2. The Chief Justice, who is the leader of The Supreme Court and The Judiciary, should defer the inauguration of the President-elect on the basis of 'conflict of interest'. How can the Chief Justice supervise the swearing-in ceremony and later sit on a case involving the person who had been sworn-in by him of her, as a defendant. Here, one can say that, The Constitution erred for not dealing with such a stalemate. There should had been a clause dealing with a situation where a party has disputed the results of the elections and had filed a case at the Supreme Court.
3.Lastly,and in the same vein, the NPP, and Not , Nana Akufo Addo, Dr. Bawumia and Mr. Jake Obestebi Lamptey,( who would not definately attend, for the same reason of 'Conflict of interest') can decide as a party to diassociate itself as a party, from attending the inauguration of The President-Elect Mr. john Mahamah.

And for this same reason, it is rational to conclude that where a party has filed a petition at The Supreme Court challenging the validity of the election results, then impliedly, the person or party has egually put an Injunction Order on any inauguartions mor swearing-in ceremonies.
The Constitution does not need to state in black and white that the inauguration is 'null and void'; It is the duty of The Judiciary to interprete the provision in The Constitution .

If as the Council of the NPP has told its supporters "...the inauguration of the president is not prejudicial to the outcome of case at the SC..." then why in the name of God and national unity are they using the WHIP to prevent NPP parliamentarians from attending what is after all a national event beyond parties?
As a neutral interested in national unity, I believe the NPP has by this action missed a huge opportunity and an old trick in the book of politics which they will come to regret long after the dust has settled. Do they not think that by encouraging their supporters to patronise the event they would have demonstrated to Ghanaians their respect for the event, the office and Ghana's statutes and endeared independents such as myself to them and their cause? What a cork up. This does not show political astuteness in my estimation.
By the way are the NPP not setting a precedent for the future? What if they were to win their case at the SC, and let's say there was even a second presidential poll and their candidate were to win the re-run. Would they then expect the NDC and it's supporters to attend the inauguration? Frankly this is a bad decision and one that surely divides, rather than unites our nation and it is not only a disgrace to the NPP but puts Ghana in a very bad light on the international scene. When Gore was clearly cheated in the US elections of 2000, many were those who were disappointed but we never heard democrats boycotting the inauguration of George W. Bush? And surely the Democratic National Convention never applied to Whip as it we to bar its elected congressmen and senators from participating? I am very disappointed!

The flaw is the Constitution did not specifically state in 'black and white' that the swearing-in ceremonies or inauguration in situations of such a 'stalement'should be declared 'null and void' until the case had been decided by the Supreme Court.
2. In Al Gore's situation, the case was decided by the Supreme Court and 'all the dusts' got settled before the inauguration.
Lastly what happened to America when the Supreme Court Republican Judges decided in favor of President George Bush?....'The Economic Chaos and Recession.' and who knows what will happen to Ghana when this case is not honestly decided?

Some members of the Youth Wing of NPP have decided to PREVENT pPresident JA Kuffour from attending the event, an important state event enshrined in the very constitution which propel like you purport to uphold.
I tell you this decision is a great missed opportunity for eh NPP as far the public sentiment is concerned and will not win them sympathisers from the independents like me. That is all I am trying to get across. If you want to be a successful politician, you have to be really crafty and to me they have missed a great trick, that is all.

