Election Petition: Court throws out EC request

The Supreme Court has thrown out a plea by the Electoral Commission (EC) to vary the Court’s orders in a petition challenging the legitimacy of President Mahama.

The EC, through a motion on notice filed by solicitors, Lynes Quashie-Idun and Co, pleaded the court to vary its April 2, 2013 order which directed respondents in the petition to file their written affidavits within five days from the service of the petitioners’ affidavits on them.

The EC prayed the court to review its order by directing it to file its written response “within five days from the close of the petitioners’ case”.

The hearing of the substantive case begins on April 16. However, the Court unanimously threw out the case on Wednesday April 10, 2013.
