Ghanaians are not better than the people of Kenya. its about a good way of appling good priciples. that is why we have some thing call amendments of constitutions. If your laws are old, antiquated, I believe you have to repell it. That is what it is. We don't vaue the principles of continuous improvement, timeliness, strategic thinking, and good managerial principles and practices. Instead we are mired in the old non-funmctional colonial and old-fashioned practices.
The constitition was written under the supervision and in consideration of the PNDC in mind hence most of the elected members of the committees were pro-NDC hence they failed to think beyond implementing processes that will hold the PNDC accountable for it atrocities, hence the blatant inclusion/exclusion of principles such as timeliness and timeframes and othe blatant omissions.
Based on your observations it is clear that Ghana is miles behind Kenya in these issues.

Please pause and take time off your tight schedule and ask any old pal the history surrounding the writing of the 1992 Fourth Republican Constitution. Be informed the elite, Lawyers, Doctors, Economist etc. who now parade themselves as democratics boycotted it outright. Is this election petition going to take years to resolve just like all other cases in the Law Courts of Ghana? I wonder: which nerd decided and wrote in the 1992 Constitution that when there was a dispute in a Presidential election (post PNDC), the disputed winner should be sworn in before the matter is settled? At this rate, John Dramani Mahama would have completed the term of four years or be far gone within that term before the so-called Justices of the Supreme Court of Ghana even begins to hear this election petition. Guess what, at that time (if it came to that), a new election cycle would have begun! Don't they say that "justice must not only be done, but seen to be done?"

The country unfortunately has been taken over by illiterate and semi-illiterates who do not see the wisdom in intellectual capacity as a tool for advancing our social and economic well being as a people. Just read through the comments that people will give to this article and you will see that we are a country busily going nowhere as long as any inteligent person is seen as an enemy. Just have a look at the calibre of people this government has appointed into ministerial positions and you will understand what I mean. But we will not relent, let us keep speaking up against incompetency and mediocrity and hopefully we may be able to educate some of our people to think straight.

Stop blaming IT or human error or rigging its the 1992 contitution which failef ghanaians. How many days can we vote, when can declare a victor, how long should the supreme
court take, and what happen after that.
These question and their answas are what the contitution dont have. We can pass the blame from office to office petson to person, but the trust is the 1992 drafted contitution is not made for purpose.
The supreme court in ghana can take as long as they like and nothing can force them to do it early. Half contitution is not good for ghana.
If you move back to ghana, dont you think you can help ghana.
Kenya has his contitution in place tell all his people to follow it, it took Kenya EC 5 days before to get the winner, it took ghana EC 48 hours, their supreme has a fix time to come out with the winner, ghana doesnt have.
John Mahama believe the elections were rigged and he cant put any pressure on the supreme court. The supreme court judges wants to be known as nobody really know them and what they do. To be popular they milk it for maybe 4 years before anything will ever get to them.
Supreme court is following the half drafted contitution which is making ghana democracy a mockery.
Biametric machines failed in kenya too, ghana has to wait for a very long time to catch up in democracy.

This shows they did not want the case settled with any urgency. And on top of that they expanded the scope after how long? There is no urgency. The majority of the SC Judges are NPP Administration appointees, not to mention the Chief Justice herself. Do we think these judges are less concerned about the image of the Judicial System than we are? Give them a break. I am sure they take their oaths seriously.

It took the petitioners almost 21 days (albeit constitutional) to file their case and this was after writing to Registrar of the court to find out whether the courts will be opened for duty on Dec 28. (talk about urgency on the part of the petitioners). After the CJ empanelled justices for the hearing of the case, who delayed the proceedings by raising objections to the composition of the panel of the justices(again very legal and constitutional for that matter) So if Lawyer Essuman is trying to suggest that the Supreme Court's duty at this point is not to determine or interprete the constitution, then I will leave it to readers to judge the hypocrisy or otherwise of the statement. The petitioners, in their petition to the SC SPECIFICALL prayed the court to invalidate results from some 11,000 polling stations claiming various levels of "irregularities" and don't forget this was done (amended) as "expeditiously" as in end of January/ February. I could go on and on about how urgently the petitioners have treated the case and equally bring up instances of stalling on the part of the respondents... SO, LAWYER ESSUMAN QUIT BLAMING THE SC JUSTICES, QUIT USING THEM AS EASY PREYS FOR YOUR PROPANDA. Of course you are a "Learned One", so it is easy for you to attack the Justices in court of public opinion, knowing very well that these Honorables Justices will neither SHOW UP nor PUT UP A DEFENSE in such court. Your article would have better served your readers if you were fair to criticize the actions of BOTH petitioners and respondents, and offer suggestions as to how to deal with such perceived 'delay tactics"

