There is no requirement to have a lawyer to draw a will just as there is no requirement to have a lawyer represent a person in the court of law. But you can bet that an accused who decides to self-represent in court is very likely to lose his or her case. Having a lawyer to draft a will is to ensure that very pertinent detail is clearly spelled out to make the document enforceable. Yamoah Paintsil’s comment is very simplistic and rather uninformed, especially from someone who presents himself as an attorney. Please don’t mislead people.

While the preparation of a will does not strictly necessitate legal representation, it is crucial to adhere to the fundamental requirements stipulated in the Wills Act 1971 (Act 360). Furthermore, case law has provided additional clarification on these stipulations. Therefore, it is strongly recommended that individuals intending to draft a will, whether for themselves or on behalf of another, seek guidance from a professional possessing at least a Bachelor of Laws (LLB) degree.
