There was flooding in 1960, in 2026 it is worse than that time.

Citizens invoke the Supreme Court to test the limits of presidential tenure and constitutional clarity
Accra — Three Ghanaian citizens have filed a case at the Supreme Court seeking an interpretation of Article 66 of the 1992 Constitution of Ghana, reigniting national debate over presidential term limits, tenure, and what the framers of the Constitution truly intended.
The move is both a civic right and what many legal observers are calling a direct test of the country’s legal minds and judicial independence.
What Article 66 Says
Article 66 governs the tenure of office of the President. The key provisions state:
1. 66(1): A person shall not hold office as President for more than two terms of four years.
2. 66(2): A person elected as President shall hold office for a term of four years beginning from the date on which he is sworn in.
3. 66(3): The President shall cease to hold office on the expiration of his term unless re-elected.
4. 66(4): The President may be removed from office under Articles 69 and 70.
While the two-term limit appears clear, legal experts say ambiguities arise around succession, resignation, impeachment, and what constitutes a “term” in special circumstances.
Why the 3 Citizens Filed
According to court documents, the applicants argue that Ghana needs a definitive judicial interpretation of Article 66 to prevent future constitutional crises.
Their stated reasons include:
1. Clarity for the Republic: To settle any potential dispute over presidential tenure before it becomes political.
2. Testing the Constitution: To see how Ghana’s apex court interprets key provisions that have never been fully litigated.
3. Protecting Democracy: To reinforce that the Constitution, not political convenience, dictates how long a President can serve.
“This is our right as citizens under Article 2(1) of the Constitution,” one of the applicants stated. “We are not challenging any person. We are asking the court to tell us what the law means, so that all of us — government, opposition, and citizens — are guided.”
More Than a Case — A Test of Legal Brains
Constitutional lawyers say the filing is significant beyond the parties involved.
“It’s a stress test for our democracy,” a senior lawyer in Accra noted. “Article 66 looks straightforward, but when you start asking questions like: what happens in case of a mid-term vacancy? Does an uncompleted term count as a term? Can a President who resigned run again? — that’s where interpretation matters.”
The Supreme Court will be expected to weigh original intent, precedent, and comparative constitutional law. For many young lawyers and law students, the case has already become a moot court exercise.
It also puts the judiciary in the spotlight. Ghanaians will be watching to see how the court balances strict legal text with the democratic principles the 1992 Constitution was built to protect.
Public Reaction
On social media and radio, reactions have been mixed.
- Some hail the applicants as patriots using legal means to strengthen accountability.
- Others worry the case could be politicized ahead of elections.
Civil society groups have largely welcomed it, saying Ghana’s democracy matures each time citizens use the courts, not the streets, to seek answers.
What Happens Next
The Supreme Court is expected to set a date for hearing soon. Once arguments are heard, the Court’s interpretation will become binding law under Article 2(2).
Regardless of the outcome, the filing itself has already achieved something: it has forced a national conversation about constitutional limits, and reminded Ghanaians that the Constitution belongs to the people — and the people have the right to ask what it means.
Bottom line: It’s their right. And it’s also a moment for Ghana’s legal brains to show how a 1992 document continues to guide a 2026 democracy.
