Instead of the Atuguba concentrating on improving courtroom procedures and thing forward on how to address and prevent issues suc as safeguarding evidence, lawyers behaviour, providing courtroom conduct and behaviours through a brochure to all attendants at the court, he is rather focusing on irrelevant issues outside the jurisdiction of the case.
It is these administrative incompetencies which are affecting Ghana's development.

It is rather unfortunate that calls for Justice Atuguba to excuse himself from panelists chosen to sit over a hearing involving his relative who is a first respondent and a material target of petitioner's complaint went unheeded.
From day one all critical eyes were on him and it was no secret that his assumption of stewardship became as suspect as most of his harsh admonishments directed at the petitioners.
Secondly the honourable justice could have chosen not to read newspapers nor watch televised comments since such indulgements could influence his decision.
Unfortunately in a free society public officials become targets of scrutiny by individuals and media. There are disadvantages as well as merits attached to latitude granted to unfettered exercise of right by the constitution. Having gone through harsh periods of intimidation and undue advantages of those in power the framers of our constitution deliberately decided to add "unfettered right" to freely exercise speech and that includes criticism of those in robes and gowns.
For Justice Atuguba, a man who has sworn to protect and defend the constitution at all times, such exercise of right to free expression in its implausible taste ruffles his judicial feathers to scorn the constution into doing what will baffle historians in their search for logic or prudence behind such action.
Did such action change the dynamics of thoughts ? An action which was purported to silence voices of unruly dissent will now be the subject of a breakfast table talk across the nation opening doors to question "Who is this Justice Atuguba ?"
The answer is: "A relative of the first respondent"

I am glad you cited USA for your argument and presumed you are an ardent follower of events in same. Just recently there was this NFL player in court for assaulting his wife. The lady judge after hearing the case decided to be lenient on him and was told to be of good behavior and under probation. He was moved by the unexpected outcome of his trial. Overpowered by his emotion of joy he decided to hit the butt of his attorney to express gratitude as often done to colleagues on the field of play. This act drew laughter from the court audience. You know what? The judge did not waste time at all to temper justice with mercy. A 30 day prison sentence was immediately handed down to the dude. Mann! it was sad to watch this guy being led to jail. This happened about two weeks ago but he was pardoned last week after his first appearance and rendering an apology to the judge. So freedom of speech you mean? Well, no country is more democratic than the USA which you cited but it happened. Take note that every right has a limit through regulations and the limit of your freedom is just the beginning of the other. Sammy is a lucky dude on this one but should be careful of what he says next.

Atuguba should have clearly indicated that so far as you belong to the opposition dont talk then we would have understood his position. My goodness, now what is going to happens is that no NPP member can say anything in this country for fear of imprisonment whiles, NDC members take us for a ride. The judges aggression on sammy came as result of the last warning issued out on Monday. Sammy happened to be next person who has call the justices name on their rulling. I think Ghana is becoming a lawless country and we seem to be admiring the kind of attitude most of the youth are displaying. It is a very big disgrace for our nation. I am very happy the judges used sammy as a scapegoat to bring some discipline. Since this election petition, Ghana is witnessing a lot of lawlessness and people go free after every misbehavior. We live in a country where to law enforcing agencies are not allowed to do their work because every move they make are politicized. If we do not differentiate the truth from politics our future generation will experience a chaotic future and I think it the mandate of the supreme court justices to ensure that Ghana does not decend into the gutters. A lot has been done but we need to start from somewhere hence sammy awuku. I hope this action from our wise men will deter others.

At the commencement of the election petition hearing, I wrote and made it known to the general public that Justice Atuguba, presiding judge is a BULLY judge whwnever he sits on a case. Again, I raised the question of element of CONFLICT OF INTEREST on the part of the presiding judge Atuguba. Looking at the concept of disqualification for interest or bias, Justice Atuguba falls within and if it were to be in any other jurisdiction he would have disqualify himself in this case.
A judge is disqualified from hearing a case in which he or she has a direct pecuniary or proprietary interest, or in circumstances where there is a reasonable suspicion or a real likelihood that he would be biased. The matters that may give rise to a suspicion or likelihood of bias include personal hostility, friendship, FAMILY RELATIONSHIP or acquaintance with a party. I think Justice Atuguba does not think about his credibility.
What we are seeing now around the whole wide world(WWW)confirm his bias.
We are all witness to the softly, softly approach on Tsatsu and Tony behaviour at the court room. Tsatsu and Tony can go free but not Addission.
NDC communication team can go free for their war like pronouncements but not Sammy Awuku and NPP communicators.

I'd want to inquire what our Noble Justices are saying to John Mahama who's going around telling everyone that he won the elections, hands down when the election petition is still before the court; is he above the law, or he has the right to deceive Ghanaians and the world? I believe that Justice Atuguba should convince Ghanaians that he and his team of Justices means their word.
The Supreme Court is the other "Arm" of Government and with the authority vested in them, they really have to demonstrate that they're not closing their eyes and ears on anyone's conduct. John Mahama is NOT above the laws of the land. The balance of justice must be equal.
So far, Nana Akufo-Addo, Dr. Bawumia and Jake Obestebi-Lamptey have kept quiet, except John Mahama. It's time for the Supreme Court to demonstrate what the really stand for.