This is an unfortunate, cowardly and hypocritical stance by the National Council. How can you say that "the results of an election should reflect the voice of the majority of voters, not the voice of those who count, collate or declare the results" the rights of those who voted to have their votes counted? The petition you (NPP) presented at the Supreme Cort (SC) stated NOTHING that significantly challenged the counting, collating or declaration process.
In case you have forgotten, the bulk of your allegations were against "Voting without biometric verification, instances of votes cast exceeding ballots issued, and polling station results without a presiding officer's signature. These instances are NOT the reflections of the voices of those who count, collate or declare results but rather the reflection of the voices of the people who cast their ballots after going through long hours of waiting in the sun.
BIOMETRIC VERIFICATION
If you really respect and honour the voice of those who cast their votes, your petition to the Supreme Court on the issues of votes cast without biometric verification should have been a prayer to the court to annul the results of the polling stations so affected and give those voters the opportunity to cast their votes "legally."
I say legally because the regulation defining the identification of a voter before proceeding to vote in CI 75 is Section 30 clauses 1 and 2. Whereas Clause 1 (a) and (b) is more of a RECOMMENDATION for the presiding officer (or his assistant) to use a voter ID (or any other form of identification that the EC may deem fit) to identify the voter, Clause 2 on the other hand is an OBLIGATION on the voter (and possibly the EC's representative) to be biometrically identified before being issued with a ballot paper.
Thus, for proper identification, 2 elements are very necessary: 1, The Presiding Officer, and 2, The Biometric Verification equipment. Legal provisions are made for the presencce of these elements in Section 17, for the Presiding officers and Polling Assistants, and Section 18, for the biometric equipment (sub-section 1.b). Whereas in Section 17 provison is made for replacement of the presiding officer by a polling assistant "during the absence or incapacity of the presiding officer" (all human beings), the only item that was to positively identify a voter before being given a ballot (the biomentric equipment) has ONLY a legal directive (adjournment, subject to an approval) backing its replacement in the event of a break-down.
This directive states in Section 34 (1) states that: "Where the proceedings at a polling station are interrupted or obstructed by
(a) riot, open violence, storm, flood, or other natural catastrophe
or
(b) the breakdown of an equipment
the presiding officer shall in consultation with the returning officer and subject to the approval of the Commission, adjourn the proceedings to the following day."
Special notice should be made of the phrase "subject to the approval of the Commission" because if the comission declines the request for adjournment and orders that voting should proceed then voting could proceed without the biometric identification. Sure, such an act could be interpreted as a violation of Section 30 (2) of CI 75, but Section 30 (1) a, and b, is also a valid form of identification. The spirit of the biometric identification is to ensure that the person already identified in section 30 (1) is the voter, so in the event of a breakdown of the machine, and in the presence of all party agents, is it not possible for humans to disentangle themselves from the legal webs of a machine failure?
Moving a step further, Section 31(1) states: "A voter who desires to vote shall be present at the allotted station and the presiding officer or a polling assistant, shall after being satisfied that (a) the voter is registered and has not already voted; or (b) is voting as a proxy; deliver the ballot paper to the voter."
So irrespective of the provision of regulation 30 (b) can a presiding officer who has satisfied himself that a voter is the person presenting an ID card (or any other identification sanctioned by the EC) but is faced with a non-functioning biometric machine give the green light to a voter by issuing the ballot paper?
Whatever the case, in persuit of good faith, what the NPP should seek, if the SC decided to uphold the argument of No Verification No Vote (NVNV), is not TO DISENFRANCHISE the innocent voters who performed their civic duties over hours in the sun, but rather an EQUAL OPPORTUNITY for the said voters to LET THEIR VOTES COUNT. And this can simply be done by seekring re-voting in the affected polling stations instead of STRIKING OUT the votes of those areas as if the voters never appeared at the polling stations to vote.
ALLEGATIONS OF OVER-VOTING vrs SPECIAL VOTING
Was Over-voting a significant issue?
From the NPP's calculations, over-voting was a serious issue, as they alloted over 600,000 votes to the allegation. But is this figure real? Did the NPP factor in the votes of those who voted on Tueday December 4? With the help of CI 75, I gleaned some answers, which meant the NPP might have failed to factor into their calculations the voters of December 4 special polls.
Section 21, sub-sections 10 and 11 states:
"10. Subject to sub regulation (11) voting at a polling station for special voters shall be conducted in the same manner as voting on polling day.
11. The returning officer shall at the end of the special voting
(a) ensure that the ballot boxes are kept in safe custody after the poll has closed;
(b) ensure that the ballot boxes are sealed with the seals of the Commission and any candidates who wish to add their seal;
and
(c) arrange for the ballot boxes to be opened at the time of the counting of the votes cast on the polling day and the ballot papers shall be counted in the same manner as those contained in the ballot boxes used on the polling day."
The meaning of the above is a clear indication that the ballot boxes of the special voters were taken to the polling stations (where special voting took place) and incorporated in the mainstream counting. As this is the assumed occurence then the incorporation meant that extra (but legal) votes would appear to have been included to the mainstream data by any cursory observer who fails to take the special voting into account, and relies only on the ballot booklet accounting to audit polling station total votes.
The arguments used by the NPP at their press conference after filing the petition failed to include special voters in their calculations. When this is done the total number of real over-votes is bound to diminish to a highly insignificant quantity, and destroy the cornerstone of their result massage theory.
OTHER ALLEGATIONS.
Other allegations such as same serial numbers of pink sheets or ballot booklets from different polling stations; failure of presiding officers to sign documents; words not matching figures; etc., sum up insignificant numbers to affect the outcome of the election so I wont deal with them. I will only say that most of these constitute administrative and human lapses that can easily be corrected.
