I need education here, maybe. My understanding of a contract is that until all paperwork and conditions have been met and signatures appended, it is not concluded, and therefore not binding. I would have thought that this includes subjecting it to parliamentary approval.
I would also have thought that until all these had been done, either party or parties reserve the right to pull out. They may or may not advance a reason for withdrawing.
I find it disturbing that people are questioning why the NPP government pulled out of the ISOFOTON deal, and therefore did not subject it to the legal parliamentary process. The government DID NOT have to give reasons for pulling out.
Even more intriguing is the fact that when ISOFOTON sued, though there was no contract, people went ahead and paid them. Did the judges who awarded payment to ISOFOTON not realise that because it had not received parliamentary approval before Kuffuor's government pulled out, there was no contract? Does it not occur to people that the word 'abrogated' is not right in ths context? How could it have been abrogated when it was never completed and therefore, not a contract?
Do people also remember that after the infamous Okudzeto Ablakwa press conference, it was made public knowledge that the Prof Mills government paid a tidy sum to a team of international lawyers to ascertain whether Ghana had a case? And that the team recommended that Ghana should not pay because there was no contract? Why pay someone to advise and then ignore what they say? What was the point in engaging and paying them if you were not going to heed their advice? Did that in itself not amount to causing financial loss to the state?
Personally, I think we should be more concerned with berating government officials who abuse their positions of trust by paying these monies when they have no need to.
It may have been immoral of the NPP government to have allegedly led ISOFOTON up the garden path, but it is criminal to waste our money the way the Prof Mills government did.
Morality in this instance is subjective. However, criminality is illegal and punishable. Which one should we go for, immorality or criminality?
I would the former, and not hesitate to condemn those who helped to bleed Ghana dry.

A contract identifies the job at hand and such items like conditions pertaining to the job at hand after bids are accepted and evaluated. A contract phase, that is, signing documents and exchange thereof, is entered after a bidder is retained, meaning definitions and working conditions and delay notices are accepted by the awarding party. Once signatures are appended and go ahead is given it means a contract deal is done.
In this Waterville case, it is understood Kufuor government clearly gave the green light that kickstarted the jobs so Waterville spent some resources as it engaged operations.
Whatever ensued was not clear later but the contract was terminated. Later, it was noted a different contract was re-entered with Chinese authorities who offered by far very competitive prices which might have offset Kufuor’s government’s decision following realization that money could be made with the later rather than the former, hence the decision to abrogate the contract as it stood.
What was wrong was the government’s decision to award contracts without recourse to parliament which imperatively had a say in such international contracts, an issue dictated by the constitution to which the government pledges itself. And the courts are holding on to the unconstitutionality of the contracts (since they have not been approved a priori by the parliament) to rule against Waterville.
The question for you is, don’t you find it weird that a foreign company scrambling to another to claim having signed job contract with the government and claiming judgment debt for unlawful abrogation (They would not be making claims in the first place it they didn’t think they had to) of the contracts? We aren’t talking of one company!!! I don’t envy the situation of Waterville because clearly they are pure evil-inclined since they were doing shaddy deals behind the naïve citizens of Ghana when they should have known better.
Kufuor’s government in similar situations awarded so many contracts that went behind parliament but latest info has it that the previous governments did the same. This promptly calls into mind the lawlessness and indiscipline of our governments when they want citizens to be well-behaved.

Why is it that some contract didn't go to parliament? The official in-charged at time were paid by the tax payer to do clean job and if they fail they must be called to answer. The courts should punish both sides.

By handing over, the former minister would have made the new Minister aware of what important contracts like the Waterville saga, what has been done and what need to be done. Since the NPP Ministers refused to do the handing over, the new ministers were left in darkness. As an independent person, I think the call for Kufuor? Ministers and the then officers to assist in clearing the case, is in place. They are the correct people to assist in clearing the air and not the NDC Ministers. In nutshell, mr Amoah is wrong to rubish the calls. They must not be arrested but help in geting to the bottom of the problems.
