Kwesi Pratt is the most dangerous Journalist Ghana had ever have, he had the gut to recommend his fellow journalists to be executed by PNDC. Why some us bashing this man's integrity and calling him all sorts of names. He admitted to this error when the parties raised the question before and after the election. That's why NPP used that opportunity to ask the court to direct him to provide such information. we need to follow the case instead of insulting our leaders.
First of all the question was raised about over registered and the explanation was given to all the parties representatives which is the error of 127,210 and they all agreed, that was before the election. When the EC responded to the petitioners claim he once again stated the same error of 127,210 so now we all know where that error's from. Now out of 705 registered abroad, only 55 came home to vote. The rest of them did not come home to vote since no voting took place outside of Ghana.
Secondary, 11m voted out of 14,031,680 so where is the over voting that NPP and others claiming? If NPP wins this case,it would be ashamed that only 6m voters chose a president out of 26m people and also someone would have to explain to Ghanaians, how 4m plus people who wasted their time and energy to vote and it did not count even though they have right to vote.
Instead of NPP asking for a re-run,they are asking for Nana to swear-in as a president of the whole country while they want half of the country's votes to be thrown out.

There was every indication that Afari Gyan was very determined to rig the ill-fated elections. Here are a few earlier clues that the elections was going to be rigged.

1. NDC deliberately delayed funding of the mid-term local elections in 2010 which resulted in their favour but the EC apologized to Ghanaians on their behalf.

2. The EC gave a lot of resistance to the Biometric Registration System, supported by Asiedu Nketia and the NDC because they were afraid of it's precision. Okuraseni Asiedu Nketiah argued that the Bio machines cannot work in villages without electricity.

3. The EC and the NDC argued heavily to reject the VERIFICATION MACHINES for the Electoral Register.

4. The EC and the NDC decided to recruit prisoners by force to register but ignored foreign Ghanaians' request to vote.

5. The NDC deliberately delayed the last census results for over 18 months to help the EC create constituencies at the last minute.

6. The EC deliberately met the NDC party alone several times to teach them how they can rig the Bio System. They explained this as being normal.

7. The NDC connived with the EC to disqualify Nana Konadu and her party, whom they fear will split the NDC votes into 2.

8. The NDC heavily registered foreigners who were brought from Cote D'Ivoire, Bourkina and Togo through Brong Ahafo, the Volta and Upper Regions. Some of the recruits confessed on You Tube holding their Ghana Voter's Cards and their Bourkinabe ID's.

9. The NDC were allowed by the police to intimidate and brutalize their opponents as happened in Odododiodoo and the shooting of a school kid in Ashanti Region as well as the attempt on NPP's Manhyia MP Opoku Prempeh.

10. The EC deliberately created 45 created 45 constituencies in opposition to other parties' protest just 6 weeks into the Elections while informing the NDC months before to get prepared.

Afari Gyan is a daylight robber. The old crook deserve to be jailed.

From day one I warned that this EC is nothing but guttered elements of fraudulence. The haste in establishing 45 new constituencies, the unflinching support by the rubber-stamp NDC legislative body over all decisions and the Supreme court's favourable but unwitty rulings in all litigations before elections raised good eyebrows. It was clear to te thinking mind that the three institutions were setting the nation at a perilous course. The Presbyterian Church could rightly foresee this problem and warned against it. Civil concerns were raised at all levels of citizenry to no avail. My question is : did the EC actually think, as intelligent as Ghanaians are, they could push anything down our throats to swallow without first examining it ?

It is very disturbing that they have set this nation to low standards of perception. We in Ghana are forced to bow down heads in disgrace. Our coverted institution which has gained center gaze of all nations is now besmeared by this act of ignominy.
What is the next step ? That is even harder because posterity will find it hard to understand the ignorance and greed behind it all. Our future must be spelled and engraved with a pledge not to let our conscience downplay the importance of our nation over personal greed and satisfaction.

