When Ken Kuanchie was summoned before the Supreme Court he feigned ignorance of the law guiding proceedings in the court. Now William Atuguba has set out the parameters guiding proceedings yet a law professor is criticizing it. The head of the panel of judges has the prerogative to decide what is contemptuous and what is not acting within the law. This is not an academic exercise, it is an application of law and common sense.

You do not go on that you don't find what you said offensive so you will not apologise. That is the beginning of a dispute or conflict. Do not write to the court period. If you have anything to say, go to the court and ask permission to address the court. there are processes for doing that. Stop confusing your students and shut up and learn from the honourable judges.

Kwaku, the headline of your article and some of your arguments are right but please, put it in the right context. You do not want to make us believe that the Supreme court is saying that no body can write to it? does it not depend on the context in which the letter is written?
Should we just write any letters to the SC which are meant to challenge their decisions or plead our case if we feel the need to? Won't we be prejudicing every case int he court if we did that? Should we not know the limits of our 'powers' as citizens in respect of what we can or cannot do when an active case is in the court?
Why do you seek to contradict yourself Kwaku? Only a few days ago, you said that those who had written to the court "should be exposed and face the law" in a comment you posted to this very issue to which I agreed. Now you realise these letters are coming from your own side of the debate, you are trying to argue differently.
By all means provide a balanced intellectual discourse or analysis of the pros and cons of any issues including this one, but I think as intellectuals, we need to be consistent and true to our calling so please don't fall prey to the 'cheap and easy' way. We are all in danger of misleading as well as casting doubt on our intellectual standing if we are not careful in the way we convey our messages.

Presumably to bring his or her opinion or knowledge to the attention of the judges. If this is so, simply put your letter could influence their decision and that is the point. Go to the open court through the laid down procedures and speak whatever you intend to write about.
No judge said you cannot comment on any case before them BUT your comment must NOT bring the court into disrepute or demean or bring the credibility of any of the judges into question period.

No wonder this forum and others like it are full of insults and unprintable words. I challenge all Ghanaians, especially those who visit this forum to cease insulting people for one week. Let's examine the issue; this is what Atuguba said,

Did Atuguba tell us how and what to write or he just told us that, we can't write to the judges? Why are you so fixated on Kwaku Asare and not Atuguba who could not made things clearer for the people he termed "lay men?" So may I ask where Atuguba and his bench told us when, how and what to write?

It is the business of counsel on either side to bring up matters IN COURT.' Judges are not students of the public to be educated by them in the manner you are suggesting.
Besides you have chksen to give two examples only kn your attempt to efend your position. Who says those are the only types of letters that can be written? The problem in Ghana is that many people now take it upon themselves to be seen and/heard on many matters and will rush to make ridiculous staements to condemm issues that are in the public domain.
What you have said does not cast you out as intellectual but rather as someone who does not think out your position well before talking. Don't you think that SC judges are better equipped to know their job than a lecturer, especially since don't think you lecture judges?

Be informed that democracy and its allied systems of free speech and rule of law sits on a culture and not wholly dependent on written texts. What was Amekudzi doing in court at the beginning of hearing the petition.If he was amicus curae and therefore heard in open court, what is the 'sin' in writing to the court if even to influence them.This is done in every jurisdiction particularly by interest groups and people of considerable knowledge on the issues at stake. They are called INFORMED OPINIONS
For your information, the wo/men on the bench get it wrong too. Don't swallow everything hook, line and sinker. Make it a point of questioning thoughts and events - that is how progress comes about.
