*The law says:*
- Under the *Constitution, the Land Act 2020 (Act 1036), and common law*, the foreshore - the land between the high-water mark and low-water mark - plus *50 to 100 meters inland* from it, is *public land vested in the President on behalf of the people*.
- The statement is: _"No individual, stool, family, or hotel can own it"_. 95a1
*What Traditional Councils own:*
- They own the *adjoining dry land* behind the beach. That is stool land.
- What they can do is give leases on that dry land. The beach itself is only held on *permissive use*. It remains a public amenity. 95a1
*Why there is confusion:*
The search result notes: _"For some entitled reasons, some traditional authorities erroneously assume that their land ownership extends to the shorelines"_. So many councils have been collecting rent from beach operators and giving 20-year leases - like the La Stool gave a GH¢1.5m lease for Polo Beach Club - but legally those leases cannot cover the actual foreshore. 95a12e33
And in 2022 Cabinet approved a *National Coastal Development Buffer* - 50 meters from high-water mark, 100 meters in high-risk areas like Labadi, Ada, Elmina - no permanent structures inside it without Cabinet approval. 63e4
So in short:
- *Sand + water + 50-100m buffer = Government / public*
- *Land behind that buffer = Can be stool/family/private, managed by Traditional Council*

Demolition alone is not enough. If illegally acquired properties are being demolished, the authorities must also pursue those who allegedly facilitated or profited from the unlawful transactions, including this La Traditional Council. The government must investigate the alleged land sellers, establish responsibility through due process, and prosecute where the evidence warrants it. The law must apply to both those who acquire illegally and those who unlawfully sell or allocate the land.

This statement appears mischievous in so many ways and intended to ride on the wave sentiment it has naturally generated, especially in the absence of factual examination.

No new agreement has been entered into by the state to relinquish that piece of real estate among the larger parcel which includes all of the trade fair site, to the La stool.
Any attempt by the traditional council or any individual or group of individuals to lease, sub-lease to third parties or in any form or shape appropriate any part or portion of that real estate or be seen to be claiming ownership of same is illegal and should be considered wilful encroachment of state property.
The state therefore reserves the right to enforce its rights of ownership, especially considering that these encroachers and squatters have consistently and with impunity, disregarded and violated both the spirit and letter of all INFORMAL agreements ALLOWING THEIR LIMITED and RESTRICTED use of the real estate.
That this matter has come to a head because it directly involves the security of the state and undermines the collective benefit of Ghanaians is instructive.
While it may be perceived with SENTIMENT, it is in the larger scheme of things, a blessing in disguise for all parties involved.
The La traditional council, by virtue of State acquisition of its real estate under LI10, is owed outstanding compensation.
However, this compensatory framework would be deemed legally inexecutable or voided by any act or acts of encroachment of property it has ceded by law to the state.
Notwithstanding the forgoing, and while the state has asserted its rights to what duly belongs to it and tightly so, it shall also commit itself to honour its outstanding obligations to the La traditional council as outlined and agreed in the acquisition of the said real estate under statutory law, LI10.
La, like any community in Ghana and its people, deserves its fair share of the national cake. It behoves the state to do its duty in that regard.
The Chiefs and people of La must also recognize the larger oversight authority of the state and its statutory obligations to our collective fortunes as a nation and play their part as law-abiding citizens.
We must all understand that we cannot be seen to be entitled, unlawful and illegal private beneficiaries of the resources of the state at the expense of the collective national agenda. That is a recipe for national collapse.
Let us not take lessons from HAITI in how not to be an orderly, disciplined and viable Republic.
