The courts must be fair otherwise we will not develop. Judges are human beings and may have their biases, but on the whole, they must to be fair.

Why did the Chief Justice appoint Justice Atuguba to chair the NPP court case, when President Mahama has just appointed Justice Atugubas nephew Dr Atuguba as the Executive Secretary to the President?!!!!!!

Ghanaians must not give up, democracy is not handed over on a silver platter
, it is 'fought' for through hard work, dedication conviction of true beliefs and the likes.

Sophia Akuffo,Vice-President of the African Court on Human and Peoples' Rights, only trained as a Lawyer under Nana Akuffo Addo, but getting a training in a profession from someone doesn't automatically make you his/her cousin, lil one.

What is the interest of 'Citizen NDC' in this case, if it knows that it is not tainted with any crime in the elections, besides attempting to delay the delivery of Justice ?

Do'nt be closed minded either. Everybody supports NPP's court action but it seems they are hurting themselves. Nobody is holding them back but they want things their way else they are dissatisfied. I am libertarian with slight NPP inclination but I am getting sick and tired of their approach to doing things. Why did'nt the executives inform the supporters truthfully to negate the anger they had going to President Kuffuor's house to stop him from going to the state invited ceremony.

NPP boasts of being number one in democracy, therefore, I expect them to observe democracy principles. They claim the elections were rigged in favour of John Mahama and they are taking court action to seek redress. Very commendable decision that everyone supports.

My only problem is their lack of transparency and inaccurate facts representation. What the supporters hear in the public arena incites them to react. I was listening to Adom FM last night and the host asked Akomea "why does'nt your supreme court writ state that some votes were stolen from Akufo Addo for John Mahama as you assert in puplic", he answered that irregularities, constitutional breach and mistakes which favoured Mahama are the grounds. Why then do they go about accusing the EC and NDC to have collaborated and stolen votes for Mahama in public but can't state same in the writ. It is because they cannot prove the theft yet they have sown the seeds in the minds of supporters - dishonest representation of facts.

If NDC wants to join as an interested entity, why try to stop them. Democratically, I think anybody who holds some evidence or facts which can help to get to the bottom of the TRUTH, should be welcome.

NPP went to supreme court and when it came to time to deliberate to decide whether NDC should be allowed to join NPP said they did not like the supreme court somposition so the hearing was adjourned. This means the present composition of the supreme court is perceived by the NPP to be corrupt, unreliable, bias etc. They want supreme court to determine a case they have against EC they do not trust, and at the same time they show mistrust in the composition of the supreme court. Are'nt they revealing their true nature? If they do not trust themselves, they would not trust anybody, and that is bad.

The petition over the 'election' results is dead on arrival; how will the other side, the leadership party, embraced the NPP's 'backward' idea?
The NDC will never extends its 'happy' NECK for the SLINGER to be massaged! It will forever protest, and disagree to anything reaching its team. Perhaps, the NPP erred in swearing Nana Akufo-Addo alongside President John Dramani Mahama. In all fairness to NPP, I think NPP is right, especially since he is the Presiding Justice. I know the other Justices could over vote him but the conflict of interest is too strong. That is my view though the Chief Justice could say that the panel was decided before the younger Atuguba was appointed to his new post by the President.

Well, well, well this is what we get at times when relatives end up in high places, most of the time, through no fault of anyone. With the political temperature surrounding this case so high, shouldn't we all agree that all those closely related to NDC & NPP officials on the Court should recuse themselves from this case? Otherwise the side that loses will forever not accept the Court's verdict. I hear the Chief Justice is related through her sister's marriage to one of the top NPP official, possibly one of their lawyers. And as I read here, are the CJ and the lead counsel for the NPP also related? This is a very nice mess we have here. Normally I would argue that these SC Justices will hear this case fairly snd dispassionately,as they are supposed to, but I also know we live in a country that still believes that friends/relatives in high places don't hurt one's cause. Time will tell.

