A strange part is the height of tolerance or conduct of this judicial panel over excess which transcends into abuse and ultra vires judicial privilege.

Take for example Counsel's comment about Bawumia's truthfulness and its relation to sworn oath to the Quoran to tell the truth. It is not counsel's position to pronounce to the court emphatically that a witness's testimony is in violation. That is a judge's duty yet the panel watched a continuous abuse until objection was raised.

The indicisiveness of the leading panelist over conduct and his inability to establish limits leave room for discussion in classrooms of case studies.
This is one benefit the public derives from open telecast : to see it all.

THAT I WAS ONLY COMING TO THE COURT AS "FRIEND OF COURT" TO RESPECTFULLY DRAW THE COURT ATTENTION TO SOME RELEVANT PROVISIONS OF THE GHANA 1992 CONSTITUTION PRECISELY CHAPTER 008 SECTIONS 4,5 & 6 WHICH IN EFFECT PROVIDED THAT "A SITTING PRESIDENT OF GHANA WHILE IN OFFICE IS NOT AMENABLE TO ANY COURT OF GHANA".
THAT THERE IS/WAS A CASE LAW/LEGAL PRECEDENT IN THE CASE OF "NEW PATRIOTIC PARTY VRS. PRESIDENT RAWLINGS AND ATTORNEY GENERAL" WHEN THE NPP CHALLENGED PRESIDENT RAWLINGS CONSTITUTIONAL AUTHORITY WHEN THE PRESIDENT APPOINTED THE DISTRICT CHIEF EXECUTIVES. THAT THE SUPREME COURT HELD UNANIMOUSLY THAT PRESIDENT RAWLINGS RIGHTFULLY EXERCISED H.E CONSTITUTIONAL POWER IN MAKING THE APPOINTMENTS.
THAT IT WAS IN THIS CASE WHEN THE SUPREME COURT ALSO DECIDED THE LEGAL ISSUE "WHETHER OR NOT A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN OR COULD BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT?"
THAT THE SUPREME COURT HELD OF MAJORITY 3 TO 2 THAT "A SITTING PRESIDENT OF GHANA CANNOT BE SUED OR JOINED AS DEFENDANT TO A LAWSUIT".
THAT THE FIRST PRINCIPLE OF THE RULE OF LAW PROVIDES THAT "THE SUPREMACY OF THE LAW AS ADMINISTERED BY THE ORDINARY LAW COURTS" AND IN THIS INSTANT CASE, THE SUPREME COURT OF GHANA HAS SETTLED THE LEGAL QUESTION.
THAT THE SUPREME COURT ASKED ME WHETHER I WOULD LIKE TO WITHDRAW THE MOTION FOR LEAVE AND TO ATTACH THE AFFIDAVIT TO IT AND TO COME BACK OR I WOULD RELY ON THE MOTION FOR LEAVE THAT I HAVE ALREADY ATTACHED THE RELEVANT PROVISIONS OF THE CONSTITUTION AND I TOLD THE COURT THAT I WOULD RELY ON THE MOTION FOR LEAVE AND ALL THE ATTACHMENTS.
THAT MY LEGAL STRATEGY OF CHOOSING THAT OPTION FIRSTLY WAS TO DRAW THE KIND ATTENTION TO THE RELEVANT PROVISIONS AND I HAVE DONE THAT.
SECONDLY, TO DEMONSTRATE TO THE COURT THAT ELECTIONS ARE NOT HELD ON PINK SHEETS BUT AT THE POLLING STATIONS THROUGH THE BALLOT BOX AND IF THE PETITIONERS THROUGH 2ND PETITIONER DR. BAWUMIA NOTORIOUSLY INFORMED THE COURT THROUGH CROSS-EXAMINATIONS THAT THE NPP POLLING AGENTS SIGNED THE PINK SHEETS AT THE POLLING STATIONS AND HAVE NOT ALSO MADE ANY FORMAL REPORTS OF ANY MALPRACTICES OR ANY WRONG DOINGS BUT JUST THAT THERE WERE SOME ERRORS ON THE PINK SHEETS AND HE HIMSELF COMMITTED SERIES OF THE SAME MISTAKES AND EVEN MIS-LABELLING SOME OF THE SAME POLLING STATIONS THEN WHAT IS THE RATIONALE OF THE COURT ENTERTAINING THE PETITION?
THAT THE COURT HELD THAT MY MOTION FOR LEAVE WAS PARTISAN SINCE IT WAS IN FAVOUR OF H.E.PRESIDENT JOHN DRAMANI MAHAMA AND I HAVE NOT ALSO ATTACHED A SWORN AFFIDAVIT TO THE MOTION FOR LEAVE THEREFORE THE MOTION FOR LEAVE WAS DISMISSED.
HOWEVER, I DID IMPRESS UPON THE SUPREME COURT THAT SINCE I RELIED ON THAT MOTION WITH ALL THE ATTACHMENTS IT IS/WAS IMPOSED ON THE COURT TO ACT "SUO MOTTO" THAT IS, BY THE COURT OWN VOLITION.
THEREFORE THE LEFAL PRINCIPLE HAS BEEN SET AS "IF A PREPARER OF DOCUMENTS MADE HONEST MISTAKES ON THE FACE OF THE DOCUMENTS IS IT FOR THE COURT TO CURE SUCH DEFECTS OR TO REMAND THE DOCUMENTS BACK TO THE MAKER OR PREPARER TO CURE THE DEFECTS OR TO DISMISS THE CASE IN ITS ENTIRETY?"
IN FACT, THESE ARE THE ISSUES FOR THE DETERMINATION OF THE SUPREME COURT.
IT IS THEREFORE NOT SURPRISING THAT ALL THE COUNSELS FOR BOTH PETITIONERS AND RESPONDENTS OBJECTED TO THE MOTION
HOWEVER, WHEN H.E.PRESIDENT OF GHANA WAS DRAGGED TO COURT BY THE PETITIONERS NONE OF THEM RAISED A PRELIMINARY OBJECTIONS.
THAT GOOD LAWYERS STRONGEST ARSENAL IS LEGAL RESEARCH.