As for me, I believe in our justice system and I'm very sure that very soon, our Noble Justices at the Supreme Court will make a sound ruling on the Election Fraud case that's been laid before them. I'm guessing that that by the end of May, Ghanaians would be shouting, singing and dancing with joy. I'm keeping my cards to my chest as the Noble Justices. Very soon, we'll see the full length of the "Dead Toad" by the river side.

The judges are corrupt and are siding with the government by dragging out the case. It is a simple case. Check the registered votes and compare them with the figures which were declared by the Electoral Commission. It is embarassing that our Supreme Court has not been able to decide the case within the timeframe dicatated by the constitutioin. The Chief Justice, Georgina Wood, is a disgrace and is not qualified for the post. She has to be firm and instruct the judges to give their decision within a certain timeframe.

The reason why the kenyan case was disposed of quickly was partly because the opposition petioned with their evidence immediatly the result were declared whereas in ghana it took the opposition almost three weeks to file their petition without submitting any evidence and even when the they were asked to provide evidence the objected until the SC overuled their objection. In Ghana they opposition have used other tricks such as objecting to some SC judges etc. to delay the process while accusing the the SC and the NDC of delaying the process.

Nana Addo lost the elections the same way he did in 2008 under Kuffour's administration.Nana Addo and NPP are just fooling their poor supporters.You cannot lose parliamentary elections and tell me you have won the presidential one the same day,this is incredible.In 2008,Nana Addo went to court a to strangle the EC from declaring Prof.Mills the winner.Finally,out of shame,NPP boycotted the Tain run off to register their anger against the EC.Since 2008,NPP has always disagreed with the EC and found ways to discredit it.After the 2008 general elections,the NPP tried to find out the reasons for their defeat.They quickly found out that if they really want to recapture power then they should better win the majority seats in parliament first.Unfortunately,they have repeated the same mistakes and lost the parliamentary again with huge margin in 2012.Instead of the leadership to concede defeat,they have rather taken the path of vicious propaganda against the EC and NDC.Today,Kuffour is not in power so Nana Addo has quickly taken refuge in the SC and his party has started attacking and dictating to the Supreme Court trying to discredit it and declaring Nana Addo as president in advance.Why? Did Nana Addo & Co not tell the whole world that their petition was 'an-open-and-shut'case based on a "mountain of evidence",that was going to be resolved on the basis of 'simple arithmetic'?
Curiously,the outright "stealing" of votes for John Mahama has turned into a situation where "irregularities", actively condoned by the EC,did not allow the NPP presidential hopeful to match his NDC counterpart;and thus close to 5 million votes, properly cast,and in full view of Ghanaians and outside observers, should be disallowed.
No wonder this country is stuck in a quicksand!

There couldn't have been any better article than this. The difficulty most silent Ghanaians have on the election dispute concerns the slow pace of the court proceedings.
There are those who sees it as an opportunity to stifle the process. The first and second respondents, and the NDC Party are of the view that they can frustrate the process through unnecessary feet dragging.
The author of the article brought to the fore basic issues that as a country we did not address our minds to, when the Constitution was written which exposes us to our lack of foresight. The article sought to highlight the shortfalls which any critical mind will appreciate.
The issues raised are really important and needs attention. We have to serious weigh the advantages of having the proceedings telecast to avert any doubt at the end of the trial. I believe it will go a long way to educate the citizens of how each party to the dispute put up its defense.
It is really ridiculous and unbelievable that those who claim to have won the elections with clear majority are the ones frustrating the process.
The dispute before the Supreme Court is about the country and not about Nana Addo or John Mahama. Those making irrational comments with regards to the article and their derogatory insults are blind in the minds and intellect. What the NDC and its supporters must understand is that being acidic with their tongues do not change the truth. They must learn to read and understand than being obsessed with hate and vindictiveness. They can hate Nana Addo to the marrow it will changed the truth.
I will hazard an advice to ourselves, whenever you find yourself on the side of the majority, it is time to pause and reflect. Think little minds!

