The issue of effective and efficient "running" of state institutions is not the lack of laws but the incorporation of foreign laws into ours and lack of enforcement of the laws we have on our books.
In the past 24-months those Ghanaians with independent functional brains, and not one of the herd of sheep, saw and continue to see the effects of sold and bought justice at work in Ghana. We also saw the corrosive effect of the GBA on our judiciary while the GJA damaged all that should have been good about freedom of speech and assembly in Ghana.
If we do not build in our laws the rights of citizens to seek monetary and compensatory damages from the state when we are wronged by actions of state actors, then the least we can entertain is Nolle Prosequi. If a government with all the tools of the courts and unlimited human resources, and after shopping around for favourable judges, the state prosecutors cannot conclude their case in 3-years then the use of Nolle Prosequi must save the state and the day.
Can any lawyer in Ghana explain how the former CJ, Justice Gertrude Torkornoo, could have assembled some SC justices to hear a case in less than a 24-hour period brought against parliament by Hon Afenyo-Markin while under same CJ Gertrude Torkornoo political cases against opposition party leaders should go on for over 2-years? Can the same lawyer group explain why and how the same Hon Afenyo-Markin was not sanctioned when he met disciplinary council for lawyers for breach of ethics in the divorce case between his client and her husband that resulted in the removal of 2 children from school without consent of the custodial father?
When it is all said and done, we will need an overarching rights of citizens to sue the state where people hiding behind the powers of state harm citizens in more ways than one. Until then, Nolle Prosequi saves the day for wrongfull and vengeful prosecution by the state and a government that walks away without paying a price for its abuse of power.

2. the court denies the application and directs the AG to proceed with prosecution
3. the AG rises and announces "that is the end of the case of the prosecution"