The number of cases count for nothing judging by the "connections" nature of the judiciary and the legal system in Ghana. The only certainty about Akuffo Addo is that his father was Edward Akuffo Addo. Apart from that his provenance appears either dubious or questionable.

His exit from Oxford. Was it for gross insubordination, substance abuse or intellectual failure? His qualification from Legon is sometimes a BSc and at other times a Masters degree, making him a post graduate "scholar".

He was "specially" called to the Middle Temple with a citation which referred to his father. The reason his certificate is missing is because he wasn't given one. Certificates are given to those who pass the requisite exams and pupillage. In his case there was nothing of merit except his father's reputation to rely on. Hence he could not practise law in the UK but had to go France to work for a Financial Company now defunct.

His name was inserted into the Roll of the Ghana Bar Association following a meeting at the Supreme Court. His certificate is missing because he wasn't issued with one. He was not enrolled and did not pass any entry assessment.

Much of his brilliance has been when he was high on dope and bluffing his way with sheer pomposity and arrogance.

Kuffour demoted him from Attorney General to Foreign Minister. You don't step down from being the legal brains of a government to become a junketing foreign minister when we are not a global or regional player. He is not recognized as an accomplished statesman on the African scene hence no body has called upon him to resolve any crisis. As a matter of fact he is an embodiment of crisis.

The NPP Communication Team will do well to shut up and start looking for a reputable leader.

I admire Mr. Tstsu Tsikata. I admire him , first, he is a Ghanaian. I admire him, second, he is/was a very intelligent University Lecturer in Law at the University, especially, Ghana.

Unfortunately, I do not admire him in his cross examination of Dr. Mahamoudou Bawumia. He appeared bored!

He made the whole exercise bored!He does not appear interesting! the only humour he ever created is the word he muttered 'bgablagya'

He has been repeating the same five questions in all the many pink sheet exhibits that he presented before the Supreme Court: He bores me! He yells at Dr. Bawumia, he braggs and intimidates Dr. Bawumia for mis-using the 'legal' word, and he tries to bully.

The ultimate goal for these repetitive questions was to prove to the court that there were 'Human errors' on the part of the petitioners and as such if the Electoral Commission made those 'human Errors', that should not be taken as sufficient grounds to annul the results of the Elections.

Good! Fair Enough!

Mr.Tsatsu Tsikata should had directly represented the Electoral Commission and Not the NDC, although I am aware that the counsels for the respondents are 'joined and one'.

The question I am pondering over is;

Yes, 'Human Errors'! 'Human Errors' from both parties. What about the other allegations in the petition?

My suggestion to the Learned Supreme Court Judges is that:

ONLY A RE-RUN OF THE PRESIDENTIAL ELECTIONS WOULD BRING PEACE IN GHANA and I repeat,

No amount of oratory, No amount of acquiescence from both parties can bring about ETERNAL PEACE IN GHANA.

It is ONLY,

A RE-RUN OF THE PRESIDENTIAL ELECTIONS THAT WOULD BRING PEACE AND TRANQUILITY IN MOTHER GAHANA.

Ghanaians should not bother about the cost of the re-run of the Presidential elections!

Ghana would be able to pay for the cost when there is PEACE.

Ghana cannot pay for the cost of 'LOST LIves' when there is WAR!

and whether there is going to be PEACE or WAR in Ghana, depends on the SUPREM COURT, and the ONLY WAY out of this,is a RE-RUN OF THE PRESIDENTIAL ELECTIONS!