Simply, Kenya's system is better because of their history - experience. We have probably tried to immitate others since we've never experienced the contest of an election in court. Certainly, when this is over, we can reflect on the process and together with our experiences amend our laws to improve the system. No law is perfect; they all keep changing based on the 3 methods you outlined. Certainly, God forbid, but the next election dispute in court will not be handled in the same manner. The fundamental difference between Kenya and Ghan which the author himself acknowledged is that they have gone through this process before and over 1200 lives were lost. Fortunately for Ghana, this is the first one and no life has been lost. Who is better?

So I certainly know what I am talking about. Have you been to Kenya, or perchance you saw pictures of Kibera, or half-naked kids being swarmed by flies? and that has colored your view of the truth? From all indications, the outcomes of legal proceedings have far reaching consequences that is why the need to "prove beyond all reasonable doubts" becomes a cornerstone of such encounters.
Debates are talk-shops out of which nothing often materializes after the hot air dissipates so speakers are allotted specific limits to talk but such is not the case with a litigation which has consequences for one of the protagonists thereafter so is this approach not defeating the end of justice? Even though the comment of George Oraro, the lead counsel for Raila Odinga may at face value be taken on its lighter side, that it is a loaded statement and cannot be disputed. Stretching imaginations a bit, is there no possibility that his observations and others can be orchestrated by the Odinga camp as underscoring their loss-supposing they lose-in the final analysis?
I have not lost sight of the need for expediency however if they are out to resolve such a landmark case taking cognizance of their past violent post election incidents, why leave anything to chance.
Changing with time is good, but change should not occur just for the sake of "keeping up with the Jones". Then it becomes cosmetic. My Akan is not a bit rusty after years of inactivity but I can still remember what we were always told " Ye dia wohu be tor wu, enye dia obi be kanfo wu"

And, of course, the drafters of our constitution should have anticipated this and set a definite deadline for determining any dispute arising from elections before the new President is sworn in. Indeed, Ghana is not Kenya but it a shame for the country.

To start with your conclusion, I wish to affirm that Ghana is definitely NOT Kenya. Is Ghana behind Kenya? That depends on what the constitutions of the two countries state with reference to electoral disputes. You are a Lawyer, an Attorney, a Barrister, and a Solicitor at the Supreme Court of Ghana, and as such, must understand better than a lay man the implications of a constitution when it comes to interpreting it and using it as a basis for determining an electoral dispute. I won’t write much, so I rush responses through your points:
1. Kenya Understands the Stakes, Ghana does not
That is a false assertion! This demonstrates a total lack of knowledge of Ghana’s constitutional provisions as regards disputes concerning Presidential elections. You assume that the Justices do not seem to appreciate what is before them is unfair to them. Those Justices are supposed to operate with some set down rules – the constitution and CI 74 – which is what they are honestly applying. What you are suggesting is that they side-stepped the provisions of the law to fast-track the case.
2. Technology: Yes, the Danquah Institute requested that proceedings be transmitted. And this was refused. No Law in Ghana requires that proceedings in any court of law, and the Supreme Court in this case, be transmitted live. It is left to the Justices to decide whether or not to do the live transmission and they rejected the idea. The court is an independent body and has the right to decide how hearings are to be made. Did the any of the parties in the dispute officially apply for the transmission of proceedings? No.
Will you say proceedings of the 2000 Florida Case at the US Supreme Court were transmitted live? No. Does that make Kenya a more advanced case than the US case? No.
In principle, no Ghanaian is denied the right of following the case as press personnel and representatives of the parties to the case are allowed entrance. In the court room nobody is gagged, blindfolded, nor has the ears plugged, so as to prevent them from listening to, seeing or hearing proceedings.
Live transmission or not is therefore not a determining factor in the final speedy determination of the case.
3. President of the Court
Similarly, having the Chief Justice of the Supreme Court as the President of the court is no guarantee to the speedy resolution of the case, nor does it guarantee that the case will be fairly dealt with.
4. The Conduct of the Lawyers Involved.
You dealt with this issue as if there is a special favour by the court towards the lawyers of the respondents. This is not fair to the Justices. As I said elsewhere, you are a lawyer and a solicitor of the Supreme Court, and as such must be conversant with the rules of the court and the provisions of the constitution. Any apparent delay (intentional or not) by any member of the legal team, if illegal, will definitely be dealt with by the Justices. The fact that a lawyer decides to exhaust all the time allotted him/her to respond to a requirement does not mean a favour from the court. In this game all parties are guilty of exhausting the legal time-frames.
5. Strict Deadlines.
The Justices of the courts are not to be blamed for the apparent lack of a deadline in dealing with this petition. The law (Constitution and CI 74) did not stipulate any deadline. The drafters of both might not have foreseen this ‘anomaly’ but the same applies to YOU and many a learned persons in the country. There is therefore no need to accuse the Court of not having deadlines.
Right now, we have a case on hand that we must work to resolve. We have seen some loopholes, in the constitution and CI 74, that we can look into the future to plug. And that is the contribution of the current generation (that includes you and I) to future generations.
Ghana, as you rightly said, is NOT Kenya, but that does not mean they are better than us. By the way, was the dispute in Kenya about some 4,000 polling station results that ended up 30 days later in nearly 12,000 polling station results? When making comparisons we must put the issues in the proper limelight.

