1. The Council of State’s role in screening a petition against the Chief Justice is a result of Agyei Twum v Attorney-General. The Supreme Court held that, before appointing a committee of inquiry, the President must determine in consultation with the Council whether the petition discloses a prima facie case.
2. Justice Sophia Akuffo presided over the court that reached that conclusion. The judgment gave the Council a prominent role in the screening process. It can be assumed that Justice Akuffo and her colleagues deemed the Council competent to make the determination.
3. A prima facie determination asks a limited question: taking the allegations at face value, do they disclose grounds warranting a full inquiry? It does not decide whether the allegations are true.
4. Preliminary screening occurs in civil, criminal and administrative settings. Its use in a criminal case does not make it inherently “quasi-criminal.” Its use by a judge does not make it exclusively judicial. Lay grand juries, for example, perform a comparable, though legally distinct, screening function when deciding whether there is probable cause to indict.
5. Justice Akuffo was entitled to disagree with the Council’s conclusion on the petition against Chief Justice Torkornoo. Other 30 members supported a prima facie finding. But disagreeing with the answer is not the same as saying the Council was unqualified to take part in answering the question.
6. She is, of course, entitled to argue that Agyei Twum should be reconsidered. In an appropriate case, the Supreme Court may depart from its precedent. But if she now believes prima facie screening is exclusively a judicial act, she should explain why the court she presided over gave that role to the President in consultation with the Council.

How would any justice on any court bench determine a prema facie case that alleges misconduct if misconduct is currently open to individual moral stance/measure?
If we are to assume that deductive legal thinking is required to determine prema facie on the subject of misconduct then should people with legal minds/law school certification and GBA membership not do? Is there not a person with legal background required besides a former CJ?
When it is all said and done, the Mahama government may deserve blame for NOT impeaching Sophia Akuffo who also is believed to have billed the Akufo-Addo government for private travels. At the very least the council of state should have demanded of Sophia Akuffo to recuse herself from the Gertrude Torkornoo case because she, Sophia Akuffo, is guilty of the same crime/misconduct charge.
There's no bad faith precedence here except for the NPP who believed they were going to win all political cases that went to the Ghana SC for as long as Gertrude Torkornoo stayed on the bench.
