He managed to convince the fanatical NPP supporters that there was rigging but not level headed people like Wireko Brobbeys and Kwame Pianims. The fact was that Nana knew that he lost the elections but was feeling too big to concede defeat to a "small boy" John Mahama. The three issues that had 5-4 were not crucial. I have read Justice Ansah's ruling where he sided with the petitioners on all those other three. But the problem was that the votes from these categories could not lead to decalaring Nana an outright winner as the petioners sought in their second relief. So Justice Anash and the others on his side rather called for a re-run in the affected areas. So you see where Akuffo Addo "won" on the minority side, his victory could not bring him the desired declaration.It is not only Wireku Brobbey who needs apoligising to. Bernadrd Moarnah also deserves an apology from all those NPP followers demanding a review. But what would that review do? A re-run in NDC stronghods with Ashanti region being an on-looker? Afari Gyan would still be in charge, NPP footsoldiers already despondent ould be to terrified to go and campaign in enemy territory, in the midst of people whose votes they tried all under the sun to annul.

Even the accusation that Mahama colluded with Afari-Djan was jettisoned. The whole petition stinks and shows the basic indecency and dishonesty of Akuffo-Addo, Obetsebi Lamptey and their poodle Sir John.
See how they are now threatening to seek a review - a ploy to keep the country on edge again. And Tsatsu was right to call out Justice Anin-Yeboah. His writing is full of bias, venom and illogic. He would annul votes and have people stand in line all day to re-vote only because the Presiding Officer forgot to sign the pink sheet even though the representatives of all the parties certified the vote as correct. Shame on him. It is not contempt to accuse a Judge of Bias if their is the basis for it. Judges are asked to recuse themselves all the time because of bias!! As I said in the beginning, this was nothing but a bogus case in search of evidence!!

Kofi, You are right that the bits on dupicate serial numbers, etc, were not thoroughly examined. Perhaps if the petiton had been solelt based on the three latter infractions, the split decisions on them would have presented good grounds for a review of the judges' decison.
However, as Justice Dotse who dealt with them extensively has noted, their inclusion has shown major flaws in the electoral system that have to be dealt with.
"It really does not make sense for the Electoral Commission Chairman, Dr. Afari Gyan to state that it is the printers who generate the numbers on the pink sheets in order for them to keep count of the number of pink sheets they have printed. This is not only absurd but also exposes the Electoral Commission as lacking any control mechanism to really check the actual number of pink sheets delivered to them.
For example, if a printer generates his own numbers from say 0000001 and goes on to 9,000,000, whilst in actual fact, the physical count is less than the quantity the Electoral Commission paid for, then the Electoral Commission would have been short changed.
Dr. Afari Gyan to me, was not convincing on this point at all, just as he was on many other issues. But for the weakness in the petitioners case on this issue, I would have dismissed the Electoral Commission’s explanation as not being reasonable.
It is for this and other reasons stated in this judgment that I am of the view that there are indeed urgent reforms needed in our electoral process and administration."

In medical school we called that "batanga" and often occurred at end of unit vivas where students undertook an oral examination. Some who were not well prepared often thought they could talk their way through things they didn't know and of course ended up failing failing the exam. This is how i saw Dr Bawumia and his testimony.
As I suggested that the time, if Dr Bawumia had been honest and said that admitted 'lack of clarity on his part' about some of the issue you raise here, people would have been more inclined to take his testimony more seriously but like many "batanga politicians" his approach was to be confrontational, cheeky, arrogant, snobbish and simply stubborn and difficult. That is why his ignorance and stupidity were exposed.
Of course the whole NPP petition team were clueless and even when they were found wanting, instead of simply letting it die quietly, they still foolishly chose to include it in their summing up written statements.
It sometimes makes you wonder whether these guys were just plain stupid (which clearly they were) or whether in addition to that, they somehow thought they could 'bully' their way through this and hope that somehow my unknown-unknown would favour them when it came to the vote.
So, like the proverbial gambler who continues to put on large bets when he is losing in the hope that he will win big to cover all his losses, this CLUELESS team hedged their 'bets' and to be fair to them, they could have pulled it off, but for the majority of the justices putting commonsense and the country before their own parochial interests. That's my take.

The main stratey of the Petitioners was maximise the volume of evidence sent to the Justices and the Respondents with a view of over-whelming them, confusing them, and thus gate crash the decision in their favour but it failed woefully.
The Petitioners were misguided by victories they obtained in previous cases against the NDC government based mainly on technicalities and poor preparations. They failed to notice that in those cases the state was defended by State Attorneys who could have been either incompetent or badly influenced. Little did they know that the Respondents were going to put up a team that will dedicate itself and make extreme sacrifices to win the case.

Kofi I think that if you study the rulings, it is not clear cut that the Judges dismissed the duplicate serial number claim for the same reason. Some declined because there was no law governing the pink sheet numbering unlike ballot papers.
You have to read the grounds for the petition to understand how the case was conducted. There were two grounds:
1) The elections suffered from infractions and malpractices that undermined its credibility. This is the leg on which the duplicated serial numbers rested on. The fact that variously, it has been recommended that this should be streamlined in future, shows that their case on duplicate serial numbers received a sympathetic ear but not held to affect the results.
2) On whether Bawumia should have been a witness, it is a settled case in law (Ghana Evidence Act), you can be a witness when analysing a public record. You do not have to be there. Both Asiedu Nketia and Dr. Afari-Gyan also testified that they did not have personal knowledge of the events they were defending.
Largely, this petition failed because we do not have a Presidential Election Act, unlike Parliamentary. The petitioners more or less had to construct an act from applicable statutes and the Constitution. This is what allowed the 'political' Judges to escape from their responsibilities. This is the hole that any reforms should plug.

One of the reasons given for the rejection both in Ansah and Atuguba's ruling was that the issue of the duplicated serial numbers was not backed by law, thus accepting Asiedu Nketiah's assertion.
Akuffo Addo knew. He was simply being dishonest because to him, he must be president at "all cost" and cannot fanthom why majority of the voters rejected him. It is simply an act of dishonesty perpetuated by the pertitioners.
