The General Secretary of the National Democratic Congress (NDC) Johnson Asiedu Nketia was quoted as remarking that even idiots can go to court.
The remark was part of his party’s knee-jerk reaction to the Nana Akufo Addo, Dr. Mahamudu Bawumia and Jake Obetsebi-Lamptey’s decision to contest the last presidential election at the Supreme Court.
It was such an unnecessary remark which not only exposes the underbelly of the NDC Scribe for his undeserved attacks but also gave credence to the largely true impression that politics in Ghana has been made dirty by a section of the political leadership.
Yesterday, a politician from the other side of the divide, in a response to the General Mosquito insult, wondered whether it was not right to state that the NDC does not represent another group of idiots marching to court as suggested by the party scribe.
There is no doubt that had he envisaged that his party would adopt this delay court tactics, he would not have thrown out this obnoxious label for those who opt for the courts in place of violent street action in protest at election results.
Vitriolic begets vitriolic, a situation which muddies the political waters unduly and thereby undermines the peace of the country giving politics a bad name.
These are the real issues worth tackling by the Ghana Peace Council and other stakeholders and not the shadow-chasing operations which have, by and large, characterized their work since they started their occupations.
Mr. Asiedu-Nketia has earned for himself an unenviable impression among many Ghanaians. His disrespect for our mores and values as Ghanaians first and foremost is lamentable.
Such notoriety as he is exhibiting shamelessly is one which should not be entertained by any inch in our political system. When the sources of our contaminated political system are sought, the Asiedu-Nketias would stand tall as the originators. What a shame when we seek to build a healthy democratic culture.
For a man who has insulted almost everybody in the country but himself, there is the need for those who seek to establish morality in the country to find a way of reining this bull in a China shop.
The court option, which Nana Akufo Addo and others chose to embrace, the source of the latest bout of insult from Mr Asiedu-Nketiah, has not pleased the NDC General Secretary and his colleagues.
In spite of their position and decision to do all they can to throw spanners into the wheels of democracy, many Ghanaians would continue to strive for decency.

now, to your last 2 paragraphs. true, the court action initiated at the instance of Nana "Nie" Addo Dankwa Akuffo Addo (nnadaa) is thought vexatious by many, not only gm and his colleagues, but to call the decision by gm's party to seek to be joined to the defendant "throwing spanners into the works" is, to say the least, a misunderstanding of the law and its workings! truth is, i know u are not that daft! unfortunately, following the experience of the 2008-2009 ex-parte motion sought by the npp in similar circumstances, when they chose which judges should sit on the case in order that they might have favourable judgement, they have not travelled the same path, but their (your) intention is still the same, to obtain by foul means, what you (the npp) failed to achieve by fair means! so it is, that u find an interested party's sincere attempt at protecting his interest "an attempt at throwing spanners into the works"! God help us all!

However, should you get your wish and war erupts in Ghana, do not place your faith in the security forces to fight your battles. The security forces consist of diverse political and ethnic persuasions, which will be revealed in time of war.
Besides, examples abound of national security forces suffering defeat at the hands of a powerful and determined insurgency. This is a real possibility in the unlikely event of war in Ghana. National security forces are not invincible.
Most of us want to preserve our country for our children and their children. If you want war, try Syria, Afghanistan or Somalia and leave Ghana in peace. You cannot appreciate peace, until you have experienced war.

If some Justices cannot be trusted by the NPP to give a fair judgement on this most crucial issue, then there is absolutely no reason to trust Justices who are close to the NPP too.
They must also be removed. Period!

Where is the judgement in the following?
'“This country is solid but we risk breaking down because principles are being chopped down to pedestrian level. The Court must be strong and truly independent. The health of [our] country depends on us," he stated, banging the table.'
The NPP has a cow boy mentality. There is no law, no principle, more important than their strong whims and caprices! They were the first to ask for a live coverage of the proceedings of the court, in the name of transparency. It should surprise no one to see them being the first to ask to speak in camera!
They insist on justice, so far as it will make Akufo-Addo president, not because they necessarily want fairness and justice to prevail. This explains the regular commentaries and predictions of victory that prejudge the case, even before the hearing. The NPP declared victory ahead of the Electoral Commissioner's declaration of the polling results, and called on their followers to wear white the next day to thank God!
Most of them we wearing white when the results were declared! They are going to court to find out who is fooling their supporters! I suggest they ask their supporters to wear white on the day of judgement, just for a repeat show!
When will this flagrant disrespect for the rule of law, chicanery, and vexatious and abuse of judicial procedures by the NPP ever end?

Even in the US SC Justices are either conservatives or liberals ideologically. It's a matter of fact and reality of life. Republican Presidents often nominate conservatives judges to the SC and Democratic Presidents nominate liberal judges to the SC.
Even if God nominates or appoints judges to the SC they are most likely to fall within the two categories. In Ghana, it's either pro-NPP or pro-NDC. It's normal because they are human unless we wanted angels. No matter their ideological or political views, they are there to administer justice and that is what is more important so they must remember to reflect that in their judgement.

Over the years Justice Atuguba has shown his partisanship in his pronouncements both from the bench and outside the courts. He needs to recuse himself, especially now that his brother/cousin is the Executive Secretary to the President who is a major part of the case before the court.
Note that there is another Justice whose brother was a former Chief-of _staff to John Mahama, that is Justice Baffoe Bonnie. Two Justices with close working relations with John Mahama does not auger well for the NPP.
Clearly Justice Atugubu is the main problem on the panel. His track record on the Court clearly shows he is not about justice but partisanship. He clearly should have recused himself from the panel.