When the NPP disputed the declaration by Dr Afari Gyan that John D Mahama had won the December 2012 elections, his (Afari Gyan's) response was short, 'you can challenge the declaration in court, if you so wish'. He was fooling himself because he thought that pressure would be made to bear on Nana Akufo Addo to concede eventually.

Mahama's strategy was to call for congratulatory messages from foreign governments and in so doing, he thought that his legitimacy would be recognised and that would make the petitioners fail in their bid to get the elections results, annuled.

Least did they think that Nana Akufo Addo and the NPP were determined to lodge their petition at the Supreme Court to get the elections results annulled.

After the petition had been lodged, in their folly, Afari Gyan and Mahama thought that they could give any stupid reponse to the petition - especially on the petitioners' allegation that the EC and the NDC conspired to rig the elections for Mahama.

Our elders (including myself) always say that 'every thief is a liar'. Dr Afari Gyan and the NDC have now indirectly confessed to Ghanaians that they stole the elections and lied about it to the Supreme Court (through the answer they gave to the petitioners). Now their 'bottom' have been exposed.

Can Dr Afari Gyan and his Electoral Commission crooks stand before the nine wise judges of the Supreme Court and tell the Ananse story they are now telling Ghanaians that the 241000 votes 'shrinked' to only 705?

If I were the lawyer for the EC, I would not waste my time on the matter any more because I would be representing liars. I would also advise Afari Gyan and John Dramani Mahama that the game is lost - they should all quit dishonourably after admitting that they stole the verdict of Ghanaians on the 7th and 8th December 2012.

The NPP - represented by Nana Akufo Addo, Dr Bawumia and Jake Obetsebi Lamptey are praying the Supreme Court to annul all election results of any polling station where more voters voted than the actual ballot papers issued out. All the presidential candidates will be affected including Nana Akufo Addo if the Supreme Court accepts the petitioners' call.

Remember that the 'foreign voters' issue could just be one of many tricks the EC and perhaps the NDC played to swing the elections in favour of Mahama.

I think you need some lessons on simple calculus. The total registered voters affect only Vote turn out percentage and nothing else. There is no way this error affected the fortune of any of the candidates.

My friend you must understand the issue at stake. Even the NPP in the rush to file their petition made a genuine error in their arithmetic and were allowed by the SC to correct it. This is inconsequential, that is to say it has no bearing on the case. What all parties got at each polling station is what was used to compute, the total number of votes reported could be wrong, yet the true scores of the parties still stand. Now that the EC has stated that only 700 or so people registered abroad, where did the NPP get their figure of 241,000? Issues must not be confused. A Court ruled and ordered the SC to do a further registration of people for various reasons who were not captured in the first one. I remember Akuse District, and one other District in Upper East (Builsa or so). These could not be and were not included in the original register. NPP needs to sort out themselves properly with all these figures before they are floored in Court,which is what the EC is waiting patiently to do. If there is any "genuine" error on the part of the NPP in their petition such as the EC has done, they should be humble enough to accept it and avoid an imminent embarassment in court.

First and foremost i respect your views because its your opinion and this is a free country however in my view the Petitioners amendment was to add to the evidence and not to discount or remove evidence already submitted.i can understand your passion to be partisan but i wish you could be like me who does not care who wins the case but rather get rid of thieves, thugs, sycophants, charlatans ans square peg in round holes be they NPP or NDC. This country deserve decent public servants who genuinely seek to build this country on a stronger foundation. i believe you are one of the decent ones. Take care

You can verify this from Akomea. They were permitted by the SC to rectify those inconsequential errors just as the EC. That is my reason for saying they were too much in a rush.

