Justice Atuguba: He added that “courts are there for the public and the judges are supposed to be public servants and with the exception that a matter is gravely confidential, it has to be heard in public”.
This shows also that he has already took a stand which is equally that of the NDC. Although he must know that it is the constitution of Ghana that treat certain matter at court and not publicly.
Who is following the law now?
I think this case is very interesting to follow. So that an objective decision could be taken individually.
Let us wait for the outcome of the case. And that the truth will come out in this case without fair and favour for any political party.
We are here to analyse things critically.
God bless our homeland Ghana!

What is all these hubala about? There is only one road to justice. I guess not all the nine judges appointed to hear this complain are NDC card holders/sympathizers. At the end of deliberations, all the judges are going to debate on the case and vote for the verdict. What are poeple's fears? It is true that these judges could be bribed and circumvent justice but "the spiritualist/prophet who prophezised that there is going to be pandemic disease in the his environment and does not stop it should know that his/her family are not immune to such disease" - they could be affected. I belive most of these sitting judges are christians and know that it is sin to deliver false judgment. GOD IS WATCHING THEM. Even if the elections were rigged by NDC to win, what would have been the deference if NPP were declared winners. Look all the member of both parties will do the same thing if they are given the mandate to govern Ghana. Didn't NPP steal from the country when they were in power? Asiedu Nketia and his gansters are afraid that if NPP comes to power because their hands are filthy with the money they were asked to manage. We all know the problems Ghana is facing. Neither NDC nor NPP is willing to help solve them. They are all theives. Some people don't see anything wrong with that but I do.

So may I know why Justice Atuguba was steaming? As an experienced judge of the Supreme Court, Justice Atuguba does not need any one to lecture him about the enormity and significance of this case. Justice Atuguba I am sure is very aware of the phrase “Conflict of Interest” Justice Atuguba I am sure is fully aware that being part of an adjudicating team that determines the fate of a case that involves his cousin would give birth to a new melodrama. I am surprised that he waits to be told to abstain from the panel. This is not the first time a judge has excused himself from a case that tethers towards conflict of interest. Years ago Chief Justice Apallo did not only abstain from a case involving his relative Modesto Apallo; he travelled out of the country during the trial. I realize the fanaticism that is fuelling this acrimonious case is going to further poison the asphyxiating political climate that we have. Listen, irrespective of what judgment is delivered by the judges, this case will forever stand out as a litmus test to our fledgling democracy. This is the kairotic time for the Judiciary to prove its independence from both the Executive and Legislative branches. All that I am asking for is that judges with conflicting connections should not contaminate the verdict by their mere presence; they should honorably abstain from the case.

Justice William Atuguba's 'outburst' was right in view of the numerous actions by the NPP:
1.Unnecessary objection to the Declaration of election results by the Electoral Commissioner.Article 64(1) does not provide a blanket license to any election loser who the whole world knows that they have lost elections to go to court.Nana Akufo Addo knows in his heart of hearts that he lost the election!. He is only trying to set up his mostly illiterate followers against the whole country to cause confusion like other West African Countries. From his actions,he should know that he is preparing himself to face the International Criminal Court.
2. Holding of unnecessary press conferences whilst petition has been presented to the Supreme Court which petition is hollow and lacks logic. How for example can they say that because a presiding officer's signature did not appear on some of the Pink sheets, therefore 208,000 votes should be deducted from President Mahama's total votes; all the representatives of the Political Parties signature however appeared.Remember that the Pink copies were eight in number and if you did not 'press hard' your signature would not appear on some of the copies. How again could they describe votes as excess while the number of votes cast were less than the number of registered voters. This again they should deduct 620,433 from President Mahama's total votes. How again can they claim that 456,933 votes should be deducted from President Mahama's total votes because voting was not by verification.I voted myself and I know the processes that I went through:(a)Checked my name on voting card against a hard copy (b)picture popping up for verification. If after the above, the machine could not verify me because it was broken down, that means I was not verified? What is the definition of verification? Article 42 is clear:'Every citizen of Ghana of eighteen years of age or above and of sound mind has the right to vote and is entitled to be registered as a voter for the purposes of public elections and referenda.'The constitution is the supreme document. This article is clear:18 years or above and registered. In any case the electoral commissioner said: No verification, no vote. He did not say, NO MACHINE verification NO VOTE.
3. Holding of Press Conference by the NPP debunking the response to their response by the Electoral Commissioner
4.As if the foregoing is not enough, NPP is trying to tell the whole world that our eminent Supreme Court Judges are not independent minded people but men and women who are biased and lack integrity? NPP is doomed for ever!!111

