The same Constitution that grants the SC powers is the same one that grants powers to EC. Thus, the SC cannot order the EC to reform let alone propose reforms. Even without any petition, Election 2012 differed greatly from that of 2008; so will it be for 2016. There will surely be electoral reforms, but not based on the liars and sore losers' ill-filed petition.

From what I heard from following the Supreme Court hearings, it is obvious that there were duplications, over voting and Biometric irregularities. For the sake of peace, I applaud the decision of the Supreme Court Judges. Not to say there was nothing wrong took place during the election. But I do not want our Nation to suffer civil unrest; or a soul to be lost in overturning the election results.I think we must learn for the experience and do things better than previous.
Ghanaians should not forget that, three High Court Judges varnished under NDC rule. Don't you think the Supreme Court Judges may have thoughts of ruling against NDC may be a signature to death treats and possible death? They made the right decision to save their own predicaments and or save our Nation from a possible civil unrest and live lost possibility.
Since the Supreme Court ruled against any wrong doings, they are bound to turn blind eye on any wrong doing. Saving their neck is also a prescription to pretend there was no wrong doing.
This means, whatever went wrong could not be addressed. Ghana will pay the price again.

I have, on previous occasions, noted that the 5-4 rulings for and against objections raised during the trial would be identical to the final judgement. It was no secret to the keen mind that Atuguba presided over a divided panel with a majority leaning against the petitioners.
All along Atuguba's protracted unwillingness to bring certain behaviours of the respondent's lawyers into order became unbearingly obvious when a woman justice stepped in a few times to gavel for him.
It was a clear picture drawn to which only the blind could not foresee the outcome. It was a kangaroo court under the whip of a justice who should have excused himself in the first place for conflict of interest.
I blame the Petitioners for not persuing their quest for Atuguba to excuse himself for conflict of interest - being a relative of Mahama the defendent.

Yes, the Supreme Court first saved their own head from the possible risk of prosecution from NDC. Remember three High Court Judges varnished under same NDC rule.
Second, they saved Ghana from possible civil unrest. Because if the decision had gone against Mahama, who knows how NDC followers were going to react. Could NDC leaders act civil? Very doubtful.
I think all Ghanaians should applaud the Supreme Court decision, for peace and avoidance or national unrest and possible lost of lives.
But the Supreme Court should be bold to embrace truth and reforms.

Now we also know that the supreme court set 2 conditions...whether irregularities occurred and if it affected the results.
So the question is why did the court use a different criteria? Because if they had used their own 2 conditions, the first condition would have stood because 5 of them admitted the claims.
Rather the pompous and self important Atuguba and co used 6 different set of criteria based on the petitioners' claim....

Electoral reforms are very important indeed!
I told a few colleagues that the petitioners case will not change the election results and nobody listened.
What the petitioners did, was only to punch holes and highlight our shortcomings into our election process.
But for their own devious ways and frustrations, they mad everything look like Afari Gyan was in bed with the NDC to rig the elections. That is very EVIL!!!!!
The fact of the matter is, the agents and the presiding officers were not well 'educated' (Will leave that for another day) enough to carry out the entire process. That is part of the reforms that needs to be considered thoroughly by OUR OWN system and money.
The bio-metric machines were NOT thoroughly tested before they were released out there. And the back-up plans in case of its failure was not
adequately thought through.
And NOT any funds from the EU! Or else they will be dictating to us who and what we should be aloud to be marrying each other, and all sorts of garbage inserted into the funding.
We, the people of Ghana should contribute to this process...........
If we don't involve the people of Ghana in the process, I will say this to all Ghanaians.............the deprived of OUR society will one day rise up to the status quo....and we will all have ourselves to blame for the consequences.
The NDC and NPP held our dear nation to ransom without the other parties calling out to their supporters to expose their useless deeds and acts...
but, rather kept silence till the next elections? What is wrong with our so-called leaders?
I will say it again to GHANAIANS...NDC and NPP have NOTHING to offer GHANAIANS.........they are mere stooges to the West. They are just there to sell our rich natural resources to the west on the cheap; to the detriment of our children's livelihood. THEY DO NOT CARE ABOUT OUR CITIZENS!!! Don't we get it???????
Please combine their years in office with that of Osayefo Dr. Kwame Nkrumah
and Kutu Acheampong. (I will leave that for another day).