I agree with you fully that the initial petition of the NPP was full of arithmetical errors or "genuine errors", these were inconsequential which is why the SC allowed them to correct them. They were also corrected to reflect in the amended motion. The corrections were made at the time of the amendment, and does not in anyway affect the merit of the petition, even though they could have been avoided but for lack of due deligence. My point here is, even if the NPP who are seeking to point out the short comings of the EC could make "genuine" but inconsequential errors in their petition, how different is this from the error made by the EC in picking a different figure to use as the total vote cast in as far as the number of votes for each candidate never changed? To err is human. This cannot and did not alter the votes obtained by any of the candidates, so the EC can equally be permitted by the SC to change the total number of votes cast. But for the petition, they did not need any body's permission to do this as part of their final review and reconciliation procedures. This simple reasoning I am afraid is what is proving very difficult for some people to understand and they result to insulting Afari Gyan.

I really want to know if he knows the ramifications of what he is agreeing to:

He ought to know our institutions are not strong and cannot stand pressure.

Will there be a caretaker government or he abides as soon as the supreme court decides. If he leaves, he vice goes with me. So also are his appointments.

Will the election be nullified and a new one ordered? Or will it be given to the shortie? If not, will there be a caretaker government, supervised by who?

There are so many grey areas here, and the unintended consequences are many.

The State you reside, Al Franken stole the election, what happened? He was allowed to keep it because the people would rather wait for another election than plunge into anything they don't know how the end will be.

Anyway the Okyenhene together with the NPP are afraid Mahama and the NDC would do a DR Busia on them. Once upon a time, Dr Busia then an (N)PP Prime Minister openly defied orders from the supreme court to restore a workor he had maliciously and capriciously dismissed. Busia declared: "NO COURT, NO COURT" had authority to direct him to do such. The rest is history, but alas it has come back to haunt the NPP. They are afraid of the shadow of Busia in the present case.

The NDC weak minds this is very simple. In order to cheat in this election you had to make sure that most of the people who registered to vote do not actually turn out to vote then you can "vote" on their behalf in the backroom. By the EC inflating the turnout numbers of registered voters, they can easily manipulate the numbers to say that 14million voted when in actual fact 10million voted.

So I am not surprised that the EC stated that there are over 200,000 foreign registered voters when in actual fact it was only 750.

If I am a registered voter but did not show up to vote on Election Day how would I know that someone else did not use my name to vote? The truth is that there is no way I can verify this. This was the flaw in the 2012 elections. The NPP knows it and that is why the biometric machines in some areas were stopped from working. The only way this election would have worked flawlessly was if the machines worked 100% without any interference.

Someone used your name to vote but you have no clue they did. NPP says the can prove that such backroom voting occurred so let us wait and see. Now EC is saying that we should throw away over 200,000 votes because they did not vote but were just registered voters. Do you really believe that?

There are bound to be rejected votes. So TURN-OUT PERCENTAGE is always lower than actual votecount. So Registered voters < Turnout < Actual Votes Counted. Now look at the figures and draw a smart, unbiased conclusion.

The point is that the latter was just a mistaken number that was picked when calculating the voter turn out. THERE IS NO EXISTING REGISTERED VOTERS LIST OF 14,158,890. So there was nothing like 127,210 potential voters during the past election!! THE DIFFERENCE OF 127,210 IS NOT VOTES CAST BUT AN ERRONEOUS FIGURE!

MAY BE THE HUGE NUMBERS CHALLENGES YOUR LITTLE ARITHMETIC ABILITY SO LET ME HELP YOU.

IF 15 STUDENTS IN CLASS SIX ARE VOTING TO ELECT A CLASS PREFECT AND ONLY 10 TURNED UP TO VOTE - 6 FOR AMA AND 4 FOR KOFI. CLEARLY AMA WON BY SECURING 60% (6/10 X 100%) AND KOFI GOT 40% (4/10 x 100%). THIS WAS EXACTLY WHAT THE EC DID. NOW IN CALCULATING THE VOTER TURN-OUT, IT BECOMES 75% (10/15 X 100%). HOWEVER, IF I MADE A MISTAKE AND PICK 20 AS THE REGISTERED VOTERS FROM NO WHERE (INSTEAD OF THE 15 THAT SHOULD HAVE BEEN USED), THEN IT BECOMES 50% (10/20 X 100%). THE ERROR AFFECTS ONLY VOTER TURN-OUT AND NOT ACTUAL VOTE CAST.