You have set out to present a situation where election petitions can be brought to the SC for intepretation and there are no provisions as to the timeframe within which the issues brought up, can be determined. It's just insane. Secondly, there's no provision as to whether to delay the announcement of the winner, pending issues of an electoral petition, by the EC, but then go with the constitutional requirement of announcing the winner after is it 24-48hours after an election. That again frustrates the courts,petitioners and respondents, and leave room for sine die situations. There's the need to revisit these provisions and amend them, to take cognisance of all these factors and make it work, for the peace of the country, for the smooth running of government and for the development of the country. Such provisions in the constitution and the CI74, creates a hanged situation and needs to be addressed. We need to set clear timelines and work towards deadlines, which is something absolutely alien to our culture and way of life.

....the gate-keeper concept of "accreditation" is rightly, an abomination against citizenship. It should stop immediately.
However, we do not believe that citizens ought to be allowed mobile phones, computers, etc., into those types of hearings. Leave the darn tools outside the courtroom/in your car/at home, etc.
Further, there is no distance between Chief Justice Woods and the long delay subject of the complaints. After all, she is the head of the body. Leaders ought to set expectations/goals/timelines, etc., for their subordinates. Therefore, if the case has dragged on and on, we cannot absolve the Chief Justice of the failure and blame.
READ: "...Unfortunately, the Supreme Court has played a role in allowing this delay to go on by not adhering strictly to the CI 74..."
OUR COMMENT: At the feet of the Chief Justice of Ghana.

Nana Addo lost the elections alright but wants to be the NPP's flagbearer for 2016.NPP must go back to the 2008 postmorthem,they will see that they have committed the same errors if no more.In 2008,they lost the majority seats in parliament even under the administration of Kuffour.In 2012,they could not reach any new strategy to recapture power.I saw it coming and made many comments on it that the campaign strategy was not going to fly.Nana Addo used the same ineffective strategy by thinking Ghanaians wanted everything free thus his emphasis on Free SHS.It did not work for him in 2008 so why should it work in 2012?On the political front,Nana Addo does not want to use Kuffour's strategy by trading horses with the smaller parties.This is the only effective strategy NPP can use to RECAPCAPTURE POWER like Kuffour did in 2000 General Elections.As for now,Nana Addo is just campaigning to lead the party in 2016,he knows the SC will not overturn the declared results,his propaganda is geared at seeking public sympathy.Thank you all.

Ghanaians seem to delude themselves that the 1950s Ghana is still the Ghana of today. If you really want to know how far ahead Kenya is compared to Ghana, take a trip on Kenya Airways to Nairobi and just look around while you are there. Visit Nakuru, Mombasa and a few international tourist sites. Check the road infrastructure. Oh by the way, Kenya has a better record on the provision of electricity and water to her people. Go figure! I cry for my country Ghana for the ineptitude and incompetence of her leaders!