Never heard of Justice Dery handling cases involving NPP members and the Republic of Ghana when there was an NPP MP, Amrose Dery who is said to be his brother? I recall a judge refusing to vacate his seat when a similar charge was raised against him. The judge might be one of these SC judges. They should wait till the case is over and they have evidence of bias. This is why Bernard Mornah's suit currently before the SC is meaningful.

There's no denying the fact that OB Obiba clearly had his information wrong but the cardinal principle here is that if Justice Atuguba has the welfare of Ghana at heart and STUDIED LAW properly he shouldn't have allowed this day to arrive without recusing himself from being on the panel. If he (Justice Atuguba) does not know the concept of CONFLICT OF INTEREST in law then mother Ghana of all countries is DOOMED forever. How in his many years of practice does he think the plaintiffs can consider him impartial in a case involving his nephews boss? Ghana will forever remain an interesting country!!!

In any case look at the following scenarios:

1. 1951, first elections held in Ghana rejected by the UP. Because they lost.

2. 1954, the UP/NLM/PP coaxed the colonial masters to hold another election. After they were trounced, they rejected the polls.

3. 1956, Danquah and his click put pressure on the colonial government to hold another election because he thought he could then make it to parliament. They lost and rejected the elections.

Fast forward to post independence.

4. They had always perceived the Nkrumah regime as illegitimate.

5. 1992, Rawlings won the elections. The NPP, led by Albert Adu Boahene (an Akyem) wrote the stolen verdict and refused to participate in the parliamentary election leaving parliament to become a lopsided NDC rubber stamp.

6. 1996, Rawlings won again. The NPP rejected the polls and claimed the elections were rigged by the electoral commission.

7. 2000, John Agyekum Kuffuor, led the NPP and they won the elections. The NPP claimed the EC was the best in the world.

8. 2004, Jake Otanka Obetsebi-Lamptey, the illiterate party chair of the NPP called the elections at the Castle Gardens ahead of the EC. Forcing the EC to endorse John Kuffuor as the legitimate winner of the polls. Ghana moved on.

9. 2008, Nana Akufo Addo led the NPP but they lost to Atta Mills and the NDC who were then in opposition. Akufo Addo and his coterie claimed that the elections were rigged in favour of the NDC! Imagine an opposition candidate rigging the elections while the government with all of its guns and the Akyem-Asante machinery fully in place looked on?

10. NPP loses 2012 because they put up a bad candidate and insulted all the floating voters.

Now hell has broken loose. How come NPP only accepts election results that goes in its favour?

Also do not digress from the topic under discussion. The issue is why Justice Atuguba isn't recusing himself of a hot issue of such magnitude. Atta Akyea, one of the loudest NPP lawyers is married to the sister of the Chief Justice Georgina Wood. It means Georgina Wood has an interest in the case and by extension, should recuse herfself from not only sitting, but also estopped from empanelling the judges who sit on the case!

You get where this would lead? The politicisation of the supreme court was done by the NPP. I am even surprised that any justice on the supreme court can be tagged NDC today.

Akuffo Addo must just be made the emperor of Kyebi, which is my own traditional second home, because I think the guy is just not a presidential material!

The NPP would even protest the colour of the suits won by the justices. We want them to tell Ghanaians which justices are not skewed against them and who are, the more they cause a delay the more NDC consolidates their rule.

Those who would gain from all this are the lawyers, after all what is clear for all to see would always be disputed by a die hard litigant. That is why John Plaughman said "The houses of lawyers are built on the shoulders of fools"

Indeed, the failure to join it in the first place could have been a solid ground for a motion by the original defendants to dismiss the case (at least without prejudice). Specifically, in addition to being the party that sponsored President Mahama's candidacy, NDC's strong associational rights, which would suffer irreparable prejudice if it is left out, makes it a necessary and proper party. However, contrary to some views expressed on this matter, Mr. Akuffo Addo's inclusion of President Mahama as a named defendant is not inappropriate. The Constitution's insulation of sitting Presidents from lawsuits applies solely to actions taken in a President's capacity as the President. Not only is suing him as a candidate for what transpired during the elections different from the insulated conduct, but leaving out any of these indispensable parties amounts to what one case tersely referred to as "a playing of Hamlet without Hamlet," where a disposition may otherwise be permanently prejudicial to that party's or individua's interests.