THIS WAS WHAT HAPPENED IN THE EC CASE. WHEN THEY SAID THE ERROR RATHER AFFECTED THE VOTER TURNOUT BY INCREASING IT TO 80.15 PERCENT (75% IN EXAMPLE ABOVE)-CORRECT TURN-OUT FROM 79.43 PERCENT (50% IN EXAMPLE ABOVE) THE WRONGLY CALCULATED.

Thumb prints on voting sheets are used to declare the winner.Nana Akufo Addo told his so called followers that they had detected 'massive fraud' in the declaration of results. When they filed the petition at the Supreme Court, they initially used the words 'Gross Irregularities'. When they amended the petition they dropped the 'gross' remaining 'irregularities'. I have earlier said that elections are declared based on number of votes cast, and not the so called 'technicalities' that they are trying to import into our voting system. Just listen to Nana Akufo Addo: Total number of votes cast at a particular constituency was 800,000 analysed as follows : John Mahama, 600,000;Nana Akufo Addo, 150,000; the other smaller parties 50,000. The returning officer in writing the 800,000 votes in words mistakenly wrote 'eight hundred' instead of eight hundred thousand. Nana Akufo Addo says that because of this error the entire votes should be cancelled and 600,000 deducted from President Mahama's total votes!. This is an incredible nonsense.The voters are clearly saying that Mr Mahama should get 600,000 votes and Nana Akufo Addo, 150,000. They are trying to use stupid technicalities to win power but this can never happen! The Supreme Court judges also took part in the voting process and they know what exactly happened at the polling stations. They know who won the elections. This is not a matter of words and figures do not agree.

So far, the EC said 705 Ghanaians registered in Ghanaian missions abroad where registration took place, whereas the Commission quoted that over 241,000 people were registered.

The EC added up the votes of the various candidates to calculate voter turnout percentage. Instead of dividing by 14,031,680 which is the total number of registered voters, they divided by 14,158,890. So they declared a voter turnout of 79.3% instead of 80.15%. This has no effect on the winner of the elections at all.

An affidavit sworn to by Kwadwo Sarfo-Kantanka, a deputy Commioner of the Electoral Commission (EC), averred that the total number of votes during the 2012 election was 14,031,680 and the total number of compiled votes:14,158,890, produces an additional 127,210 votes. Sarfo-Kantanka stated that this was merely a "genuine error"--notwithstanding the deputy Commissioner of the EC did not enumerate what the critical difference there was between a genuine error and an addition of votes used to produce a desired result. The latter is why Nana Akufo-Addo et al's petition is moving before the Supreme Court. It should also be noted that the "magic number" in election votes is less than 164,000. That is, it would take less than 164,000 votes to change a loser into a winner.
All of the Electoral Commission's reports seem rather strange. The EC in its answers to the petitioners, indicated that eventhough it had announced initial provisional figures of 13,917,366, after including and adding registration of [Ghanaians abroad,] it arrived at 14,158, 890 votes cast in the election of 2012, which included the difference of 241,524 registered overseas voters. It should be noted that 241,524 is another number more than 127,210--114,314 more to be exact.
The EC has recently declared that "no voting took place outside Ghana." Notwithstanding it is difficult to understand how the EC can record 241,524 registered voters; use this number of votes in their compiled votes and then declare: "No voting took place outside of Ghana." When it is understood that the Magic Number needed to change John Mahama from a loser into a winner is 163,970 we can begin to understand why the EC might have used magic numbers floating in and out of their statistical statements.
The Electoral Commission (EC) had reported that they had added 241,524 votes from abroad to produce the final compiled vote number in the 2012 election of 14,158,890 as the final total number of votes cast and counted in the 2012 election. This number of total votes was the number of votes submitted as counted and included in the voting results of the 2012 election.
Now the EC is saying there was not actually 241,524 votes cast and counted from abroad (that was also probably a genuine error), there was actually only 705 registered Ghana voters outside of Ghana who actually voted and were counted, maybe. The new number of 705 was given by the EC because of a Supreme Court Order. The new number of 705 was given by the EC because Nana Akufo-Addo et al's petition motion had produced an Order by the Supreme Court to have the EC produce a true and correct report of the total number of voters outside of Ghana. If we can assume that this is actually a true and correct number, perhaps we must also assume that the Electoral Commission (EC) only gives true and correct number reports to the Supreme Court when ordered to do so--otherwise the EC just gives any report they choose to give. We must assume this because the former number of 241,524 figures the EC submitted as the total number of the "voters registered abroad" who were "included in the final [number of counted] results of the election." The critical question here is how can the EC list 241,524 registered voters who voted and were included in the 2012 election's final results when now they are saying that "no one voted from abroad." Is it any wonder how Nana Akufo-Addo et al used the above data and other data to form an assumption that "the election was rigged in favor of President Mahama."

