These teachers took part in the registration and also managed the elections. Given that the timetable was changed, the teachers could not be used. Many other individuals were used for the Presiding member job.
Is it the case that Justice Dotse wanted Dr. Afari Djan to be central in recruiting all the Presiding officers and other election official, whether temporary or permanent, then what comes of his deletion role? The fact that we had some clerical errors occurring in this election does not make the EC boss an incompetent individual. Is Justice Dotse telling us that even when we see typos in the final judgment in circulation we should conclude that the Justices are incompetent? I don't think so, so the call that the EC boss failed is not correct.
It beats my imagination when people see things in a straight jacket. Believe you me, if the Supreme Court had requested for the KPMG to put all 2602 pink sheets to the test of the NPPs microscope, everybody would have realized that the same errors bandied around would have recurred in all of them, significantly having no effect at all. I have followed elections all throughout since 1992 and I can bet that this election 2012 was the best Ghana has ever had. If truly there was any cheating anywhere, in the form of over voting, voting without biometric verification amongst others, the parties would have protested way before even the declaration.
To my last point, any person who is security oriented and understood the temperature of Ghanaians at the time of the elections proper (7, 8 and 9th December 2012) would have advised Dr. Afari Djan to behave the way that he did. All that the NPP was looking for was a delay of the process to allow them file injunctions at the Supreme court to hold the elections and have things over turned. That would have sent Ghana into a brink of war, trust me. For me, Afari Djan did the best under the circumstance and I will judge him not by the outcome of the 2012 elections, but the principles and proven processes he and his team have instituted for our elections. The petitioners went to court and all of us submitted ourselves to the court because of the very processes the EC instituted.
Somehow, and sometimes, I turn to agree that our Justices are too partisan in your views. Maybe they need to grow beyond partisanship and see things fairly.

Afari Gyan himself had already said at a confab in Ho that the EC intended to prosecute some officials who were tasked with the task of recruitment and training agents in the regions. Such people, pocketed the money for training and recruited unsuitable relatives and friends. Given the short time available, it would have been quite impossible to detect such fraudulent activities even if Afari Gyan had traveled to the affected constituencies to verify things himself. Only tip offs from the public could have uncovered such bad actions.
Having said that, I perfectly agree with him that the frivolous case wouldn't or might not have gone to court if the EC had given a listening ear to the aggrieved parties for at least 2 days, show them the signatures on the original sheets which did not appear on the duplicates they received and explain a few other things. Why on earth couldn't Afari Gyan do that, and spare us the monumental charade and economically debilitating situation Ghana has been put into?
So, Justice Dotse agreed that it was no case and shouldn't have been brought to court! That's very telling of even a justice who went on to grant some of the reliefs of the petitioners, obviously on the spurious grounds of their not being given much attention but rather told to go to court!
Anyway, as part of reforms, I had already suggested that a CI be passed barring the EC from declaring results of polls for a period of not more than 5 days once a complaint was officially lodged. A Tribunal comprising Reps. of the EC, the contesting parties, presided over by a High court judge shall examine the complaints and give their decision within that period. After that, any party still aggrieved can go to court, if they so desire. No more nonsense like this one! Such tribunals which are integral parts of the justice systems of continental European countries are very efficient and fast ways of handling many issues relating to govt depts, etc. We need more of them in Ghana to bypass the clogged and laborious courts.

Today the matter is still in court. DOTSE, IS THAT COMPETENCE ON THE PART OF YOU JUDGES? Another case. The state acquired PRIME land from the allodial owners and built flats on them for its officials. Jake lived in one of those flats and decided that on leaving govt service he alone should buy that flat. When the matter came to court, you Judges ruled that Jake is right in buying that flat. In the face of that RULING, some of your colleague Judges are living in rented flats ON GOVT ACQUIRED LANDS AND OTHER PEOPLE'S TAXES ARE BEING USED IN PAYING RENT IN US$. What horror stories have we not heard about the various court registries in this country - the missing dossiers,'fronting' for Judges who dabble in 'brown envelopes',etc?
Btw,are these people who consititute JUSAC or whatever their name is, not permanent staff members,many of whom have had several years on-the-job training? And is the EC, under Dr. Afari Gyan, unique in its hiring and training processes? The SC of Canada case cited by all the the parties adressed this point,and this attack on Dr. Afari Gyan is part of a concerted effort, by certain individuals and groups in this country, to tarnish the reputation of this very dedicated and humble Ghanaian.
My question to JSC Dotse is this:has the 8 long months devoted to this petition asnd the ruling handed down satisfied the petitioners and their NPP supporters? We thank the Almighty that the proceedings were televised for all to see what the petitioners were trying to do,that is come to power through the backdoor!

JUDGE Dotse did not say anywhere that Dr Afari Gyan stole the election for any body but simply incompetent. The judge also deduced that NPP did not have a case and the petition should have not seen even a single day in court.

