United States is pleased with the on-going
political situation in Ghana with regards to the current petition
challenging the outcome of the December 2012 presidential polls in
court.
Mr Michael Pelletier, Deputy Assistant Secretary, Public Diplomacy and
Public Affairs, African Affairs of the US Department of State, said “it
shows that the institutions are working in Ghana and people have
confidence in the institutions.”
Mr Pelletier said this in an interview with the Ghana News Agency at
the US Department of State building in Washington DC yesterday after
meeting with 2013 Spring Professional Fellows to address US-Africa
foreign policy issues.
Professional Fellows are up and coming and mid-level emerging leaders,
who are competitively selected from across the globe by partner agencies
of the US Department of State to come to the US and work with US public
and private institutions and NGOs with the aim to broaden their
expertise as well as understanding of American society.
For this year’s Spring programme, 220 professionals in the areas of
legislation, economics and media were selected from over 40 countries
including Ghana, China, Peru, Costa Rica, to participate in the event
where they spent four weeks working with various US institutions.
Some people have suggested that, the on-going election petition case at
the Supreme Court has and or might affect investor confidence in Ghana
but Mr Pelletier said the election petition case did not affect US-Ghana
relations in anyway adding that it also did not undermine or cast a
slur on Ghana’s integrity amongst the investment community in the US.
He said “you have the laws and the rules and you are just following the laws to address your grievances and that is right.”
The 2012 presidential candidate of the New Patriotic Party (NPP), Nana
Akufo-Addo, his running mate Dr Mahamudu Bawumia and Chairman of the
NPP, Jake Obetsebi Lamptey are challenging the outcome of the December
2012 presidential results at the Supreme Court, and have requested the
court to annul substantial amount of votes secured by the winner,
President John Mahama, citing alleged irregularities during the polls.
Mr Pelletier said the US government would continue to work with the
Ghana government to promote the welfare of the people in-line with its
(US government) foreign policy objectives, which included strengthening
democratic institutions, ensuring rule of law, free press, and promoting
opportunities in economic growth and development.
Ms Tara Sonenshine, Under Secretary of State for Public Diplomacy and
Public Affairs said the Professional Fellows Programme was at the core
of the US government’s ideology and practicality adding it promoted
mutual understanding between the US and other peoples across the world.

