Just some weeks ago, when a witness failed to sign a sheet, the Judge postponed the case for almost one month , for signature oooo. At least at tribunal, they will get you a pen to sign when in the witness box there and then . On a Case management and a printing paper ink not readable, so two weeks postponement. How many minutes does it take it re- print, but one month according to the judge. Especially those judges recommended by Gary Nimako Marfo haaaaaaa about 50 of them in the High Court alone or Dame Supreme Court justices before 2025, forget it , postponing saaaaaa

What exactly does it mean when people say the judiciary can be improved with more judges and staff to get the job done instead of augmentation or supplimentation via tribunals?
Tribunal courts have not been permanent fixtures. Like them or loathe them tribunals cut through the chase and effectively minimize the lawyer initiated delays that have become mainstay with standard courts. Would Wontumi lawyers have completed their defense only to seek new counsel during case summary phase so a new lawyer can be retained to this its best to delay the judge from rendering a verdict?
Furthermore, we overlook the root causes of the rather meager wages and salaries of civil and public servants in Ghana that drives bribery and corruption as the viable option for government workers to make ends meet. Increasing the number of justices and court staff and all tge logistics needed to create permanent additions to the courts simply means adding permanent expenditures and associated overhead cost to an already overbloated, ineffective and inefficient government bureaucracy that stiffle adequate compensation of quality work and services.
So while the judges and staff expenditures are a wash or break-even with additional courts, the temporary nature or as needed aspect of tribunal courts help governments with keeping annual estimated or actual budget numbers low. The one thing I wish the Tribunal legislation could have done for the soul of Ghana is to have made it mandatory that all land developments where structural foundations are more than 20 percent completed shall be registered with appropriate government agencies. It beats any logic for any department or agency of the government of Ghana to make a claim that government collects taxes if the government has zero chance of knowing who owns what property in Ghana. Maybe lawmakers love the anonymity because some amongst the elite class do most of their hiding of pilfered government monies in unregistered properties.

Many of these Ghana lawyers and Judges have studied at European, American and Australian universities and know how the court systems in those countries function. Why then can't they implement similar simple rules to be followed by all courts in Ghana? Also, it will be helpful if the Police were only to refer criminal cases to the Attorney General's Office for prosecution instead of introducing cases in court, for this too causes unnecessary delays in the system. Examine the current rules of civil and criminal procedures, then determine what within those rules may need to be changed to allow for an efficient operation of cases through the courts. Instead of wasting resources building a tribunal system, take steps to ensure that courts abide the rules of procedure, and courts that fail to do so should reprimanded by the appropriate bodies. If your gets clogged, you don't ask a plumber to install a second toilet in that bathroom; you have a plumber unclog it, and then make sure that the occupants of the facility or residence do not do things that will cause the toilet to get clogged. Thus, check the corruption that permeated the court system; check to make sure that court staff are familiar with rules that their courts are supposed go by; and have a phone number available to the public where that they can call to complain about unnecessary delay in their cases. Finally, employ retired Judges and retired lawyers to periodically visit courts in all the regions to examine their court records to ensure that these courts are fully complying with the rules that govern their courts.

Also there should be a process whereby cases proceed in hierarchical order from one court to another. The current process where lawyers jump from say a high court to a court of appeal for ongoing cases to context certain rulings of the high court should cease. The high court should conclude the case in it's entirety and an appeal only file after where an aggrieved party isn't happy with the judgment. The jumping from court to court significantly contributes to the delay in concluding cases.
