You are dishonestly insulting Tsatsu, because you never commented on Addison's uncouth submission that Tsatsu should better sit down because he had run out of questions. Or you think this was ethical. Let me put on record that evidence and/or questions that are irrelevant are inadmissable in court, so if Addison thinks that Tsatsu's questions are irrevant, he should object to them as irrelevant. Heis not able to do so because he knows it is legally right for Tsatsu to question each pink sheet presented by the petitioners. The issue of repetition does not arise because issues have been duplicated, triplicated etc by the petitioners themselves. Every good lawyer knows what Tsatsu is doing is what is required of him even though I think that this detailed cross-examination was expected more from EC's lawyer than Tsatsu. If you don't have legal brains, this might prove too mouthful for some of you to comprehend. God bless Ghana.

Sometimes those woh profess themselves as knowing and having facts or documents do not really have foko and neither do they know tiiin!! One such a character is Kweku Baako Malik. Kweku in his mind thinks that Tsatsu's marathon of questions is sending him nowhere. Of course those with little brains will not see and cannot see through what is going on. The whole issue is about credibility, sincerity, and integrity and at the end of it all merit. Who says what is Kweku Baako imagines is what is in Tsatsu's mind? Tsatsu's target in posing his questions is obviously different from what Kweku Baako is imagining. So Kweku Baako has come up so loudly based on his myopic thinking and sense of direction. But my class six boy was able to tell where he thinks Tsatsu is aiming at and what his questions and exposure of the skewed and biased selection of the pink sheets with the supposed or so-called irregularities had been been done by the NPP to support their claim and demand that Nana has won and so should be made President. We all thought that the so-called revelations or checks to show case the irregularities should cover the entire country. But looo and behold here we are with a complete show of double standards. The standards of measure manner of determining what is to be annulled and what is to be accepted by the NPP'S standards should be applied by then equally in screening all the pink sheets from the 2012 elections. Tsatsu's aim is not to give credence to NPPs claim of voer voting, irregularities, and all that crap but to simply tell the whole world that the NPP petition lacks credibility and that there is insincerity, double standards, biased and skewed selection of documents to support their claim. Tsatsu has greatly succeeded in doing that and in fact only the daft cannot see the damage Tsatsu has done to BAWUMIA and for that matter the NPP. I ask Baako to open no only his eyes but more importantly his brains and his thinking a little more beyond dogmatic politics of supporting your master with eyes and minds closed to good reasoning.

He just need to punch holes in that point and make it weak. Thats exactly what he is doing. About repeating questions, it is a trick lawyers use to make you contradict yourself. Remember Bawumia i a witness. As a witness, you credibility and honesty is the only assert you have. So giving different answers to the same question or contradicting yourself makes you an unreliable person and for that matter what you are saying as a witness. Is unfortunate that our loud mouth journalist just talk without knowledge of the matter. Where did Kwaku study law or anything thereof? Infact all the journalist covering these procedings or making comments, what background do they have in law? We want to copy things from CNN, BBC etc. but we are not ready to learn how things are done. I have never seen any journalist on CNN or BBC comments on legal issues unless they have a law background. But come to Ghana, all SSS graduates are journalist and a making comments on issues they have no clue about.You think the 9 judges and the lawyers are so stupid and dont know anything about the laws of the land? I just pity Ghana for these empty barrels that keep making noise all over the airwaves.

It is becoming increasingly unerving to hear Kwaku Baako take the posture of a Mister Know All and always wanting to goto town with persons he disagrees with. What does he know about law practice and for him to comment on the performance of Tsatsu Tsikata. I will not say I am amused at the way Tsatsu is going about the cross exan=mination, but hey, he is in charge and to the extent that he is doing all these within the acceptable limits of the law or practise, I do not thnk it is fair for anyone to condemn him. I have heard and seen all manner of attempts to satanise Tsatsu for the simple reason that he is doing his job as a lawyer. If Kweku Baako is saying his cross examination is going nowhere, then they should allow him to be, after all he will be impairing his own matter. But the truth is that these pro-NPP apologists are getting worried because Tsatsu seems to be slowly bt surely unmasking their chicanery and that is what is becomng a bother, hence these mudslingings at Tsatsu. Just take a very close look at Phillip Addisin, the lawyer for the Petitioners and you will see in him the air of arrogance and ecentricism. These NPP guys make it look as if, apart from them there are no others who can be scholars and so when t becomes obvious that somebody is about to outshine them, they do all manner of things to denigrate that person. These NPP guys do all manner of things when they know or think others are not watching. I am sure viewers of GTV saw how Gloria Akuffo, one of the lawyers and spokesperson of the Petitioners threw off the very polite invitation of the GBC anchorman at the Election Petition hearing. These are the doube standard folks whom we are dealing with. Unfortunately many Ghanaians are ready and happy to b duped by these crooks. My life cannot be deternmined by any politician in Ghana. I owe myself the duty to improve upon myself and so I will never depend on any poitician, worse stillbeing these NPP miscreants. If Tsatsu has not achieved anything at all, he has made Bawumia know that he is fallible after all since he, Bawumia , now concedes that some of the pink sheets which they claimed were examples of over voting are after all not so.