WHO WON THE 2012 PRESIDENTIAL ELECTIONS. THAT THE PETITIONERS IN THEIR
PURPORTED ASSUMPTIONS OF ANALYSIS AND CALCULATIONS MADE SERIES AND
SERIOUS MISTAKES THEMSELVES OF WHICH THE SECOND PETITIONER DR>MAHMOUD
BAWUMIA WHO IS NOW UNDER CROSS-EXAMINATIONS TOLD THE SUPREME COURT
ADMITTING MAKING THOSE MISTAKES AND EVEN WENT ON TO SAY THAT "EVERYBODY
MAKES MISTAKES". THAT THE LEGAL ISSUES INVOLVING THIS RELATED MATTER ARE
AS FOLLOWS:
(i) WHETHER OR NOT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN BE SUED OR TO BE JOINED TO A LAWSUIT AS DEFENDANT?"
THAT GHANA 1992 CONSTITUTION CHAPTER 008 ARTICLE 57 SECTIONS 4, 5 & 6
CLEARLY READING ALL THE SECTIONS TOGETHER IN EFFECT PROVIDED THAT " A
SITTING PRESIDENT OF GHANA WHILE IN OFFICE IS NOT AMENABLE TO ANY COURT
OF GHANA".
THAT THERE IS A LEGAL PRECEDENT IN THE CASE OF "NEW PATRIOTIC PARTY
(NPP) VRS. PRESIDENT RAWLINGS & ATTORNEY GENERAL". THAT IN THIS CASE
THE NPP CHALLENGED THE CONSTITUTIONAL AUTHORITY OF THE PRESIDENT
APPOINTING THE DISTRICT CHIEF EXECUTIVES". THAT THE SUPREME COURT HELD
UNANIMOUSLY THAT THE PRESIDENT RIGHTFULLY EXERCISED HIS CONSTITUTIONAL
AUTHORITY UNDER ARTICLE 57 SECTION 4 OF MAKING SUCH APPOINTMENTS.
THAT IT WAS IN THIS CASE THAT A MEMBER OF THE PANEL RAISED A PRELIMINARY
OBJECTION "WHETHER A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN OR
COULD BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT?" THAT THE SUPREME
COURT HELD 3-2 MAJORITY THAT "A SITTING PRESIDENT OF GHANA WHILE IN
OFFICE CANNOT BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT".
THEREFORE SETTLED THE LEGAL POSITION OF THE QUESTION IN VIEW OF THE
FIRST PRINCIPLE OF THE RULE OF LAW WHICH PROVIDES THAT "THE SUPREMACY OF
THE LAW IS AS ADMINISTERED BY THE ORDINARY COURTS OF THE LAND AND IN
THE INSTANT CASE THE SUPREME COURT OF GHANA AND HAS THEREFORE GIVEN
EFFECT TO THE LAW AS SUPREME".
IT IS AT THESE RELATED BACKDROP THAT BEFORE THE SUPREME COURT
ENTERTAINED THE PETITION AGAINST A SITTING PRESIDENT OF GHANA WHILE IN
OFFICE WHETHER OR NOT A PRELIMINARY OBJECTION HAS BEEN RAISED IT
BEHOOVES ON THE COURT TO MAKE A DETERMINATION OF THE ISSUE FIRST AND
FAILURE TO MAKE A DETERMINATION OF THE LEGAL ISSUE OFFENDS BOTH GHANA
1992 CONSTITUTION ARTICLE 57 SECTIONS 4,5 & 6 , CASE LAW AND THE
RULE OF LAW, JUSTICE AND FAIR-PLAY.
(ii) WHETHER OR NOT A PREPARER OR MAKER OF A DOCUMENT WHO MAKES A
MISTAKE ON THE FACE OF THE RECORD IS THE DUTY OF THE COURT TO CURE SUCH
DEFECTS IN VIEW OF THE BODY MAKING THE DOCUMENT CONSTITUTIONAL AUTHORITY
IS SUBJECT TO THE CONSTITUTION ONLY AND ALSO INDEPENDENT AS THE
JUDICIARY ITSELF?

Please enlighten me on this portion of the write up. "By printing duplicate polling station sheets with duplicate serial numbers, the EC introduced 2.6 million votes which benefited John Mahama and led to an outcome that did not reflect the sovereign will and wishes of the people of Ghana. Therefore NPP-USA concurs with Dr. Bawumia that the EC is economical with the truth on the issue of the Duplicate Polling Station Sheets".
1. How do you explain that this exercise benifitted Mr John Mahama given that the 2.6 mil votes to be annuled is for all the aspirants.
2. Were surpervised election conducted at those polling stations?
3. Must the originals and alleged 'duplicates' station results all to be annuled?
4. Should my votes not count because of a purported wrong doing of EC?
Please let be objective and call a spade a spade. 'Elections are won through votes casted and counted not administrative procedures'.

Don't forget that the NPP had their polling agents at the so-called duplicate polling stations. Their are only against polling stations within the NDC strongholds that Mahama won. To them, if the SC heeds their demand and annul all pro-Mahama polling station results, Nana Addo can then become the President.

Even heaven knows NPP lost because the serial number on the pink sheet before it is filled does not identify the suggest the pink sheet is not unique because the EC explained that the EC issued those pink sheets to places that extra was needed so wherever the extras was needed those pink sheets were used.
Infact this is why Tsatsu Tsikata the bdc lawyer requested that the SC do an audit up show all that pink sheets with same serial numbers were used in parliamentary votes too. This same audit will reveal why NPP has sat on the Asante and eastern regional votes because they know it will only go to show their selective game of picking pink sheets mostly from where John mahama won.
All foreign observers, Codeo, the international and local press, ecowas, thr commonwealth, NPP own polling agents etc all say the election was won by John Mahama except the NPP. Are we to believe that those Ghanaians that voted in Asante region and eastern on the second day of voting should also be tossed? Or are we to toss millions of votes because some untrained bloke forgot to sign the pink sheet?

If I can remember very close to the election there were causes to believe the (espercialy Nana Kunadu) may be illegible after threats of going to court, however this could not have been an excuse for it.
