When I heard, Jake alleged that the party discover a sophisticated fraud, which skewed the result to JM I thought this is serious allegation and the president and EC are in trouble. However, when I read the empty petition and the sophisticated fraud has become irregularity then I realised for the first time that Nana and his team of advisors are sick. It is a very dangerous practice in all-walks of life to talk more than you think. I am not a lawyer and I do not have the level of education some of these guys have but hey there is a huge ‘creative thinking deficit’ in NPP right now. I feel sorry for Gabby you will have been better of pursuing your legal profession rather than allowing yourself to be debase by the irrational and emotionally filled venture that has taken sense of logic out of you.

Nana Akufo Addo also needs 248,734 votes to be declared an outright winner. That is, all things being equal. I am surprised that the petitioners have asked for nearly half of the votes declared as valid by the EC to be nullified. It was not necessary and in fact, that has made the petitioners case weak.
In my view if the SC nullifies all the vote 4.7 million votes, the relief that Nana Akufo Addo should be declared winner will not materialise. The whole election would not have been credible and will be nullified. The SC will be left with no other option but to order a re-election instead.
On the other hand, should 4.7 million votes be nullified and Nana Akufo declared winner, his Presidency will lack legitimacy because he would have won with very low percentage of registered voters or even the actual votes on election day.
In my view, it is highly unlikely the SC will disenfranchise that many voters and still declare a winner. I say so because the judiciary are expected to use the interpretation of the law and apply it to enhance the enjoyment of fundamental human rights but not to curtail them. The right to exercise one's franchise is a fundamental one and is enshrined in Ghana's constitution. The SC will therefore protect that right.
Again, the mere fact that a condition of machine verification was imposed does not mean the SC will automatically apply it to the letter without regard to the Supreme Law of the land. That condition may be in conflict with the Constitution so the SC may thread very cautiously before the Justices nullify all the votes that were not machine verified. The question for the Justices would be: was it possible to reasonably verify a voter without necessarily using biometric machine? If the answer is yes, the next question would be: would it be right and proper or constitutional to nullify and disenfranchise all those voters simply because a machine did not verify their identity? I am aware that that condition or requirement was in the CI75 but that does not necessarily make it constitutional. I believe that could be ruled unconstitutional.
I agree with you that case management is a big problem and for justice not only to be done but also seen to be done, the Justices must manage the case effectively and efficiently. That will also ensure expeditious hearing of the petition and for justice to prevail.

It is not for the respondents to deny with evidence, rather it is the petitioners to be able to prove convincingly with evidence that they have a case. It called the burden of proof. Anyone can go to court with allegation but the burden is on the accuser to prove his case and judging by the merits of his evidence and considering the far reaching effect of the ruling the justices then rule. So pls go and help Nana and his cohorts to prove every single number they have quoted. If its even shy by one it will not hold in court of law. Viva Ghana

A prima facie case has to made before the respondents are called to open their defence. Remember also that the justices stated that the previous ruling on further and better particulars also affected the ammendment, meaning the NPP has in addition been compelled to provide further and better particualars for 11,906 polling stations. The justices know the implication of each ruling and NPP can choose to wish away its significance (like Gabby is doing), at their own peril. Lastly,Gabby it is not for you to suggest what time frame the SC should take, what is your basis for 5 months? Why are you prepositioning yourself as the Senior Prefect of the SC? The case would take as long a time as the SC deems nessary to ensure that these vexatious and absurd challenges are not entertained in future. You called the tune, now dance to the music.

