My personal view is that, whether there will be a review by the loser or not will depend on the arithmetic of the decision. Whilst a 5-4 decision is more likely to result in a review by the loser, it is highly unlikely if the decision is by 6-3 majority, unless a review will require the totality of the Justices of the Supreme Court. Ordinarily, a review will require two additional Justices who may influence the original Justices to change their earlier decisions or stick to them. Imagine the original Justices do not change their minds and the two new Justices vote to support the minority decision, it will still be 6-5 in favour of the original decision.
Though I wish the loser will not seek a review so as not to extend the political tension and uncertainty in Ghana, which is damaging to the economy as some foreign investors are waiting for the outcome of the presidential petition before they make their minds up, a review is what the law allows. It is therefore the right of the contesting parties and there will be nothing wrong for any of them, especially, NDC and NPP to exercise that right.

CLAUSE(S)(1) The validity of the election of the President may be challenged only by a citizen of Ghana who may present a petition for the purpose to the Supreme Court within twenty-one days after the declaration of the result of the election in respect of which the petition is presented.
(2) A declaration by the Supreme Court that the election of the President is not valid shall be without prejudice to anything done by the President before the declaration.
(3) The Rules of Court Committee shall, by constitutional instrument, make rules of court for the practice and procedure for petitions to the Supreme Court challenging the election of a President.."
THAT THE LEGAL ISSUE INVOLVED IN THE SUBSTANCE OF THE PETITIONERS RELIEF(S) BEING SOUGHT WHETHER OR NOT THE SUPREME COURT HAS THE CONSTITUTIONAL POWER AND AUTHORITY TO ANNUL VOTES?

(v) WHETHER OR NOT A HYPOTHETICAL DOCTRAINAIRES CLERICAL ERRORS ON THE PINK SHEETS AND NEVER OCCURRED AT THE REAL POLLING STATION CAN BE TESTED IN A LAW COURT?
(vi) WHETHER OR NOT THE ELECTION OFFICIALS INTENTIONALLY, WILLFULLY AND DELIBERATELY COMMITTED THE CLERICAL ERRORS PURPORTED TO BE MADE ON THE PINK SHEETS?
(vii) WHETHER OR NOT THE PETITIONERS THEMSELVES WHEN PREPARING THE PINK SHEETS TO COMMENCE THE PETITION AT THE SUPREME COURT MADE THE SAME ERRORS OR MISTAKES ON THE PINK SHEETS HAS ANY LEGAL EFFECTS OR RAMIFICATIONS?
(viii) AND ANY OTHER LEGAL ISSUES THAT MAY OR MIGHT BE IDENTIFIED AND WITH THE PROPER INTERPRETATION OF THE APPLICABLE LAWS AND LEGAL THEORIES NOT HYPOTHETICAL WOULD HELP RESOLVE THE CASE FOR A FAIR,JUST AND FIRM DECISION TO BE RENDERED THAT MAY BE ACCEPTABLE TO ALL THE PARTIES, THE GOOD PEOPLE OF GHANA AND GHANA FRIENDS THROUGHOUT THE WORLD IN ACCORDANCE WITH THE PREAMBLE TO GHANA 1992 CONSTITUTION.
IT IS THEREFORE VERY CLEAR THAT IT IS NOT ONLY ASKING FOR NO REVIEW BUT IT IS A QUESTION OF LAW THAT SHOULD BE PROPERLY AND APPROPRIATELY APPLY AND TO BE INTERPRETED ACCORDINGLY TO HELP PROMOTE PEACE AND UNITY IN DIVERSITY IN GHANA SINCE LAW IS A TOOL FOR/OF DEVELOPMENT THAT ALSO BRINGS AND PROMOTES HARMONY AND SOLIDARITY BETWEEN AND AMONG THE PEOPLE.

Two, let the "losing" side publicly call on their supporters to accept the verdict.
Fourth, let the National Executives of the "losing" side congratulate the "winning side".
Five, let no provocative jubilation or celebration explode from the camp of the "winning" side.
Finally, the media. That is where flames can readily be set by sheer unguarded utterances. That's where passion may be allowed to go astray and ignite chaos. There's thus the need for utmost circumspection from the media; print, electronic, etc.