"Thank you Tsatsu, we did not discover that one case of over voting, but you did, so that increases the number of OVER VOTING" cases we presented. We told you there were over voting"

Tsatsu has caused a blunder: you don't use a damaging evidence to prove a witness is not credible. If even the judges buy the credibility argument, (which I doubt, because Tsatsu's surprise over-voting evidence proves petitioners' assertion), the argument comes back to answer the FACT that, yes there were over-voting, and that, first, the
petioners made that claim, and second, the respondents agreed that over voting happened at other places besides areas presented to the court by the petioners.

I think what Tsatsu has done is simply shooting of his own foot. NOBODY can spin around this irreversible blunder. It's certainly and simply a stupid legal move which will impact negatively on his client's case!!

Those pink sheets being proffered did not fall out of the sky, there is neither two elections in dispute. If the petitioners seriously fabricated photocopied pink sheets are admissible evidences, then respondents must likewise obtain the right to refute arguments with the original pink sheets, by way of fine tooth combing, which Mr Atuguba's opinion is unfavorable. Is Baako now a legal expert or simply appealing to his ignorance? Please allow Ghana's law to evolve. We cannot continue to imitate others forever.
When years ago a New Yorker cooked and ate, his lover, he could not be charged for eating her because it a first time occurrence, and no prior law to call to mind, the sitting Judge bluntly constated "there is no law on the books forbidding; or that states one must not eat his girl friend." You cannot rule this way in Ghana because we simply ape. Mr Baako, Tsatsu may have been out of order but retains the right to advise his learned friend to shut up if the Chief sitting judge is a jerk! In a court of law people just do not talk over others like Addison knowingly prattle! If Atuguba thinks the NPP is just going to walk away, they gave him his warning yesterday when Addison again spluttered, "WE ARE NOT GOING TO IDENTIFY ANY PINK SHEETS." That was what was not ethical, worse still Atuguba's response was you just evened the score! Are we that kind of people, or that dislocatedly decrepit?

As a friend of mine says, and as far as I am concerned, this case is a matter of, thief, thief, thief - God laughs and so who am I to take sides. In all honesty, I really dont give a damn who wins or loses the case. Our so-called law is like tossing a coin, anyway. Only the judges who have arrogated themselves to the posture of dictators, know what they are doing.

Then again, Bobo, if this legal system that is supposed to be for all of us doesnt make sense to most of us, then clearly is not a good, fair, useful or democratic law. It is an overly partisan law which has been drafted to partially favor legal technocrats, the rich and the powerful in society. The mass of the voting and tax paying public do not even as much as to how to access that law. Come on lets face it, is this helpful to our development process?

The issue of repetition does not arise because the issues themselves have been duplicated, triplicated etc by the petitioners. Every good lawyer knows what Tsatsu is doing is what is required of him even though I think that this detailed cross-examination was expected more from the EC's lawyer than Tsatsu. It has even emerged that some of the pink sheet do not have the stamp of the Commissioner of Oaths and are supposed to be expunged from the lot by the judges. The December 2012 elections took place in over 26 thousand polling stations, thus NPP came about its allegations by going through the 26 thousand and over pink sheets. Are we being told by the justices that those who voted for John Mahama do not have the right of conscience and the right to association, which are inscribed in the 1992 Constitution and International Treaties that we ratified? Thus the justices are calling on the respondents to bring to the court the wound without the person who is wounded, which has no logic. It is like presenting the figures in court without the pink sheets that are the material evidence.