Some of the people who are in the media in Ghana are just plain imbeciles to be called practitioners. Either they lack the proper comprehension and usage of the English language or they think in their mother tongues and transcribe their thoughts directly into English and by so doing exacerbate situations.
Sensational reporting sells news but the low level to which some media people in Ghana stoop is absolutely disgusting.
Whenever a person explodes in a communication process, he/she loses control of himself/herself and normally rants to emphasize his/her points. The speech is most often confrontational, couched in anger, embellished in words that are often not repeatable but which in retrospect is often regretted. However if any sane human being puts the words of Justice Atuguba in context, there is nothing explosives about what he said. He was rather counselling than admonishing. He was not confrontational but rather reasoning. So for a journalist, if he or she can call himself/herself that, put out such an offensive headline speaks volumes of the depravity.
It is true the English language is not our mother tongue but the dictionary is there to help us with the proper usage of words, especially if our messages are intended for public consumption.
During the composition of an article, in the present age of information technology, if in doubt of the spelling of a word or the usage thereof, just google and the right thing pops up. If this is too much for some "journalists" to do despite professing to be media persons, then they should please do the honorable thing and go into poultry farming instead, because they lack the capacity to be media practitioners/journalists. By the way, where are the editors of papers that continuously put out such miserably mediocre articles. Do the Ghanaian reading public not deserve better? By the way do not forget that the internet is not referred to as the worldwide web (www) for nothing. What ever you put on it is available to anyone even on the remotest island in the Pacific Ocean, in Alaska or in the Gobi desert who roams the web so if you want to continue making a mockery of yourself, you are welcome. Knock yourself out.

I remember very well when I was studying 'auditing' at The School Of Administration , University of Ghana, Legon, I read something on the subject; 'The Independence Of The Auditor'.
An auditor should approach his duties 'free from anything that could be seen or interpreted to mean that that he was not free to express his candid opinion on the documents and records that had been examined by him'.
This lack of freedom could be seen and interpreted to stem from many causes:
For example,if my father owns a big corporation and I happen to be appointed as the auditor, although, I possess all the necessary qualificatons and knowledge that all other ordinary auditors are possessing, but because the business is owned by my father, my independence would be enchroached upon by the 'father-son relationship'. This is also 'Conflict of Interest'.
Now my questions to Justice Atuguba:
1.Why should Justice Atuguba throw 'tantrums' when the NPP attorneys questioned his membership of the panel because of his realtionship with the Executive Secretary to the President, who is the Ist respondent in this case?
2.Did he do that because he thought that they were doubting his qualifications or competence?
3.Why was he annoyed and was hiting the table with his fist and making such outrageous remarks and comments?
4. Did he think that he was super-Ghanaian or super-citizen or indispensable Chief Justice?
5. Was he trying to say that although the Executive Secretary to The President is my cousin, this relationship could not infringe or hamper my independence of mind, thoughts and decision-making?
6. Is he not matured enough to know the wisdom in the popular saying that: "There is no art to find the minds construction in the face"?
7. Should the Attorneys sit down uncomplained until they are taken unawares? Should they keep quiet until incorrigible and indelible mistakes are done?
Unfortunately, the behavior of Justice Atuguba is reprehensible and smells of some 'skeleton behind the cup-board'.
No, this should not be the behaviour of one of our honourable Justices Of the Supreme Court.

Efo Yao, where in the volta region do you come from. I'd like to talk to your village chief to councel you because you seem to be off track on the objection issue being raised by the NPP. The nine (9) justices makes it perfect for a straight verdict on cases at any time. If there should be a close tie eg. 4:4 the ninth justice adds his/her final voice vote, to make the majority to arrive at a verdict. So what's your point. Don't be blinded by tribalism and fall into the opinion that the NDC has the power to rig elections. Election fraud is a serious matter and that's why there's court hearing on it. Do you know what election fraud is; do you know that EC's boss Kwadjo Afari Gyan or someone could be sentensed to jail term because of this fraud? Please try to sharpen your brains a little, so you may easily understand proceedings. Have a nice day, Efo.

Are saying saying that the CJ has recused her self? If she is not sitting on the case does not mean that she has recused herself. Who selected the judges to sit on the case?
Gberlornu comes across as driveling moron. When zealots put up such arguments, one starts wondering the extent to which fanaticism dissipates brain power
THIS FUCKER ATUGUBA MUST DO LIKEWISE. HE SHOULD NEVER THINK HE IS BETTER THAN ANYONE, AND THAT HIS ABSENCE WILL DISCONRINUE THE TRIAL. JUST TELL THE THIEF TO FUCK OFF. BOGUS CORRUPT ATUGUBA
Why is NPP afraid to mention the name of the judge they want to recuse from the panel, but just casting innuendo, that the person "demeanor(US) in court today showed us that he knew that something was wrong in his sitting on ...

Justice Atuguba's anger should be aimed squarely at the ridiculous wig he is made to wear. How do these justices think with such a piece of crap on their heads?
It's quite baffling how you swear in a president while the very essence of his winning is being challenged. What if there's a ruling against him or is this a forgone conclusion against NPP ?