It is a fundamental principle of law and the code of judicial ethics that even an appearance of partiality should mandate a trier of facts to recuse themselves from a case in order to preserve the integrity of any ruling or judgment handed down by the trier of fact. Among the several grounds for recussal is when the trier of fact and a person with vested interest in the case are blood relations. Even if the trier of fact is principled and impartial, the appearance of impartiality based on family relationship is justifiable grounds for recussal. Blood is thicker than water as the adage goes.

Fellow Ghanaians, I am an ardent NPP supporter, but I can clearly see why this judge is extremely worried about the future of the country. Every competent judge knows that the overwhelming evidence being produced by the NPP will undoubtedly lead to the reversal of the presidential elections. No amount of verbal posturing can prevent that, because most of the allegations and the evidence are pretty damning.
Now the real question lingering in our minds is, how do we force this presidential change to occur in this country? Remember, when this inevitable judgement against President Mahama comes down, he is no longer the president, according to the constitution. This scenerio is fully pregnant with civil strive chaos in this country. This is the fears of this judge, that the imminent decision will tear the country apart. Let no one in NDC live in illusion and deceive themselves of victory in this case because the evidence is just overwhelming. I am NPP supporter but I think we as a country, have inadvertently pushed the self destruction button here. I thought they wanted the proceedings of the court telecasted live; why are they now asking for the part that has to do with stating their reason for challenging the constitution of the panel in camera? Oh they think the Justices would do what they would have done if they were in the realm of affairs; using family ties to influence decisions.
Come on, half baked lawyers, we all know you have no case but intentionally using these tactic and means to re-launch your disgraced Nana Addo. It will not work!
Disgraced Nana who by all measure is unfit to be president thinks by dragging this case, he would be maintaining his popularity and be re-chosen as flag bearer the third time. Sorry, you are nowhere near the character of the late Mills. Well, Nana would be maintaining his negative popularity; a recipe for another shameful defeat.

While a logical extension of the principle compels a judge to recuse himself from a case in which he has a familial or pecuniary interest, in practice, the doctrine is not designed to apply robotically. In the celebrated Sallah case, the justices prudently noted that because everyone in Ghana is related to someone, including a judge, or to someone related to a judge, some caution should be exercised in the application of the doctrine. Thus, the fact that a judge might be related to one of the parties in the case should not be a foregone conclusion for his recusal. However, it makes sense if he voluntarily recuses himself on the procedural issue of the joinder or intervention by the NDC, especially given the enormous national interest at stake, the extensive negative publicity that has been generated, and the need to avoid the speculation, suspicion. or perception that the Court might have been influenced by his bias.
The intervention, as previously mentioned, is warranted by basic rules of civil procedure as that is the only way by which a complete relief can be granted to the parties. I must note, though, that, although the joinder or intervention is the correct way to proceed, it should not affect the merits one way or the other. The merits would be based solely on the facts and evidence presented to the Court and the Court's independent judgment upon its sound application of the law.

The EC is the party required to offer the substantive response not the first respondent. The NPP has not provided any evidence of a grand conspiracy involving Mahama and the EC.
So the NPP contesting the NDC application is a pointless exercise, since if it believes its case is strong, then it must be strong regardless of the number or strength of the respondents.
Akufo Addo said his objection was because the hearing of his petition will not be expedited and not because Mahama will gain an unfair advantage by been tied in with his party. If he desires expeditious hearing why object to the composition of the panel only for the case to be adjourned indefinitely?

The independence of the distinguished men and women in whose hands the destiny of 'political' Ghana lay is already being questioned? An air of mistrust already; so soon? But should that mean the rest of the judges are either independent-minded persons or sympathetic to the course of the NPP? If the former is the case then NPP is justified otherwise if the latter is true then those judges should also be asked to leave. And the yardstick to gauge party affiliation not always clear; it could be something of the heart and so difficult to ascertain.
What a crossroad the nation finds itself at! Who will give us direction?
For God's sake will our judges rise above party affiliation and execute their work in absolute honesty and boldness for posterity!

We should not impugn the character and integrity of our Justices based simply on which administration appointed them. Our Justices have so far not shown any demonstrable bias in any court decisions they have made to deserve this kind of unwarranted attacks. But to uphold the integrity of our legal system at all times, there should not be the "slightest semblance" of impropriety.
If Justice William Atuguba is allegedly related to Dr Raymond Atuguba, Executive Secretary to the President, then he should know this raises a clear semblance of a "potential conflict of interest" - he should NOT be interpreting this as a "personal" attack. In the interest of Justice and fairness, he should simply recluse himself from this case. Unfortunately, his outburt feeds in to the very cynicism Ghanaians have and to which he is objecting.
By the same token, as Dr. Ogunda alleges, if Justice Sophia Akuffo is related to Gloria Akuffo (NPP's lead attorney) and Justice Rose Owusu is related to the NPP General secretary Owusu Afriyie, then both should recluse themselves from the case. I am not sure why this should even be debatable, or why the occasion should arise for us to remind our Justices about this.

Sophia Akuffo trained as a lawyer under Nana Akufo-Addo.[1] She has been a member of the Governing Committee of the Commonwealth Judicial Education Institute,[2] and the Chairperson of the Alternative Dispute Resolution Task Force. In January 2006 she was elected one of the first judges of the African Court on Human and Peoples' Rights:[3] initially elected for two years,[4] she was subsequently re-elected until 2014 and is at present serving as Vice-President of the Court.[5]
She has written The Application of Information & Communication Technology in the Judicial Process – the Ghanaian Experience, a presentation to the African Judicial Network Ghana (2002).
Clearly the NPP does not want the case to be heard in the first place knowing very well that they will loose, so they are putting hurdles in the way of everybody to prevent them from putting the case to rest once and for all. Its all part of their diabolic agenda to frustrate the government from delivering his campaign promises but it won't work. This case shouldn't travel beyond two months.