According to Justice Dotse, his examination of some of the contentious pink sheets, which were identified and upon which some cross-examination had been conducted upon in court, has revealed that some of the Presiding Officers appeared to be illiterates and know next to nothing.
“They do not only have very bad writing skills, but cannot express themselves in simple language and even denote figures in words correctly. I will in this context blame the appointing authorities of such low calibre of staff,” the respected judge added.

Everybody can make mistakes. We need to come up with constructive ways of solving our election problem. Blaming Afari Djan, a particular party or SC will never solve our problems. EC has invited all parties and citizens to come up with suggestions to improve the process or the system and people continue to spend energy in blaming instead of writing about ways to improve the process. Ghana does not belong to any party. Maybe for Ghana we should all be independent voters without party affiliation. On Election Day everyone casts his secrete vote without intimidation. That is just a suggestion. Will that work, of course I don't know.

The electoral commission DOES not enjoy the sort of budget the judiciary does, and has no capacity to engage the sort of permanent staff that Dotse would like to see in place.
Second, Afari-Gyan is perfect at his job but again for the lack of funding, he's not been able to hire & train the competent staff that Dotse, sitting in his "ivory tower", thinks every institution has or should have in Ghana. Dotse apparently is either ignorant about economics or is playing the ostrich game here.
Finally, from Dotse's own statement, he is clear that Akufo-Addo had no business going to court if only Afari-Gyan had responded to the NPP's concerns. And this is where, Dotse has clearly showed that he is lacking in mental capacity. If Dotse really listened to all the bogus arguments "Dr Pink Sheets" made in court on behalf of the petitioners, can he Dotse in good conscience believe that Afari-Gyan had any chance at all of making the NPP gang understand the obvious?

I know it’s a shame that every facet of our society is riddled with corruption? After 56 years of independence we still depend on the donor countries to support our budget and yet all we hear in our ears NPP this, NDC that. Isn’t mind-boggling that a country that is endowed with enviable rich resources can’t get its act together and have to receive money from donor countries to fund its election?
What we don’t realize is our corruptness is enriching the western countries, just watch Jungle Gold or take a look at Chinese destroying our water etc.
Really, what I think ails us is the fact that most Ghanaians won’t take their tribalistic and partisan blinders off and smell the coffee.
Reading your piece tells me that you and I both and most people are concerned with the rot in our beloved country, so instead of being at each other’s throat when issues like these come up, we should put pressure on our government to curb corruption, demand accountability from our government, insist that the government provides oversight for the their various institutions etc..
Also, instead of insulting each other I think supporters of the political in power should rather mount pressure on them to improve systems, and threaten them that they won’t vote for them if these don’t happen, maybe this will scare them. Just like what every caring parent does when their children get off the right track onto the wrong track…
Really belongs to all of us not any political party, in fact what I realize most of these politicians seem like their enemies in public and yet behind closed door they eat from the same bowl.

But talking about illiteracy, Justice Dotse himself appears to be quite ignorant of the cardinal principle of equity which states that " He who come to equity must come with clean hands".
There are 26,002 polling stations in Ghana. The petitioners chose their preferred sample of 24,000 pink sheets upon which they wanted votes annulled. And this block head of a judge thinks the petitioners have not acted in bad faith and somehow Akuffo Addo ought to be declared President based on 24,000 pink sheets.

If not for thefact that the Constitution did not allow anyone to disenfranchise qualified Ghanaian voters, this judge would have done so and declare Nana the president. Justice Dotse failed to state that not a single allegation including vote padding which Dr Afari Gyan was confronted with before the declaration was brought to the SC by the petitioners. This judge has indeed confirmed his status as an NPP card carrying member. He should resign and go into full time politics to help his party, the NPP win power starting from the Volta Region his home base. After all you knew petitioners had no case except to capitalize on the weaknesses of ill-trained EC officials.

Justice Dotse failed to observe the limitations imposed by by logistics, an issue very relevant to most organisations in Ghana, be they governmental or private. By this, Justice Dotse seems to have provided winds for the sails of the petitoners and their sympathisers, but by the same stroke, the learned Justice seems to have opened the pandora box for attacks on his person and his integrity. Dotse could have done with much less vitriol.

Long before this court matter some of us have complained about the calibre of people recruited to manage our election issues. If the country is not willing to invest in the process but paying enhanced allowances to those involved in the elections, we cannot attract qualified personnel to manage the elections. We want to give peanut to those who work for us but we think we are qualified to take the big allowances.
Until we are ready to entice qualified individuals by paying ''good allowances'' we cannot attract beetter qualified people to manage our elections.

He is solely responsible for the NPP going to the Supreme Court to challenge the 2012 election results and posterity will judge him as such. His performance during the petition hearing was mediocre and substandard and whilst Bamumia managed to come out of it smelling of roses, Afari-Gyan's came out of it having lost his credibility and integrity.

THAT AS I HAVE POSTULATED TO THE ENTIRE WORLD THAT "JUSTICE SEEKS THE TRUTH AND NOTHING BUT THE TRUTH".

