When an office pre-finances activities through cash, MoMo, or bank account, there should be records: receipts, approvals, purpose, date. That’s legitimate if it’s tied to a specific activity/event.
If someone takes money from the office that isn’t linked to any approved/pre-financed activity, that’s typically treated as an unauthorized withdrawal. In a fraud case, the court looks at intent, documentation, and whether the money was used for the stated purpose.
Why a judge likely wouldn’t allow unrelated expenses as a defense
Evidence has to be relevant to the charge. If the charge is fraud/misappropriation, bringing up expenses unrelated to the alleged activity doesn’t disprove the charge. It can look like trying to muddy the waters.
A judge will usually only admit evidence that:
- Directly relates to the alleged offense
- Shows a legitimate business purpose and proper authorization
- Is backed by records at the time the transaction happened
“Back-dated” or unrelated expenses won’t usually fly as a defense.
