Indications are clear that Tsatsu Tsikata, counsel for the National Democratic Congress, 3rd respondent in the ongoing election petition hearing at the Supreme Court, is banking his hope on exploiting technicalities in his desperate bid to save his client from defeat. Mr Tsikata’s NUMEROUS BORING DAYS of cross examination appears to have failed in mounting a strong challenge to the case of the petitioners in the context of the two issues being determined by the court. The issues are whether there were statutory and constitutional violations, irregularities or malpractices in the conduct of the December presidential election and whether, if any, they affected the outcome of the election.
The NDC’s counsel has mainly focused on defects in respect of labelling of exhibits by the petitioners, as well as those identified in respect of the pink sheets and affidavits. These defects, according to legal experts, are ‘curable’ and do not have significant effect on the case of the petitioners.