At this stage of the process, given the protest, it seems to me that NPP was hoping for a specific group of judges to adjudicate their case before the court. Not having drawn that lot, they are protesting.

Would NPP be ready to accept a verdict that is not in the party's favour?

How is the court constituted at any point in time?

Is the Chief Justice responsible for selecting the nine judges out of the fourteen or fifteen?

Will someone with knowledge of the system, please, clarify the process?

Lastly, can the EC or the lawyers representing EC also protest the paneling of the judges?

If they cannot agree on who should be on the court, does it mean this case will never be heard?

I hope they are not saying they have NPP judges at the Supreme Court which is an insult to our justices who are supposed to be the final arbiter in any conflict. It is indeed an affront on our justice system for NPP to think that a judge of the Supreme Court can be so biased as not to give verdict on the basis of the evidence presented.
In that case NPP want NPP judges to be empaneled for them so that these judges will favour them irrespective of their unconvincing evidence.
This is a slap in the face of our justices themselves.
It is difficult to understand why the NPP do not realise the harm they are doing to themselves. They are losing on all fronts.

I thought the understanding we have is that the judges are fair and will rule on a case depending on the merit of that case.If this is so, why should the NPP protest on the composition of the court? Are they saying the court should be composed of those judges who are sympathetic to their party? The mentality of these people is that they should always have the lion share, ;they are greedy and selfish. Ghanaians have to decide to alienate these group of people in our political discourse.It is very key.
Ghanaians should ask the NPP to name the lawyers they want to constitute the panel at the Supreme Court.We are tired with these people. Their inability to win this election has really bothered them. Looting of state properties and money has been stopped by Ghanaians.

The NPP now want the Supreme Court in this case and presumably when it comes to hearing the substantive petition to be empanelled in its favour. The party obviously does not trust the force of its argument.

It is an insult to the Supreme Court and to the nation for the NPP to dictate to the judiciary. Akuffo Addo and Co. are vexatious litigants and must be denied any hearing.

If it wasn't a serious case, we wouldn't need to go to the polls to elect our nation's leaders.

Meanwhile Tsatsu Tsikata shouldn't be allowed to use any delay tactics as he's done in previous court hearings involving the embezzlement case against him.

Shameful and weak minded lawyers with no brains of theirs but rely on brains of expatriates’ consultancy all the time to survive in their career field.
I thought they wanted the proceedings of the court telecasted live; why are they now asking for the part that has to do with stating their reason for challenging the constitution of the panel in camera? Oh they think the Justices would do what they would have done if they were in the realm of affairs; using family ties to influence decisions.
Come on, half baked lawyers, we all know you have no case but intentionally using these tactic and means to re-launch your disgraced Nana Addo. It will not work!
Disgraced Nana who by all measure is unfit to be president thinks by dragging this case, he would be maintaining his popularity and be re-chosen as flag bearer the third time. Sorry, you are nowhere near the character of the late Mills. Well, Nana would be maintaining his negative popularity; a recipe for another shameful defeat.
If even Atuguba relates someone in government, who told them the respected Justice thinks the way they would have thought? I mean allowing that to influence his decision. He is not a half-baked Judge.
It is a good thing Tsatsu requested for public hearing of their reservation and thank God an opportunity has availed itself to help these half-baked lawyers learn and refresh their minds on the rudiments of law once again. Peace!

Those who come to equity must come with clean hands. The NPP cannot object to Atuguba without objecting to Sophia Akuffo who is the sister of a member of its legal team. In all clean conscience it will have to object to her sitting on the bench. That raises the whole question of where does the conflict of interest with respect to a constitutional case rest.

The judges as citizens of Ghana presumably voted in the elections. To establish neutrality therefore they must all declare not only their political affiliations but which candidate they voted for. Any judge who voted for either candidate will have to be excluded. Chances are there will be no judge qualified or deemed intelligent enough to distinguish constitutional affairs from needless politicking. That is the absurd nonsense merry go round that the NPP is plunging the country into.
