However, after listening to Srem-Sai on the Joy Fm super morning show today (17th April), I became convinced about the technicalities. To explain it a lay mans language. The power to Prosecute is an entrenched clause in the constitution given solely to the AG and you can't use Parliament to alter an entrenched clause ( only by constitutinal amendment and affirmed by a referendum). The OSP However claims to have Independent prosecutoral powers which the AG disagrees. The OSP is therefore bound to seek the consent of the AG before embarking on any prosecution. The AG says they are ready to collaborate with the OSP to give them authorisation to prosecute cases. John Mahama is committed to making the OSP work and the constitutional amendments ongoing will factor in the necessary provisions to make the OSP truly independent. The accused person went to court and asked the court to rule whether the OSP has prosecutorial powers. The judge, in his ruling, made it clear with regard to the 1992 Constitution that all prosecutions, including those of the OSP, must be subject to the Office of the Attorney General. The question then is why is Kofi Bentil wagging his tail and barking at government. Is he now seeing the judge as the government? Richard Sky was the one who took the LGBTQ+ bill to court. A bill, not an act, to court. Richard Sky was working in Afenyo-Markin's law firm. Bentil now thinks its the same scenario playing out. And was it not the President who rose against steps initiated by both the NDC and the small NPP to flash out Kissie Adjabeng recently? What is this Bentil saying then. He is learned but his party went down the slope for corruption and abysmal performance.