If the petitioners seriously fabricated photocopied pink sheets are admissible evidences, then respondents must likewise obtain the right to refute arguments with the original pink sheets, by way of fine teeth combing. Is Baako now a legal expert or simply appealing to his ignorance? Please allow Ghana's law to evolve. We cannot continue to imitate others forever. When years ago a New Yorker cooked and ate, his lover, he could not be charged for eating her because it a first, and no previous law on the books, the sitting Judge bluntly constated "there is no law on the books forbidding; or that says one must not eat his girl friend." You cannot rule this way in Ghana because we simply ape. Mr Baako, Tsatsu may be out of order but has the right to advise his learned friend to shut up if the Chief judge is a jerk! In a court of law people just do not talk over others like Addison knowingly prattle! If Atuguba thinks the NPP is just going to walk away he had his warning yesterday. look at what is taking place at the supreme court right now. there were also massive overvoting, violations of the law that took place in polling stations that akuffo addo won yet they only see the need to seek the court to annul the results of overvoting that took place in only polling stations that mahama won. what an injustice? the scale cannot balance then. The Good Book says remove the log that is in your eye and you will see clearly to remove the speck that is in your neighbour's eye. for true justice to prevail, the court must order for all the polling stations that akuffo addo won where there was also overvoting too to be annulled. then now they can judge. but for now it is imbalance. in any case since 1992 ballot papers issued has never tallied with number of registered voters in several polling stations. that too must be looked into. NPP for reason of not allowing results to be declared was that akuffo addo votes have been reduced, and so were asked to bring evidence on that. now they have shifted to administrative errors of over voting where infact it took place also in their own strongholds. what injustice!!!!

Kwaku,I really appreciate your submission(s) anytime I Listen to you.You are good and really a blessing to Ghana.I fully agreed with you on the 'uncouth and unethical behaviour' displayed by the so-called legal luminary who has been matched on equal footing by a Lawyer he tutored- Philip Addison. What I can see and say is that the Supreme Court Judges especially its president has given unnecessary latitude to Tsatsu Tsikata to operate. He deposed in many of his rulings that the SC and for that matter the Judges and Magistrates have the right to control the mode and order of interrogation at the courts and this position is supported by section 69 of Evidence Decree of N.R.C.D 323/75. What I can not understand is that why are the Judges not invoking that section to control Tsatsu Tsikata especially when he was insulting the intelligence of his learned colleague whether he/she is his own son/daughter? If one reads the commentary to the above section quoted, sub-sections 10 and 11 the rules are clearly spelt out and I do not understand why the Judges are not INVOKING those sub-sections to control Tsikata for the country to have smooth and speedy trial. The Judges should know that they are not conducting this trial in a VACUUM.There are those who are religiously following every bit of the trial. My Honourable and respected Judges should not do anything for those of us sitting at the fence to suspect that there is a fishy deal somewhere so that their ruling will be acceptable to all and sundry.

Apparently Kweku Baako doesn't even understand what constitute bad faith in law. Producing facts in cross examination in order to test the truthfulness of the witness is permitted under the evidence law.

Wofa Kufour came back from Australia and packed the supreme court with the dead Justice Afreh and some other hirelings.

As a christian who believes in the word of God and justice, I of the conclusion that Kufour will surely face the wrath of God on this earth before he joins Afreh in the land of the ancestors.

The way and manner wofa Kufour went about that case was one of the reasons why we lost 2008 to the NDC. Kufour pet project was to show Tsatsu where power lies and he did it by sinning against God.

Mind you that Tsatsu was not accused of stealing or anything. The case was that GNPC guaranteed loan for a cocoa farm venture and when the project could not pay its debt on time, Ghana was forced to bear the cost.

This was a project that the Worldbank and the IFC (not the NPP's 419 IFC) advised to be profitable. At the time that Tsatsu was sent to jail under the under dealings of wofa Kufour, the project was doing so well, selling it off would have helped Ghana to get her money back. But Kufour being so wicked and vindictive, chose to show his enemies where power lies. Key witnesses like the Worldbank and the IFC were prevented by Kufour from testifying in favour of Tsatsu in court.

So came 2008, Ghanaians choose to punish our NPP for the wickedness and the extra judicial activities of wofa Agyekum Kufour.
