I stand to be corrected but unless I missed a sentence or two from Ms. Sophia Akuffo, the former CJ, she hopelessly devalued the CJ brand when she said there is no member of the Council of State who has the wherewithal to make a determination of prima facie case but a former CJ on the council who is trained from years of law practice to do so. I was taken aback not because of what Ms Sophia Akuffo said but because there has been no lawyer in Ghana worth a dime who challenged that nonsensical statement.
Does the Ghana constitution recommend use of jurors or cases that can tried before a jury in our entire legal system? If so how could a collection of citizens who are not educated in law or had law training take instructions from a judge (-who may or may not be prejudiced against a defendant, who may have been bribed with judicial promotion depending on conviction of the defendant or a judge who habours tribal or political party animus against a defendant offer convincing instructions-) to turn jurors into understanding what societal moral norms and standards are?
If Ms. Sophia Akuffo's illogical diatribe is the prevailing sentiments among justices on the Courts in Ghana, then we do not and could never attain, retain and sustain the ideal of "everyone being equal before the law" or "no one being above the law". It couldn't be if apparently judges believe they are the collection of people with logical and intellectual know-how for determination of prima facie against an accused. Are we to ignore the fact the charge of any crime of moral turpitude was not derived from the legal society but from the moral compass of the community.
A community or society that believes in the ideals of the infamous "animal kingdom" could never establish a prima facie case against anyone from the preferred group or class and Ghana is not and has never been an "animal kingdom" type of land no matter how bad the Sophia Akuffo's of Ghana want us to be.