I am of the opinion that if the grounds or reasons given by the judges for ruling on the case is not backed by the constitution, then party that loses out should be able to go for a review. We Are fond of pretending that it is ok, while in actual fact it is not ok.
Just before the elections, the peace council and Otumfuo advised the parties to accept the election results and when it became obvious that things did not go well as per the rules and constitution the petitioners were being branded sour loses because they refused to accept what to them was not right.
One can conclude that the things that they raised concerns about and the go to court, go to court mantra of the EC chairman was probably due to the fact that they expected the petitioners to accept the results because they have agreed at the peace. Council meeting that they will not challenge the results.
I am sure that leaving that option open will help our democracy.

I wasn't all that surprised because I knew for a fact that the EC has been helping the NDC rig elections since 1992, and they were ready to do it again. Folks will recall that it was John Mahama who went around country bragging that; "if God says you won't be president, it shall remain so" even when the 10 year old could tell that it's simply impossible to win elections when you're not known. Esp. when it had become obvious that the NDC had performed poorly in managing Ghana's economy, under late Prez. Mills.
The fact still remains that ever since ex-Prez. Kuffour handed over power to the NDC, things have never been the same; life has become unpleasantly unbearable! And there was this fact that the president had just passed away. Where in this world would this happen? Probably except Ghana.
For the NDC, election fraud is common. They believe that stealing the ballot is a cool thing to do. Folk would recall the 2008 elections. After the elections in which Afari-Gyan declared late Atta-Mills the winner, the whole country fell into a very sorrowful mood. It didn't take long for people to realize that the country was heading into an economic ditch. If Ghanaians had become weary of stolen verdict, then that was the last straw that broke the camel's back.
Nana Akufo-Addo was prevailed upon some elders of state to put off his court challenge. The EC and the NDC should have taken some notes here. Instead they must have thought that they could do it anytime or once more, so far as Dr. Kwadjo Afari-Gyan remained the EC boss. That's why Afari-Gyan was saying to the NPP; "go to court; go to court" thinking that once he's announced the winner, nothing can be done about it. The NDC's scribe, Asiedu Nketia as went about say: "any idiot can go to court" thinking it's all over! The NDC went on to tell Ghanaians and the world that: "elections are won at the polls, but not in the court room. The were wrong! They've awaken to the most severest shock of their lives. Truly the election petition case is before the Highest Court of the land; the Supreme Court.
The NDC now finds themselves in a very hot spot. They had thought that nothing could stop them in their crazy election schemes. Folk would recall the pre-election discoveries that the NPP made, concerning NDC's plot to scuttle the ballot, with the Boateng Gyan recorded tapes. Now their bottom have been uncovered. They can run, but they cannot hide.
Folks would recall that before the Decembe elections, I had called on the NPP to be vigilant and expose all NDC's wicked plot to steal the ballot? Happily and interestingly, it was NDC's own agrieved members who showed the NPP all the ropes---I mean the honest ones who crossed carpet.
The fact is John Mahama and the NDC didn't have any campaign message to tell Ghanaians. They rather focused on using the media esp. radio to denigrate the Nobleman, Nana Akufo-Addo. While Nana was spreading his Free Education and the need to turn away from the Guggisberg kind of economy, to a value-added economy which could bring jobs, esp. to our youth, the NDC wasted time trying to refute any good point that he made. What a shame! Now they can clearly see the kind of stupid and senseless moves they made.

When NPP lost twice against Tsatsu at the supreme court, they went for review and appointed two more judges to win. If NDC lose, they will go for review just as NPP did not accept election results.

I agree with you. Why was the provision for review put there in the first place? There are people who even thought the election petition was wrong and that the losing party should have just accepted defeat.

What's the meaning of this statement? The law says if you lose, you can go on appeal and the IEA says what? If the NPP or NDC loses, they can go an appeal, it's their right