"In the documents sighted by Daily Guide, the EC filed that the Ministry of Foreign Affairs presented to them a list totaling 2,350 as members of staff serving missions abroad but the commission 'captured' only 705 of the number submitted between September and October 2012."

"So far, the EC said 705 Ghanaians registered in Ghanaian missions abroad where registration took place, whereas the Commission quoted that over 241,000 people were registered."

The article is saying 'SO FAR' the EC said....
It did not say EC's 705 are final. Note the date; BETWEEN SEPTEMBER AND OCTOBER 2012.

Again, the piece is saying 'DOCUMENT SIGHTED BY DAILY GUIDE'

Remember Daily Guide has not publish any document to confirm what they are saying as they are known for posting articles and retracting or given wrong calculated information to support Nana and the NPP.
For all those jumping into premature excitement, just hold your breath until the Supreme court begin digesting whatever figures the EC provided in that regard.
Finally, the abroad vote is just a microscopic part of the votes cast; what about the major domestic votes which was under the watch of all political parties agents?

As I've alwayss posted here on Ghanaweb, the NDC think rigging election is a cool thing to do. The fact is that's the only way through which they can have the chance to rule.

They've been going around trying to cause dissaffection among the citizenry against the NPP, by making all sorts of statements; "the NPP is taking the Ghanaians for a ride" "elections are won at the polls not in court" are among some of their constant diatribes against Nana Akufo-Addo & Co, in their pursuit to cleanse our electoral system of fraud and cheating.

It's becoming increasingly clear, from facts and figures that's being revealed that the EC, Kwadjo Afari-Gyan and the NDC connived to steal the ballot to help keep the NDC in power, even when it was obvious that Ghanaians kept on expressing their disgust and dislike about the criminal and non-performing NDC govt.

They didn't even have a message to tell Ghanaians during the election campaign, rather than resort to challenging and refuting every inspiring campaign message of Nana Akufo-Addo, Dr. Bawumia and the NPP.

Well, it's too early to make any comments. The Supreme Court has the power to tell us their mind. Until then, everyone should chill until the judgement day. But quite frankly, the NDC doesn't deserve to be in politics. NDC is "Sasabonsam" party. Period!

The petitioners contesting the declaration of President Mahama as the winner of the December 2012 polls have submitted the names and codes of 4,709 polling stations where alleged irregularities took place.

They have also filed the names and codes of the polling stations where voting took place without biometric verification.

President John Dramani Mahama and the Electoral Commission (EC), who are the first and second respondents in the petition are expected to be served with the filed documents before the end of the week.

Pursuant to the court’s order on February 5, 2013, the petitioners are expected to submit further and better particulars on the remaining 7,207 polling stations where the alleged irregularities took place within two weeks.

