I beg to differ from Otumfuo in his claims that no family owns allodial land in Asanti region. The facts remain that before the formation of Asanteman, there were chiefs and families who own lands. For example Ofinso, Kumawu, Mampong, agogo etc were in existence and they own their land and at no time/where they did secede their lands to the Golden Stool. They all accepted the Golden Stool as embodiment of their spiritual and political stool. Actually, they do not plagued alliances to Kumasihene but rather to the Golden Stool. The Golden Stool per se do not own land. Each mamhene , individual subchiefs and families own their lands.
Believe Otumfuo is according himself somethings that does not align with Asanti traditions and customers. The 7 Amamhene who formed Asanti were all equal but Asantihene was equal among equals.The Asantehene is supposed to be military leader and custodian of Golden Stool.
Please note the writer is not trying to diminish Asantehene structure in the Asante. He is the supreme military leader of the Asante Kingdom but the revered King or Golden stool does not own the lands in Asanti region. For example, when General Achaempong government wanted to acquire lands in Afram plains, the government dealt with Kumawuhene and not Asantehene. Because the land belong to Kumawumam. There are a lot of examples existed in Ghana history.

The citing of the recreating of the Asante Confederacy in 1938 to support the argument that stools own lands fails to consider how colonialism distorted the Asante land tenure systems. Although customs evolve and adapt to changes of the time, I argue here that the colonial project created this land tenure system and forced it upon the people. The English feudal system is what is the Asante King indicated. What was the nature of customary land law prior to 1938? Did the then Asante paramount chiefs understand allodial title, usufructuary rights, leases, etc? Does the Asante Twi have words for allodial ownership, usufurtuary interest, leases, etc? This suggests that these land rights are new version of customary land law that did not exist in the rural areas of Asanteman. Consequently, if anyone employs such knowledge to categorise land ownership in Asanteman, it will generate lots of tension. The reason is that some stools were elevated in certain communities whose royals were not the original settlers. In addition, the other implications of the new land ownership are that all clans that are not royals in communities are recognised as second class clans. They do not have identity and are tenant-at-will of their chiefs. Their allodial title holders (chiefs) can evict them with or without compensation. This is helping in peri-urban communities around Kumasi Metropolis. This can create apathy among the people, which may affect community development. I think the Asante King should consider history as tool to understand the nature of land ownership in Asanteman instead of leaning only on what occurred in 1938.

Did the then Asante paramount chiefs understand allodial title, usufructuary rights, leases, etc? Does the Asante Twi have words for allodial ownership, usufurtuary interest, leases, etc? This suggests that these land rights are new version of customary land law that did not exist in the rural areas of Asanteman. Consequently, if anyone employs such knowledge to categorise land ownership in Asanteman, it will generate lots of tension. The reason is that some stools were elevated in certain communities whose royals were not the original settlers. In addition, the other implications of the new land ownership are that all clans that are not royals in communities are recognised as second class clans. They do not have identity and are tenant-at-will of their chiefs. Their allodial title holders (chiefs) can evict them with or without compensation. Land evictions are happening in peri-urban communities around Kumasi Metropolis. This can create apathy among the people, which may affect community development. I think the Asante King should consider history as tool to understand the nature of land ownership in Asanteman instead of leaning only on what occurred in 1938.