'A STITCH IN TIME SAVES NINE'!

'A WORD TO THE WISE IS ENOUGH'!

'FORE-WARNED IS FORE-ARMED'!

What is the ROLE of Polling Agents that is mentioned in the CONSTITUTION? These are some of the issues to be determined! But one thing is clear: the number of Pinksheets that petitioners brought b4 the SC is less than the number they swore in their affidavit. How can analysis of 8000+ data give a result that is based 11,138 pinksheets? There is something FUNDAMENTALLY wrong with the DATA analysed and the results of the analysis! Well, we shall see later!

All he says is if a pink sheets shows even a single so called irregularity ( one over vote ) then the entire votes cast at that polling specification should be annulled. That is not analysis, that seems more like wishful thinking.

Prior to submitting their evidence to the Court, they posed in photographs of what they said said was a mountain of evidence which has now been padded with duplicates, triplicates and quadruplicates.

What he is reluctant to admit is that in his so called analysis, if a pink sheet had two blemishes it was duplicated, if it had three blemishes they presented 3 copies as evidence and so on.

The statements made at the press conference about mountain or mountains of evidence and presented to the court and the respondents can be construed as wanting to deceive the court. It is the privilege of the respondent's counsel to slowly rubbish the padded evidence. Cross examination need not be gladiatorial or hurried like Mr Addison's style. It is a matter of repeating the point on every piece of document submitted as evidence so that the message sinks into the subconscious mind of the listeners.

Mr Tsikata's job is not to entertain observers as Judge Atuguba is wont to do but to make sure it is recorded for posterity by the court records that the NPP submitted bogus evidence.

Throughout their cross-examination of Dr. Bawumia, (both Tony Lithur and Tsastu Tsikata), it has become clear that he's stood his grounds point out what went wrong. No matter how hard they try to discredit his testimony, the man has been able to tell the court and the whole world that indeed the EC committed lots of unpardonable errors and irregularities, esp. over-voting, pink sheet errors ect. They don't have anything else to question him about, because the man is talking facts; he's not making any funny assertions. The evidence is there---it is clear and simple!

The real drama is yet to unfold; we're yet to hear from the mouth of the "Dark Horse" when he mounts the dock, probably mid-next week. Afari-Gyan has lots of questions to answer. He must tell Ghanaians why he made that bogus declaration whne one of his own deputies had said that the election results would be delayed for 72hrs, until all disputes have been resolved.

Folks should just consider the so-called diasporan voters list. That alone is huge dent or damage on EC. Afari-Gyan and every culprit in this case must fact the music. He should be marched to Nsawam to to be crowned as a high-profile resident.

Meanwhile, the issue is not about whether Nana Akufo-Addo is popular or Tsatsu Tsikata; we're eagerly seeking justice in the December elections. It's about the laws of Ghana; it's about time Ghanaians sought to ask for, or demand what is just and what is right! Our electoral laws must be taken seriously and we must abide to them.

We hope the Supreme Court would have the courage and wisdom to rule on the election fraud case, without bias. We pray the God will give them the wisdom to do just that.

No-one is above the laws of the land and that must succinctly be clear to all Ghanaians. That's the law!

Then he had another First Class at Oxford University in his LLM or Masters degree. Nana Addo had a Third Class in Economics from the University of Ghana. Nana Claims he is a lawyer but up till now Nana cannot tell us where he did his law studies. Secondary Nana cannot remember any of his classmates at the Law School, then lastly Nana is refusing to produce a duplicate Law certificate if the original certificate is missing. So how can a certificateless Lawyer, a Fake lawyer and a CRIMINAL in the Person of Nana make a first Class degree Student popular. Tsatsu has a law certificate so did he need the help of Nana, to Show him how you can call yourself a lawyre or a Doctor even when you do not have the proper training and qualifications.

Folks, the NPP and its shallow minded legal team has finally fallen into Tsatsu's trap. when lawyer Amedzeku filled his applications before the supreme court, NPP counsel lawyer Addison was first to raised objects for its dismissal on the grounds that he has not sworn proper affidavitt in support of his application. As a result his objection was upheld and lawyer Amedzeku's application was dismissed. Now most of the evidences and exhibits NPP submitted to the supreme court are duplications,triplications and quadruplications without commissioner of oath approved stamps thus not properly sworn with affidavit in support. QUESTION:Do you think the supreme court in its own wisdom would overlook these same loop holes in lawyer Amedzeku's application which is the same as that of NPP and rule in their favour?.

I would like to see Nana challenging Tsatsu Tsikata, Tony Lithur and James Quarshie-Idun. Phillip Addison must make the tactical decision to put Nana in the witness box without delay to cut off Tsikata from wasting time on pink sheets cross-examination.