"---So then, impliedly, and by majority decision, the Supreme Court in dismissing the case appears to be saying that nothing wrong happened ----"
Wrong interpretation!!! Democratic processes are implemented by humans, not angels. In all democratic countries, some glitches always occur. You only have to observe the high profile presidential elections in the US to see how, in some cases, delibrate voter suppression methods are used by some parties. But what always determines whether something need to be done is whether there was sufficient obtruction of the election process. That may be a judgement call, and in the case of this petition in Ghana, the judgement of the majority of the judges was that there was not enough disruption.
Secondly, there is almost a sacred democratic obligation to avoid the nullification of the rights of millions of honest and genuine voters to exercise their vote when, out of no error of their own, they arrive to exercise their right to vote only to have their votes nullified on the technicality that, somehow, machines say they don't exist as Ghanaians. Most just legal systems would do everything to avoid canceling millions of voters votes when they did nothing wrong. These are some of the imperfections of human systems and I would rather avoid canceling millions of genuine votes on a technicality.
I do not believe that the judgement means that no reforms are necessary. I do not know what reforms, if any, may be necessary, but if ways can be found to ensure that the technicality that puts millions of genuine votes in limbo is removed, neither the judges nor any right-minded Ghanaian will object. Besides, the petition has provided a collective education on elections to the public in general which is invaluable, and so any commission set up seeking to introduce election reforms is likely to get a broader input from the public at large rather than just from "I put it to you" clicks

The justices made a decision not to seek justice but to do the right thing in their views to keep the peace. The bulk of legalities involved in granting the petitioners their wish would have been too much for the court and the country to handle...they found themselves in compromising position by siding with the electoral commission and by the same token they have secured their respective retirements. None of them wanted to retire from the supreme court and live like justice Kpegah. A lot of money was at stake...they grabbed it and kept the status quo. Corruption has eaten into the fabric of every aspect of Ghanaian society and has finally been entrenched implicitly by the supreme court.

I have never see a process when party agents are present, count the vote and validate them with their signatures.
The EC is one of the best in the world. Some people thing that they must be president, they must always win election, their oponents are their enemies, and that is naive, nonsense, and foolish because when they win is free and fair and the oposite is true.
It is time for you guys to travel and see how other contries vote and their elctoral process where they do discriminate and many bad things.
Let thank the EC, SC, and all loving Ghanaians. God bless ghana and all Ghanaians.

what i fear most about this ruling is that Atuguba and co will not sit in an electoral case as this again. NPP nor any of the opposition parties will not bother to send their case to supreme court but instead take matters to their own hands and resolve them at the pooling sites since the SC clearly demonstrated to the entire nation that there was nothing wrong with voting system but clearly endosed the irregularities. And if one cannot trust the institution that was establish to bring fairness into the process then
matters will be resolved without them

I believe Ghanaians will understand why the NPP vehemently protested Atuguba's inclusion as a member of the bench charged by the Supreme Court to adjudicate upon the election petition, esp. when if was known that John Mahama had appointed his cousin at the seat of the presidency as personal secretary.
As soon as the NPP launched their protest, Atuguba started yelling and beat his hands on tables etc. Little did Ghanaians know that he would be so biased. Personally, I had thought that the verdict would be fair. But like many Ghanaians, I was wrong! What the Supreme Court has told us by their verdict is: "you can go to hell; nobody can challenge our judgement or decision" esp. when some people were jailed while others got fined. These actions taken by the court was in a way probably to instill fear in Ghanaians so none would dare make any comments after the verdict.
Many will now understand that Seven (7) of the justices were appointed by Rawlings' NDC govt. while Two (2) out of the Nine (9) were appointed by Kuffour's NPP govt. And by this structure of appointments, there was bound to be some bias in the case. The justices in whom people had put their trust have rather disappointed Ghanaians by their Verdict. Elections are meant to be free and fair, without any hint of malpractices, omissions, commissions, irregularities, voting without verification, over voting and situations where presiding agents of the EC blatantly refuse to append their signatures fearing charges or accusations of fraud or maybe part of the fraud that seem to have already been planned or plotted ahead of the elections. It's so sad to note.
People have started questioning what would be the situation when a similar thing occur in future elections? By the petitioner's case in the December elections, that was put before the Supreme Court, Ghanaians have been informed of the dirty tricks that's been associated with our elections over the years, and what ought to be done about it. Some of the Supreme Court justices don't believe so; they think everything is just okay!
We now understand why there've been post-election violence when majority of the electorates think that they've been cheated. Is it right to say that the Supreme Court whose duty to the state is to make our law work, and whose duty is to correct all the wrongs and fraud in our system has the right to ignore facts and evidence in such a case?
By their ruling, Ghanaians have also been informed that our system of justice also need some reforms. Maybe, we may have to amend the constitution and allow the public to vote for justices to the Supreme Court.
The Thursday, August 29 verdict by the Supreme Court will go down in history as a "Black Thursday" in Ghana's electoral history, along with the election petition writ filed by NPP's presidential candidate, Nana Akufo-Addo, Dr. Bawumia and Jake Obetsebi-Lamptey.
May God bless our Homeland Ghana. Amen!