The petitioners have also filed the amended petition which has increased the number of polling stations where alleged irregularities took place from 4,709 to 11,916, thereby, making 11,916, the official figure in the court’s records.

They filed the amendment following February 7, 2013 permission by the Supreme Court.

The Electoral Commission (EC), for its part, has complied with the Supreme Court orders by answering questions posed by petitioners.

The petitioners, who are the presidential candidate of the New Patriotic Party (NPP), Nana Addo Dankwa Akufo-Addo; his running mate, Dr Mahamadu Bawumia, and the Chairman of the NPP, Mr Jake Obetsebi-Lamptey, filed a petition at the Supreme Court, dated December 28, 2012 and noted, among other things, that irregularities recorded at 11,916 polling stations, favoured President Mahama but President Mahama and the EC have denied the claims.

Answering interrogatories posed by the petitioners, a table submitted by the EC said the Ministry of Foreign Affairs submitted a total of 2,350 as members of staff, but the EC captured a total of 705 staff during the registration process which took place between September and October 2012.

The EC explained in an answer to interrogatories posed by the petitioners and filed at the Supreme Court registry Tuesday that, 55 persons who registered in Accra, were staff serving in Ghanaian missions abroad but had returned home.

It said the list of foreign service personnel, their dependants, students on Ghana government scholarship abroad and Ghanaians working with international organisations together with the locations and proposed dates of registration was given by the EC to both the NPP and the NDC before the registration abroad took place.

“Honourable Dr Matthew Opoku Prempeh (NPP) and Mr George Lawson (NDC), collected the material on behalf of their political parties in the middle of September, 2012,” adding “no voting took place outside Ghana.”

Countries where registration exercise took place were London, 49; The Hague, 27; Moscow, 34; Berlin, 27; Geneva, 26; Rome, 16; Spain, 3; Cuba, 15; Washington DC, 23; New York, 55; Brazil, 13; China, 20; Seoul, 22; India, 17; Dubai, 19; Malaysia, 13, Addis Ababa, 36; Pretoria, 43; Rabat, 45; Algiers, 28; Cairo, 20; Monrovia, 27, Dakar, 21; Abidjan, 13; Bamako, 11; Abuja, 30 and Lome 7.

The Deputy Chairman in-charge of Finance and Administration of the EC, Mr Amadu Sulley, said the initial provisional figure it announced of registered voters was 13,917,366, but after the conduct of registration of foreign service officials, students abroad on government scholarship, other Ghanaians working abroad with international organisations and the late registration of service personnel returning from international peacekeeping duties, it announced that a “figure of 14,031,793 registered voters.

“This was the figure used in printing the final voters copies which were given to the political parties. Following directives from the court on decision regarding appeals from challenges and objections raised during the exhibition of the provisional voters register under C.I. 72, the number of registered voters stood at 14,031,680,” the EC stated.

According to the EC, “further directives received from the court are yet to be incorporated into the register as well as the recent registrations effected in the Kassena-Nankana District, following the order of the High Court. This will alter the total number of registered voters.

“The voters register is dynamic, not static, particularly, in this era of continuous registration as required by Regulation 9 (C. I. 72)”, the EC added.

In answer to whether or not Nana Akufo-Addo or the NPP was notified of the dates of registration abroad, the EC said “the respondent is not obliged by law to allow political party representatives to be present during registration exercises but has done so, in practice, as a courtesy and to enhance transparency.

It was open to the political parties to have their representatives present at the registration locations abroad if they had so wished”, the EC added.

The petitioners on January 31, 2013, amended their petition which they had filed on December 28, 2012, to request the Supreme Court to annul 4,670,504 valid votes cast during the election at 11,916 polling stations where alleged irregularities were recorded.

They have also introduced the claim that there were 28 locations where elections took place, which according to them, were not part of the 26,002 polling stations created by the EC.