It is quite interesting that we are being inundated with calls for an expeditious treatment of the petition at the Supreme Court (SC) case over the last few days.. On Ghanaweb, I have read articles such as:
Prof. Okoampa-Ahoofe’s feature article “The Supreme Court Must Expedite Justice” February 10, 2013.
Kwaku Asare’s feature article “The Absence of a Concession and the Powers of the Supreme Court,” February 9, 2013.
Kwaku A. Danso’s feature article “Ghana Elections: The Absence of a Concession and the Powers of the Supreme Court,” February 9, 2013.
These articles and calls are coming a few days after the petitioners were given two days to amend their petition to the SC on Friday February 8. Before these amendments, we have witnessed at least four other actions by the parties to the court case that may be said to have contributed to a delay in the trial. Three of these came from the petitioners when:
- They chose to exhaust all the 21 days stipulated by law before presenting their petition to the SC.
- They challenged the composition of the panel and thus caused a suspension of proceedings, only to return two days later to say they no longer object to the composition.
- They decided to amend their original petition.
The NDC, which was not originally included in the petition, also filed a joinder motion to be made a respondent; arguing that the 1st respondent (the President) was fielded as a candidate by the party.
These actions delayed proceedings to the extent that till today the main issue is not heard. Add these to the original “hollow” petition which was served to the court and the respondents. This petition was deemed by the respondents to lack further and better particulars of the claims and allegations of the petitioners, leading all the respondents to pray the court to order the petitioners to provide further and better particulars to back their claims and allegations.
Could the petitioners not have noticed that the lack of further and better particulars constituted a very high potential of delaying the process? Mr. Otchere Darko is said to be one of the team of lawyers on the petitioners’ side so I wonder what he is doing here, calling for an expeditious treatment of the case. Could he not have worked better enhancing the work of the court by presenting a petition with better particulars and devoid of mathematical errors as observed in the original petition?
Reading through the article, Mr. Otchere Darko seems to imply along the way that the onus of peace in this country rests on the NDC because it is the validity of their leader’s Presidency that is being challenged. Has Mr. Otchere Darko soon forgotten that those who beat up, killed, and smashed cars in this country in the aftermath of the declaration of the results were supporters of the party whose interest he is defending in court?
The considerable weight of apprehension in this country is due to the way some of our politicians have acted the past couple of months, starting with a declaration of a winner of the elections by Sir John (the NPPs General Secretary) on the night of December 8, when just 50% of the results had been certified; through the refusal of the NPP to concede defeat, alleging massive rigging and fraud (words that have disappeared in the legal dictionary of the NPP); to demonstrations and harassing innocent citizens; and ending, for now, in a so-called “Let My Vote Count” campaign by leaders of the same party whose members claim their fight is to ensure that their votes are counted – forgetting that the battle of their petitioners is to discount over 4 million votes.
If Mr. Otchere-Darko has decided to write on the need for speed at the trial, he should tell us, with our law books in hand, and not forgetting the feet-dragging tactics being employed by the parties involved, how long it must take to resolve the case at the SC. Mr. Otchere-Darko reigns supreme at the Danquah Institute and must use that institute to promote good governance and civility in the country by brainstorming the laws of the land while in their dormant state, instead of tell us how legal processes should be expedited only when he becomes one of the interested parties in the legal battle.
Mr. Otchere-Darko states that “what is in dispute can certainly not be the facts and figures on the pink sheets but the effect of those facts and figures and that will not be determined by polling station agents but by expert witnesses, legal arguments and the like.” So now, the fact that a registered voter cast a ballot no longer matters. What matters is what an “expert witness” (who is this personality?) and a legal practitioner says in court! Is the NPP now running away from the pink sheets that they claim form the basis of the evidence of their fraud now, and now prefers to depend on expert witnesses and legal arguments in court to defend their theory of fraud? If this is the case, why are they claiming that the EC must make available all pink sheets to them for copying to avoid doctoring?
Finally, Mr. Otchere-Darko, going by the face of the petition and the claims of the petitioners, will you say that striking out 4.7 million ballot papers out of a total of 11 million votes is the surest way of ensuring justice in this country?

