Good call! One point I really like is how some sellers present a genuine root of title but a different site plan. Double check with the national grid and a licensed surveyor to make sure the land they are offering is the same as what is in the lease! Another thing is to check if the seller’s claim to the land is still valid and has not been extinguished by a court of competent jurisdiction. Check if there are any ongoing suits. Some sellers are wicked and some buyers are naive and ignorant. They won’t tell you there is an ongoing litigation or that their ownership has been invalidated. Don’t just rely on lands commission alone, go an extra mile to check courts records if that particular land is known in court records. It takes time for the changes to reflect in ghe SMD of lands commission so if the old record is still there and has not been updated after a judgement, you are getting yourself into a trap. Lastly, some buyers are very stubborn, they think by continuing building despite protest or injunctions is normal . Nooooo, it’s a risk you have to blame yourself. Once a protest has been made, adverse possession clock stops and if even it take 20 years to litigation you will loose it because your occupation all this while does not count and you took the risk and you should not expect sympathy from the court or the judgement creditor. Acquiescence does not help either because you knew the consequences and you choose to take it. Even if a court denies the other party’s injunction and ask you to continue building, note that it has no weight when the substantive matter is settled. If you loose you loose everything.

I did work at Land department for 5 years. Our system is not properly laid out to avoid dubious sales.
I bought a 20 plot of land in Koforidua in 1980. As an experienced Lands Department official. I did all that you wrote. Yet the seller proved to be dubious years later in court. Today I have the indentured, registered at Lands yet all the 20 plots are developed my other people who bought from another family member.

It must be a project to digitally map all the areas so that both seller and buyer appear at the lands office for identification and execution of the transaction. The lands commission verifies the legitimacy of the seller and ensures the sold land is taken off the map. Any other person who want to buy that parcel is automatically notified that it is already sold and provided details of the current owner. So in short, no transaction can be effected without the involvement of lands commission. It’s a win win situation. Govt gets its stamp duty, seller and buyer walk away without risks.

All that you written is the ideal situation. This never happens in Ghana. Most buyers are not stupid. They do all the due diligence and take all the steps you have outlined but their lands are still taken from them or resold to another. There is so much impunity in this country from politicians and state actors who connive with criminals to take people's land away from them. There's no enforceability of our laws and our courts are corrupt. That's what you must really address and not what you just published. Many follow your prescriptions but they still loose money or land. Are you not in Ghana?

You hit it right on! No enforcement processes. The legislature must empower the courts to setup enforcement units where marshals take up all the procedures once judgement is pronounced and the judgment creditor has provided the necessary instructions and paid the fees. Currently, you have to write a letter to the police for assistance, pay cola etc etc and follow all other kinds of bureaucratic procedures including permits from the district or municipal authorities where applicable, disconnect utilities etc. Sometimes you end up not being able to execute judgement and the judgement becomes a piece of paper. More stringent and expedited measures are needed to serve as a deterrent to landguards and others who return to the land. Only with such measures will people become cautious when encroaching because they learn the hard way that once you loose it will not be easy for you.

The indiscipline and lawlessness in Ghana is way too much. This is the reason I believe Ghana may never be prosperous.
