This motion filed is so strange. Courts normally writes their rulings mostly before lawyers and prosecutors files their submissions. Courts do not relies on lawyers submissions in writing their rulings. Courts also bases their rule writings on court’s evidence. Lawyers and prosecutors submissions just helps them in law’s reference and quotations. These are some of the reasons some lawyers do not even file submissions. Unless Lawyer Atta Akyea wants to use this as delay tactics by filing appeals on it, not really an issue. For delay tactics, defence wants to fight for any undotted I and uncross t. Justice Achibonga has probably written his rulings long time ago and just reading over and doing some minor corrections now .

Atta Akyea has used a backdoor approach to response to the submissions made by the AG. Whether the issues he has canvassed are true or not, the judge now cannot ignore them. Yes, in principle, a material is not in evidence, cannot be tried upon.