1. Your arguments about delays to the hearing seem to weigh heavily on the attitude of the respondents rather than both sides which is unfair.
2. You argue strongly about the extent of what you present as irregularities e.g. involving the number of pink sheets improperly completed, signed or with several serial numbers.
3. In your selection of cases around Africa (and indeed the US) to buttress your arguments, you fail to put each of these examples in the proper context and degree of complexity e.g. In the Nigerian case and the US case of 1876. These are two nations which run a federal system and in the US case, the electoral college as well, plus in the US case, they were emerging from Civil war and the Democrats were disadvantaged nationally; in the Nigerian case, a particular candidate was being barred from office for whatever reason and somehow they had to find a way of achieving their aim which many of us condemned at the time.
Nor do you even put the Ugandan and Zambian case in the right context vis a vis the level of transparency, fairness and 'freeness' of the elections from observers, compared to Ghana which is by far more 'robust' in its electoral processes and the integrity of our elections as evidenced by external observers. It is also interesting that you have failed completely to examine the validity and authenticity of the 2000 and 2004 Ghana elections which were won by Kufuor and for which the NDC opposition did not go via this route to seek redress.
4. You also seem to criticise the supreme justices where they have taken decisions that you do not like e.g. allowing the NDC to join the petition, yet I challenge you to provide ONE credible reason why Jake Obetesebi-Lamptey is part of the petition if not as a proxy representative of his party the NPP. The reasons you give for the justices' ruling on the matter are not the whole truth. If you want Ghanaians to take you seriously, then please provide the whole facts and then make your arguments either way.
5. Be that as it may, one question you have failed completely to address is - the fact that the constitutional provision of the voting franchise did not take into account technological developments and originally emphasised the 'fitness of individuals' to vote under Universal adult suffrage. Part of the problem with the 2012 election issues border around the use of biometric machines recently introduced into our electoral system to help make them more transparent and to reduce fraud.
Given the problems we all now know about their level of 'efficiency and / or functionality' in a number of cases, and given the fact that the over 4 million votes which your petitioners argue may have to be recalled, WERE THESE 4,000,000 plus, REAL HUMAN BEINGS and did they actually qualify to vote under the constitution and did they actually cast votes or not? If the answers to these questions are all YES, then please explain to Ghanaians what the SC should in all fairness, decide with regard to whether to annull their votes (thereby disenfranchising these millions of real human beings who otherwise were qualified to vote) or to accept that though 'imperfect' nonetheless the electoral system was not intentionally and fraudulently designed to disadvantage any one candidate. In other words, would you accept the Zambian solution that you so eloquently refer to in your article?
I believe we all need to be sensible, unbiased, realistic and properly balanced in our arguments if we truly wish to see Ghana as one intact, peaceful and prosperous nation of diverse views, opinions, parties and tribes living together in harmony as we have done for many a Century. Would you agree?
PS: by the way I am not a member of the legal profession, nor am I a supporter of the NDC, just a commonsense Ghanaian seeking the truth, fairness and justice as our national emblem says.

On Thursday, the court ruled for the petitioners to amend their petition. This means that, they are now challenging over 900,000 votes as being tainted by over-voting; over 600,000 cases of voting without biometric verification, over 300 pink sheets without the signature of the presiding officer, affecting over 100,000 votes, and some 2.9 million pink sheets carrying duplicates of serial numbers, even though each pink sheet must have a serial number unique to that polling station. The amended petition now includes 28 polling stations, which were not part of the 26,002 officially declared by the EC."

Of course the Supreme Court's decision must be in line with the law of the Constitution. Gabby indicated that the importance of the decision would be that it needed to give relevence to the decision of the Court and it must direct the proceedures and the measure of justice in Ghana's elections and in Ghana's democracy, expediously. The evidence before the Supreme Court is monumental. The decision that will come from this election petition will be precedential. Not since Ghana led and won the battle for Independence in Africa has Ghana been so certainly at the forefront of democracy's development in Africa. Ghana has been led to this moment in its history by Nana Akufo-Addo, who is a leader of genius, who has been involved in the march to a strong, true, perminant democracy in Ghana. I will work for Nana Addo to see him granted the Nobel Peace Award. Nana is a great leader who I have followed since I met him at Legon when we were attending the University of Ghana at Legon. I have followed Nana Addo since I met him. He is a great Ghanaian leader, who I wish to follow and to emulate. I believe we have entered a door in time in which many people will strive to emulate Ghanaians. It is time for Ghanaians to realize that many people in Ghana and the world will wish to emulate them because of their superlative greatness. Pope Benedict XVI will resign on the 28th of Febuary and one of the Cardinals who is being spoken of to become the next Pope is Ghana's Cardinal Peter Appiah Turkson. The people of Ghana, and I do not mean merely the Catholicts in Ghana, should pray for Cardinal Turkson. Just as I pray for Nana Akufo-Addo and will pray for Cardinal Turkson; I try to emulate Nana Addo, because it is my devout prayer to become like he is. Ghana, emulate your great leaders; emulate Cardinal Turkson; follow them and your national greatness will grow.