IN FACT, THE SAME CANNOT OR COULD NOT BE SAID WITH THE 2012 PRESIDENTIAL ELECTIONS PETITION CHALLENGED SINCE COUNSELS FOR RESPONDENTS INSTEAD OF TO RAISE "A PRELIMINAY CHALLENGE ON THE PETITION ITSELF AND OTHER LEGAL ISSUES RAISED AS FRIVOLOUS, CAPRICIOUS, VEXACIOUS AND MALICIOUS" BUT RATHER ENGAGED THE PETITIONERS ON "PINK SHEETS CLERICAL ERRORS INSTEAD OF ON POINTS OF LAW AND LEGAL BASIS".
THAT THE WHOLE MATTER WAS "A QUESTION OF LAW AND NOT PINK SHEETS".
HOWEVER, THE SUPREME COURT OF GHANA HAS NOT BEEN FULLY APPRISED WITH THE LEGAL POSITIONS SINCE COUNSELS FAILED TO MAKE THE RELEVANT LEGAL ARGUMENTS BUT JUST DWELL ON FACTS AND RATIONALITY OR RATIONAL ANALYSIS OF THE FACTS.
IT IS MY FIRM BELIEVED THAT IF THE COUNSELS FOR RESPONDENTS WERE TO RAISE THE PRELIMINARY OBJECTIONS TO THE PETITION AND MADE THE RELEVANT LEGAL ARGUMENTS SUPPORTED WITH THE RELEVANT PROVISIONS OF THE CONSTITUTION AND OTHER RELEVANT LAWS THE COURT WOULD HAVE DISMISSED THE LAWSUITS ON THE ONSET.
THAT I AM RESPECTFULLY CALLING ON ALL THE MEDIA HOUSES THAT COVERED THE PROCEEDINGS TO PRODUCE THE TAPE RECORDINGS OF THE PROCEEDINGS OF THE AMICUS CURIAE REVIEW MOTION AND THE LEGAL ARGUMENTS THAT I ADDUCED AT THE COURT AND EACH COUNSELS RESPONSE AND THE COURT RESPONSE AND THE THE COURT RULING TO HELP THE READING PUBLIC TO ASCERTAIN THE DIFFICULTIES POSED BY SOME OF THE COUNSELS RESPONSES TO THE JUDGES.

THAT THE TRUTH OF THE MATTER WAS THAT THE MALPRACTICES AND OTHERS THAT THE PETITIONERS COMPLAINED ABOUT AND COMMENCED THE LAWSUITS DID NOT OCCUR IN REALITY AT THE POLLING STATIONS THEMSELVES THAT THE LEGITIMATE VOTER COULD BE BLAMED OR ACCUSED OF BUT JUST "MERE CLERICAL OR ADMINISTRATIVE ERRORS" THAT DID NOT ACTUALLY AFFECT THE FINAL OUTCOME OF THE FINAL RESULTS DECLARED THAT IT THEREFORE DEFILED COMMON SENSE THAT THOSE GENUINE AND HONEST SINCERE VOTES CAST TO BE PURPORTED TO BE ANNULED THAT THE ISSUE THEN IS "WHERE THEREFORE WILL BE JUSTICE ITSELF?".

Justice Dotse can not be more wrong. Who told him the NNP gang will not go to court if EC had taken 2 weeks to explain things to them. The only word from Afari Djan that will stop them from going to court will be for Afari Djan to reverse the votes in their favour. What is the difference between what the court told NPP and what Afari Djan had told them earlier. The verdict is the same. NPP you have lost the election.
Justice Dotse had tried so hard to find a reason to overturn the election in favour of NPP but there was no avenue for him to do so. Now he is angry at Afari Djan who was able to determine the answer for NPP within a day instead of weeks or months as Justice Dotse will like to see.

THAT DR.AFARI-GYAN HAS DONE NOTHING WRONG TO CAST A SLUR ON HIS REPUTATION AND INTEGRITY ESPECIALLY AS DR.BAWUMIA TOLD THE SUPREME COURT IN HIS EVIDENCE IN CHIEF AND UNDER CROSS-EXAMINATIONS THAT WHEN THEY WERE PREPARING THE PINK SHEETS TO COMMENCE THE LAWSUITS THEY ALSO MADE "MISTAKES" AND HE EVEN FURTHER STATED THAT "THEY MADE MISTAKES AS ANYBODY OR ANY PERSON CAN ALSO MAKE MISTAKES" AND THAT THE LEGAL POSITION AND LEGAL EFFECTS OF DR.BAWUMIA TESTIMONY WAS NEVER ADDRESSED IN LAW.

(v) WHETHER OR NOT THE PURPORTED MISTAKES MADE CAN BE CURED BY THE COURT WHEN THE PETITIONERS THEMSELVES ALSO MADE THE SAME MISTAKES?
(vi)WHETHER OR NOT THE PROVISIONS UNDER CLAUSES 4,5 & 6 OF ARTICLE 57 CHAPTER 008 OF GHANA 1992 CONSTITUTION OF THE CASE OF A SITTING PRESIDENT OF GHANA WHILE IN OFFICE ACTED AS OUSTER CLAUSE(S) TO
